AMENDMENT TO HOUSE BILL 2557

2    AMENDMENT NO. ______. Amend House Bill 2557 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by adding
5Section 6-111.5 as follows:
 
6    (605 ILCS 5/6-111.5 new)
7    Sec. 6-111.5. Elimination of county unit road districts. A
8county unit road district may be eliminated by referendum. The
9process, petition, and referendum requirements shall be
10identical to those requirements used to form a county unit road
11district under Section 6-111 of this Code, except that the
12referendum question shall be "Shall the county unit road
13district in .... County, Illinois be eliminated?".
14    (a) If a majority of voters at any general election votes
15to eliminate a county unit road district, the county board of
16the county shall determine what road system to adopt in place

1of the eliminated county unit road district. The county board
2shall form a committee of no more than 9 persons to study and
3recommend to the board what type of road system and what
4geographic boundaries should be put into place. The committee
5should consider mileage of roads, tax base, population, and
6natural and manmade geographic limitations in recommending the
7geographic boundaries. The corporate limits of any
8municipality within the county may be its own geographic unit
9for the proposed new road system. The committee shall also
10recommend the distribution of county unit road district assets
11and resources.
12    (b) The committee may prepare more than one proposal, but
13not more than 3 proposals, to present to the board for a final
14decision. The committee shall be formed, a budget set, and a
15chairperson determined by the board within 60 days of the
16election to eliminate the county unit road district. The
17committee shall present the proposal or proposals to the board
18within 150 days of the election.
19    (c) The board shall hold public hearings as it determines
20is necessary for public review and comment on the proposal or
21proposals of the committee within 60 days of receiving the
22proposal or proposals from the committee. Within 30 days after
23the public hearing or hearings, the board may return the
24proposal or any number of the proposals to the committee for a
25review and consideration of amendments based upon the comments
26from the public hearing or hearings. If the board returns the

1proposal to the committee for review and possible amendment,
2the committee has 30 days to complete its review, make any
3amendments, and return the final proposal or proposals to the
4board.
5    (d) No more than 30 days from the date of the last public
6hearing, or from the receipt of the final proposal or proposals
7from the committee if the board sent the proposal or proposals
8back to the committee for review and consideration of
9amendment, the board shall make a final determination as to
10what form of road system shall replace the county unit road
11district.
12    (e) The board shall determine and oversee all steps
13required to divide the resources and assets of the road system
14that replaces the county unit road district. The county unit
15road district shall be eliminated and the new road system shall
16be created simultaneously on a date set by the board, no later
17than 365 days from the date of the election to eliminate the
18county unit road district. The board shall designate the title
19of and appoint the head or heads of the various divisions of
20the new road system. The positions shall be voted on at the
21next general election after the election to eliminate the
22county unit road district and every 4 years thereafter. If the
23board adopts a system where municipalities are a geographic
24boundary, the commissioner in charge of the roads within a
25municipality shall automatically be the supervisor based upon
26the election process and terms for each municipality.

1    Section 99. Effective date. This Act takes effect July 1,
22011.".
