AMENDMENT TO SENATE BILL 3802

AMENDMENT NO. ______. Amend Senate Bill 3802, AS AMENDED, by replacing everything after the enacting clause with the following:

"Section 5. The following grant funds and grant programs have been identified by the Illinois Emergency Management Agency as subject to the provisions of Section 4.2 of the Illinois Grant Funds Recovery Act, and, on and after the effective date of this Act, the suspension of authorization is lifted for the Illinois Emergency Management Agency to make grants for these grant funds and grant programs:

Section 10. Section 15. The following grant funds and grant programs have been identified by the Department of Insurance as subject to the provisions of Section 4.2 of the Illinois Grant Funds Recovery Act, and, on and after the effective date of this Act, the suspension of authorization is lifted for the Department of Insurance to make grants for these grant funds and grant programs:

Section 20. The following grant funds and grant programs have been identified by the Department of State Police as subject to the provisions of Section 4.2 of the Illinois Grant Funds Recovery Act, and, on and after the effective date of this Act, the suspension of authorization is lifted for the Department of State Police to make grants for these grant funds and grant programs:

Section 990. Construction.

(a) All references to State or federal statutes, regulations, or other law in this Act shall be construed to include any subsequent amendment, recodification, reenactment, reorganization, or change in name of that statute, regulation, or law in the same or a substantially similar form as that statute, regulation, or law. All references to court orders and consent decrees in this Act shall be construed to include any subsequent amendment or other change to that order or consent decree in the same or a substantially similar form as that order or consent decree, made by a court of competent jurisdiction.

(b) All references to State or federal statutes, regulations, and other law, or to specific grant programs, shall be construed to include any additional grant programs or subgrants made by the same agency under the State or federal statutes, regulations, other laws, or grant programs specified therein.

Section 992. Grant programs enacted on or after July 1, 2012. For any grant programs or funds enacted by statute or regulation, or established pursuant to a settlement agreement ordered by a court or entered into, on or after July 1, 2012 that would otherwise be subject to the provisions of Section 4.2 of the Illinois Grant Funds Recovery Act, the suspension of authorization is lifted for the appropriate grantor agency to make grants for those grant funds and grant programs until July 1, 2017.

Section 995. Repealer. This Act is repealed on July 1, 2017.

Section 999. Effective date. This Act takes effect July 1, 2012.".
