 1        AN ACT concerning real property.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4                             Article 5.

 5        Section 5-5.  Upon the payment of the sum of  $1  to  the
 6    State  of  Illinois  and  the tender by the Village of Tinley
 7    Park of a certified survey of  the  land  described  in  this
 8    Section,  current  within  6  months,  the Secretary of Human
 9    Services is authorized to convey by  quitclaim  deed  to  the
10    Village  of Tinley Park all right, title, and interest in and
11    to the land in Cook County, Illinois commonly known as:
12        THAT PART OF THE WEST 1900 FEET OF THE SOUTHWEST  QUARTER
13        OF  SECTION  36,  TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE
14        THIRD PRINCIPAL MERIDIAN LYING SOUTHERLY OF THE SOUTHERLY
15        RIGHT OF WAY OF THE  CHICAGO,  ROCK  ISLAND  AND  PACIFIC
16        RAILROAD  (COMMONLY  KNOWN  AS  THE  METRALINE) AND LYING
17        NORTHERLY OF THE NORTHERN TRIBUTARY TO THE UNION DRAINAGE
18        DITCH (EXCEPTING THEREFROM THAT PART, IF ANY,  TAKEN  FOR
19        80TH  AVENUE), IN COOK COUNTY, ILLINOIS AND CONTAINING 56
20        ACRES.
21        The legal description of the land  that  appears  in  the
22    quitclaim  deed  shall  conform  to the survey required under
23    this Section.

24        Section 5-10.  Upon the payment of the sum of $1  to  the
25    State  of  Illinois,  the  Secretary  of  Human  Services  is
26    authorized to convey by quitclaim deed to the United Cerebral
27    Palsy  Association  of  Greater Chicago all right, title, and
28    interest in and to  the  following  described  land  in  Cook
29    County, Illinois:
30        THAT  PART  OF  THE  SOUTH 1/2 OF SECTION 36, TOWNSHIP 36
31        NORTH, RANGE 12, EAST OF THE  THIRD  PRINCIPAL  MERIDIAN,

 1        DESCRIBED  AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER
 2        OF SAID SECTION 36; THENCE WEST ALONG THE SOUTH  LINE  OF
 3        SAID  SECTION 36, 2237.39 FEET; THENCE NORTH 0 degrees 00
 4        minutes WEST, ALONG A LINE PERPENDICULAR  TO  SAID  SOUTH
 5        LINE,  50.00  FEET TO THE POINT OF BEGINNING ON THE NORTH
 6        LINE OF 183RD STREET; THENCE CONTINUING NORTH  0  degrees
 7        00  minutes WEST, 124.75 FEET; THENCE NORTH 33 degrees 04
 8        minutes WEST, 99.70 FEET;  THENCE  NORTH  72  degrees  25
 9        minutes  40  seconds  WEST,  105.00 FEET; THENCE NORTH 90
10        DEGREES WEST, 139.51 FEET;  THENCE  SOUTH  0  degrees  00
11        minutes  EAST,  240.00  FEET; THENCE EAST, 294.01 FEET TO
12        THE POINT OF BEGINNING, ALL IN COOK COUNTY, ILLINOIS  AND
13        CONTAINING 1.50 ACRES.

14        Section  5-15.   The  Secretary  of  Human Services shall
15    obtain  a  certified  copy  of  the  portions  of  this   Act
16    containing  the  title,  the  enacting  clause, the effective
17    date,  the   appropriate   Sections   containing   the   land
18    descriptions  of property to be transferred, and this Section
19    within 60 days after this  Act's  effective  date  and,  upon
20    receipt  of  payment  required  by  the appropriate Sections,
21    shall record the certified document in the Recorder's  office
22    in the county in which the land is located.

23        Section 5-20.  In consideration of the use of the land by
24    Hardin   County  for  public  purposes  and  without  further
25    compensation, the Board of  Trustees  of  the  University  of
26    Illinois  is authorized to convey by quitclaim deed to Hardin
27    County all right, title, and interest in and to the following
28    described land in Hardin County, Illinois:
29                               Tract 2
30        Beginning at a point where the East line of the West-half
31        (W 1/2) of the Southeast  Quarter  (SE  1/4)  of  Section
32        Fourteen  (14),  Township  Twelve (12) South, Range Eight

 1        (8) East of the Third  Principal  Median  intersects  the
 2        North right-of-way line of Illinois State Highway No. 146
 3        (being  the  Southeast corner of a tract of land conveyed
 4        to the University of Illinois by Warranty  Deed  recorded
 5        January  10,  1917  in  Deed  Book 12, at pages 505-506),
 6        thence North a distance of Four Hundred Thirty (430) feet
 7        to a point, thence  East  a  distance  of  Three  Hundred
 8        Thirty  (330) feet to a point, thence South a distance of
 9        One Hundred Forty Five and Twenty One Hundredths (145.21)
10        feet to the North  right-of-way  line  of  said  highway,
11        thence   in   a   Southwesterly   direction   along  said
12        right-of-way line Four Hundred  Thirty  Five  and  Ninety
13        Hundredths (435.90) feet to the point of beginning, being
14        2.18  acres  more  or  less,  situated  in HARDIN COUNTY,
15        ILLINOIS.

16        Section 5-25.  The Board of Trustees of the University of
17    Illinois shall obtain a certified copy  of  the  portions  of
18    this  Act  containing  the  title,  the  enacting clause, the
19    effective date, the appropriate Sections containing the  land
20    descriptions  of property to be transferred, and this Section
21    within 60 days after this  Act's  effective  date  and  shall
22    record the certified document in the Recorder's office in the
23    county in which the land is located.

24                             Article 10.

25        Section 10-1.  Short title.  This Article may be cited as
26    the   Ft.   Dearborn   United   States  Army  Reserve  Center
27    Retrocession Law.

28        Section 10-5.  Authorization to accept retrocession.
29        (a)  Under the provisions of Section 2683 of Title 10  of
30    the  United  States  Code,  the  State of Illinois authorizes
31    acceptance of retrocession by the United States of America of

 1    exclusive  legislative  jurisdiction,  to  the  extent   such
 2    jurisdiction  has not previously been retroceded to the State
 3    of  Illinois,  the  United   States   retaining   a   federal
 4    proprietary  interest  only, over lands consisting of the Ft.
 5    Dearborn United States Army Reserve Center, located at O'Hare
 6    International Airport in Chicago, Cook County, Illinois, more
 7    particularly described as follows:
 8             THAT PART  OF  THE  SOUTHEAST  1/4  OF  SECTION  32,
 9        TOWNSHIP  41  NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL
10        MERIDIAN AND THE NORTHWEST 1/4 OF SECTION 4, TOWNSHIP  40
11        NORTH,  RANGE  12  EAST  OF THE THIRD PRINCIPAL MERIDIAN,
12        DESCRIBED AS FOLLOWS: BEGINNING AT  THE  INTERSECTION  OF

15        SECONDS WEST, ALONG SAID  WEST  LINE,  610  FEET  TO  THE
16        HEREINABOVE DESCRIBED POINT OF BEGINNING, IN COOK COUNTY,
17        ILLINOIS.
18    Further,  the  State  of Illinois accepts retrocession of and
19    authorizes acceptance of retrocession over  all  those  lands
20    owned   by   the  United  States  that  may  subsequently  be
21    identified by the Department of the Army as part of  the  Ft.
22    Dearborn  United  States  Army  Reserve  Center, although not
23    included within  the  legal  description  contained  in  this
24    subsection,  to  the  extent  exclusive  jurisdiction has not
25    previously been retroceded to the  State  of  Illinois.   Any
26    additional  land over which the State accepts retrocession of
27    jurisdiction shall be identified in a  notice  filed  by  the
28    Governor as provided in subsection (d).
29        (b)  By   retaining   in  the  subject  lands  a  federal
30    proprietary interest only, there exists a right of the United
31    States to perform the functions delegated to it by the United
32    States Constitution and directed by  statutory  enactment  of
33    the  United  States  Congress  without  interference from any
34    source.  The State of Illinois may not impose its  regulatory

 1    power  directly  upon  the  United States and may not tax the
 2    land under the federal  proprietary  interest;  however,  the
 3    State  of Illinois may tax a lessee's interest in the land to
 4    the extent State law permits.
 5        (c)  Subject to subsection (b),  the  State  of  Illinois
 6    accepts cession of exclusive federal legislative jurisdiction
 7    from the United States, and the State of Illinois retains all
 8    the legislative jurisdiction over the area it would have if a
 9    private  individual  rather  than the United States owned the
10    land.
11        (d)  The Governor of the State of Illinois is  authorized
12    to   accept   the   retrocession   of  exclusive  legislative
13    jurisdiction over the subject lands by  filing  a  notice  of
14    acceptance with the Illinois Secretary of State.
15        (e)  Upon  transfer  by  deed  of  subject  lands, or any
16    portion  thereof,  by  the  United  States  of  America,  the
17    proprietary interest retained  by  the  United  States  shall
18    expire as to the particular property transferred.

19                             Article 90.

20        Section  90-5.  The Code of Civil Procedure is amended by
21    changing Section 7-103 as follows:

22        (735 ILCS 5/7-103) (from Ch. 110, par. 7-103)
23        Sec. 7-103.  "Quick-take".  This Section applies only  to
24    proceedings under this Article:
25             (1)  by  the  State  of  Illinois, the Illinois Toll
26        Highway Authority or  the  St.  Louis  Metropolitan  Area
27        Airport   Authority   for  the  acquisition  of  land  or
28        interests therein for highway purposes;
29             (2)  (blank);
30             (3)  by the Department  of  Commerce  and  Community
31        Affairs  for  the  purpose specified in the Illinois Coal

 1        Development Bond Act;
 2             (4)  (blank);
 3             (5)  for the purpose  specified  in  the  St.  Louis
 4        Metropolitan Area Airport Authority Act;
 5             (6)  for  a  period of 24 months after May 24, 1996,
 6        by  the  Southwestern  Illinois   Development   Authority
 7        pursuant   to   the   Southwestern  Illinois  Development
 8        Authority Act;
 9             (7)  for a period of  3  years  after  December  30,
10        1987,  by  the  Quad Cities Regional Economic Development
11        Authority  (except  for  the  acquisition  of   land   or
12        interests  therein  that  is  farmland,  or upon which is
13        situated a farm dwelling and appurtenant  structures,  or
14        upon  which  is  situated a residence, or which is wholly
15        within  an  area  that  is  zoned  for  residential  use)
16        pursuant to the Quad Cities Regional Economic Development
17        Authority Act;
18             (8)  by  a  sanitary  district  created  under   the
19        Metropolitan  Water  Reclamation  District  Act   for the
20        acquisition of land or  interests  therein  for  purposes
21        specified in that Act;
22             (9)  by  a  rail carrier within the time limitations
23        and subject to the terms  and  conditions  set  forth  in
24        Section 18c-7501 of the Illinois Vehicle Code;
25             (10)  for  a  period  of 18 months after January 26,
26        1987, for  the  purpose  specified  in  Division  135  of
27        Article   11   of  the  Illinois  Municipal  Code,  by  a
28        commission  created  under  Section  2   of   the   Water
29        Commission Act of 1985;
30             (11)  by  a  village containing a population of less
31        than 15,000 for the purpose of acquiring property  to  be
32        used  for  a  refuse  derived  fuel  system   designed to
33        generate  steam  and  electricity,  and  for   industrial
34        development that will utilize such steam and electricity,

 1        pursuant  to  Section  11-19-10 of the Illinois Municipal
 2        Code;
 3             (12)  after receiving the prior approval of the City
 4        Council, by a municipality having a  population  of  more
 5        than  500,000  for  the  purposes  set  forth  in Section
 6        11-61-1a and Divisions 74.2 and 74.3 of Article 11 of the
 7        Illinois Municipal Code, and for the same  purposes  when
 8        established pursuant to home rule powers;
 9             (13)  by  a  home  rule municipality, after a public
10        hearing  held  by  the  corporate  authorities  or  by  a
11        committee of the corporate authorities and after approval
12        by a majority of the  corporate  authorities,  within  an
13        area designated as an enterprise zone by the municipality
14        under the Illinois Enterprise Zone Act;
15             (14)  by  the  Illinois  Sports Facilities Authority
16        for the purpose specified in Section 12 of  the  Illinois
17        Sports Facilities Authority Act;
18             (15)  by  a municipality having a population of more
19        than 2,000,000 for the purpose of acquiring the  property
20        described in Section 3 of the Sports Stadium Act;
21             (16)  for a period of 18 months after July 29, 1986,
22        in  any  proceeding  by  the  Board  of  Trustees  of the
23        University of Illinois for the  acquisition  of  land  in
24        Champaign  County  or  interests  therein as a site for a
25        building or for any educational purpose;
26             (17)  for a period of 2 years after July 1, 1990, by
27        a  home  rule  municipality  and  a  county  board,  upon
28        approval of a majority of the  corporate  authorities  of
29        both  the  county  board  and the municipality, within an
30        area designated as an enterprise zone by the municipality
31        and  the  county  board  through   an   intergovernmental
32        agreement  under  the  Illinois Enterprise Zone Act, when
33        the purpose of the condemnation proceeding is to  acquire
34        land  for  the construction of an industrial harbor port,

 1        and when the total amount of land to be acquired for that
 2        purpose is less than 75 acres  and  is  adjacent  to  the
 3        Illinois River;
 4             (18)  by  an airport authority located solely within
 5        the boundaries of Madison County, Illinois, and which  is
 6        organized  pursuant  to  the  provisions  of  the Airport
 7        Authorities Act, (i) for the acquisition of 160 acres, or
 8        less, of land  or  interests  therein  for  the  purposes
 9        specified  in  that Act which may be necessary to extend,
10        mark, and light runway 11/29 for a distance of 1600  feet
11        in  length by 100 feet in width with parallel taxiway, to
12        relocate and mark  County  Highway  19,  Madison  County,
13        known  as  Moreland  Road,  to  relocate  the  instrument
14        landing system including the approach lighting system and
15        to  construct  associated  drainage,  fencing and seeding
16        required for the foregoing project and (ii) for a  period
17        of  6 months after December 28, 1989, for the acquisition
18        of 75 acres, or less, of land or  interests  therein  for
19        the purposes specified in that Act which may be necessary
20        to  extend,  mark and light the south end of runway 17/35
21        at such airport;
22             (19)  by  any  unit  of  local  government   for   a
23        permanent   easement  for  the  purpose  of  maintaining,
24        dredging or cleaning the Little Calumet River;
25             (20)  by  any  unit  of  local  government   for   a
26        permanent   easement  for  the  purpose  of  maintaining,
27        dredging or cleaning the Salt Creek in DuPage County;
28             (21)  by  St.  Clair  County,  Illinois,   for   the
29        development  of  a  joint use facility at Scott Air Force
30        Base;
31             (22)  by the Village of Summit, Illinois, to acquire
32        land for a waste to energy plant;
33             (23)  for a period of 15 months after  September  7,
34        1990,  by the Department of Transportation or by any unit

 1        of   local   government   under   the   terms    of    an
 2        intergovernmental   cooperation   agreement  between  the
 3        Department  of  Transportation  and  the  unit  of  local
 4        government  for  the  purpose  of   developing   aviation
 5        facilities  in  and  around  Chanute  Air  Force  Base in
 6        Champaign County, Illinois;
 7             (24)  for a period of  1  year  after  December  12,
 8        1990,  by  the  City of Morris for the development of the
 9        Morris Municipal Airport;
10             (25)  for a period of 1 year after June 19, 1991, by
11        the  Greater  Rockford  Airport  Authority  for   airport
12        expansion purposes;
13             (26)  for a period of 24 months after June 30, 1991,
14        by  the  City  of  Aurora for completion of an instrument
15        landing system and construction of an east-west runway at
16        the Aurora Municipal Airport;
17             (27)  for the acquisition by the  Metropolitan  Pier
18        and   Exposition   Authority  of  property  described  in
19        subsection (f) of Section 5 of the Metropolitan Pier  and
20        Exposition  Authority  Act  for the purposes of providing
21        additional grounds, buildings, and facilities related  to
22        the  purposes  of  the  Metropolitan  Pier and Exposition
23        Authority;
24             (28)  for a period of 24 months after March 1, 1992,
25        by the Village of  Wheeling  and  the  City  of  Prospect
26        Heights,  owners  of  the Palwaukee Municipal Airport, to
27        allow for the acquisition of right of way to complete the
28        realignment of Hintz Road and Wolf Road;
29             (29)  for a period of one year  from  the  effective
30        date   of   this   amendatory   Act   of   1992,  by  the
31        Bloomington-Normal   Airport   Authority   for    airport
32        expansion purposes;
33             (30)  for  a period of 24 months after September 10,
34        1993, by the Cook  County  Highway  Department  and  Lake

 1        County  Department  of  Transportation  to  allow for the
 2        acquisition of necessary right-of-way for construction of
 3        underpasses   for   Lake-Cook   Road   at   the   Chicago
 4        Northwestern Railroad crossing, west of Skokie Boulevard,
 5        and the Chicago, Milwaukee, St. Paul and Pacific Railroad
 6        crossing, west of Waukegan Road;
 7             (31)  for a period of one year  after  December  23,
 8        1993,  by  the City of Arcola and the City of Tuscola for
 9        the development of the Arcola/Tuscola Water  Transmission
10        Pipeline   Project   pursuant  to  the  intergovernmental
11        agreement between the City of  Arcola  and  the  City  of
12        Tuscola;
13             (32)  for  a  period  of 24 months from December 23,
14        1993, by the Village of Bensenville for  the  acquisition
15        of  property bounded by Illinois Route 83 to the west and
16        O'Hare International Airport to the east  to  complete  a
17        flood control project known as the Bensenville Ditch;
18             (33)  for  a  period  of  9 months after November 1,
19        1993, by the Medical Center Commission for the purpose of
20        acquiring a site for the Illinois State  Police  Forensic
21        Science  Laboratory  at  Chicago, on the block bounded by
22        Roosevelt Road on the north, Wolcott Street on the  east,
23        Washburn  Street  on  the  south, and Damen Avenue on the
24        west in Chicago, Illinois;
25             (34)  for a period of 36 months after July 14, 1995,
26        by White County for  the  acquisition  of  a  3 1/2  mile
27        section  of Bellaire Road, which is described as follows:
28        Commencing at the Northwest Corner of the  Southeast  1/4
29        of Section 28, Township 6 South, Range 10 East of the 3rd
30        Principal  Meridian;  thence  South  to  a  point  at the
31        Southwest Corner of  the  Southeast  1/4  of  Section  9,
32        Township  7  South,  Range  10  East of the 3rd Principal
33        Meridian;
34             (35)  for a period of one year after July 14,  1995,

 1        by  the  City  of  Aurora  for  permanent  and  temporary
 2        easements  except  over land adjacent to Indian Creek and
 3        west of Selmarten Creek located within the City of Aurora
 4        for the construction of Phase  II  of  the  Indian  Creek
 5        Flood Control Project;
 6             (35.1)  for  a  period  beginning June 24, 1995 (the
 7        day following the effective date of Public Act 89-29) and
 8        ending on July 13, 1995 (the day preceding the  effective
 9        date  of  Public  Act  89-134), by the City of Aurora for
10        permanent and temporary easements for the construction of
11        Phase II of the Indian Creek Flood Control Project;
12             (36)  for a period of 6 years from July 14, 1995, by
13        the Grand Avenue Railroad Relocation  Authority  for  the
14        Grand Avenue Railroad Grade Separation Project within the
15        Village of Franklin Park, Illinois;
16             (37)  for  a  period of 3 years after July 14, 1995,
17        by the Village  of  Romeoville  for  the  acquisition  of
18        rights-of-way  for the 135th Street Bridge Project, lying
19        within the South 1/2 of Section 34,  Township  37  North,
20        Range  10  East and the South 1/2 of Section 35, Township
21        37 North, Range 10 East of the Third Principal  Meridian,
22        and  the North 1/2 of Section 2, Township 36 North, Range

23    motion requesting that,  immediately  or  at  some  specified
24    later  date,  the  plaintiff  either  be  vested with the fee
25    simple title (or such lesser estate, interest or easement, as
26    may be required) to the real property, or  specified  portion
27    thereof,  which  is  the  subject  of  the proceeding, and be
28    authorized to take possession of and use  such  property;  or
29    only  be  authorized  to  take  possession of and to use such
30    property, if such possession and use, without the vesting  of
31    title, are sufficient to permit the plaintiff to proceed with
32    the  project  until  the final ascertainment of compensation;
33    however, no land or interests therein now or hereafter owned,
34    leased, controlled or operated and used by, or necessary  for

 2    interstate commerce, or any other public utility  subject  to
 3    the  jurisdiction  of the Illinois Commerce Commission, shall
 4    be taken or appropriated hereunder by the State of  Illinois,
 5    the  Illinois  Toll Highway Authority, the sanitary district,
 6    the St. Louis Metropolitan  Area  Airport  Authority  or  the
 7    Board of Trustees of the University of Illinois without first
 8    securing the approval of such Commission.
 9        Except as hereinafter stated, the motion for taking shall
10    state:  (1)  an accurate description of the property to which
11    the motion relates and the estate or interest  sought  to  be
12    acquired  therein;  (2) the formally adopted schedule or plan
13    of operation for the execution of  the  plaintiff's  project;
14    (3)  the  situation  of  the  property  to  which  the motion
15    relates, with respect  to  the  schedule  or  plan;  (4)  the
16    necessity for taking such property in the manner requested in
17    the   motion;  and  (5)  if  the  property  (except  property
18    described in Section 3 of the Sports Stadium Act, or property
19    described as Site B in Section 2 of the Metropolitan Pier and
20    Exposition Authority Act)  to  be  taken  is  owned,  leased,
21    controlled  or  operated  and  used  by, or necessary for the
22    actual operation of, any interstate common carrier  or  other
23    public  utility  subject  to the jurisdiction of the Illinois
24    Commerce Commission, a  statement  to  the  effect  that  the
25    approval  of  such proposed taking has been secured from such
26    Commission, and attaching to such motion a certified copy  of
27    the  order of such Commission granting such approval.  If the
28    schedule or plan of operation is not set forth fully  in  the
29    motion,  a copy of such schedule or plan shall be attached to
30    the motion.
