 1                    AMENDMENT TO SENATE BILL 1647

 2        AMENDMENT NO.     .  Amend Senate Bill 1647 on  page  52,
 3    immediately below line 23, by inserting the following:

 4        "Section  10-55.  (a)  Upon the payment of a sum equal to
 5    the appraised fair market value of the  real  estate  to  the
 6    Department  of  Natural  Resources,  the  Director of Natural
 7    Resources, on behalf of the State of Illinois, is  authorized
 8    to  execute  and  deliver  to  the Makanda Evergreen Cemetery
 9    Association, its successors and assigns, a quit claim deed to
10    the following described  real  property,  provided  that  the
11    Grantee pay title and closing costs, to wit:
12        Two  (2)  acres in the Southeast Quarter of the Southwest
13        Quarter of Section 27, Township 10 South, Range 1 West of
14        the Third Principal Meridian, Jackson  County,  Illinois,
15        being  described  as  follows: A strip of land of uniform
16        width containing 2.00 acres, adjoining the East  line  of
17        the  existing  cemetery which lies northerly and easterly
18        of the public road, said strip being bounded on the North
19        by the easterly prolongation of the North  line  of  said
20        cemetery, and being bounded on the South by the northerly
21        right-of-way  line  of  said public road, a more accurate
22        legal description to be prepared from  an  accurate  land
23        survey  to  be  made  by  an  Illinois  Professional Land

 1        Surveyor.
 2        (b)  The  conveyance  of  real  property  authorized   by
 3    subsection  (a) is subject to: (i) existing public utilities,
 4    existing  public  roads,  and  any  and   all   reservations,
 5    easements,   encumbrances,  covenants,  and  restrictions  of
 6    record and (ii) the  express  condition  that  if  said  real
 7    property  ceases  to  be  used  for burial ground purposes it
 8    shall revert to the State of Illinois, Department of  Natural
 9    Resources.".
