AMENDMENT TO HOUSE BILL 2557

2    AMENDMENT NO. ______. Amend House Bill 2557, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Highway Code is amended by adding
6Section 6-111.5 as follows:
 
7    (605 ILCS 5/6-111.5 new)
8    Sec. 6-111.5. Elimination of county unit road districts. A
9county unit road district may be eliminated by referendum. The
10process, petition, and referendum requirements shall be
11identical to those requirements used to form a county unit road
12district under Section 6-111 of this Code, except that the
13referendum question shall be "Shall the county unit road
14district in .... County, Illinois be eliminated and road
15districts be created in its place?".
16    (a) If a majority of voters at any general election votes

1to eliminate a county unit road district, the county board of
2the county shall determine what road districts to adopt in
3place of the eliminated county unit road district. The county
4board shall form a committee of no more than 9 persons to study
5and recommend to the board what type of road districts and what
6geographic boundaries should be put into place. The committee
7should consider mileage of roads, tax base, population, and
8natural and manmade geographic limitations in recommending the
9geographic boundaries. The corporate limits of any
10municipality within the county may be its own geographic unit
11for the proposed new road districts. The committee shall also
12recommend the distribution of county unit road district assets
13and resources.
14    (b) The committee may prepare more than one proposal, but
15not more than 3 proposals, to present to the board for a final
16decision. The committee shall be formed, a budget set, and a
17chairperson determined by the board within 60 days of the
18election to eliminate the county unit road district. The
19committee shall present the proposal or proposals to the board
20within 150 days of the election.
21    (c) The board shall hold public hearings as it determines
22is necessary for public review and comment on the proposal or
23proposals of the committee within 60 days of receiving the
24proposal or proposals from the committee. Within 30 days after
25the public hearing or hearings, the board may return the
26proposal or any number of the proposals to the committee for a

1review and consideration of amendments based upon the comments
2from the public hearing or hearings. If the board returns the
3proposal to the committee for review and possible amendment,
4the committee has 30 days to complete its review, make any
5amendments, and return the final proposal or proposals to the
6board.
7    (d) No more than 30 days from the date of the last public
8hearing, or from the receipt of the final proposal or proposals
9from the committee if the board sent the proposal or proposals
10back to the committee for review and consideration of
11amendment, the board shall make a final determination as to
12what form of road districts shall replace the county unit road
13district.
14    (e) The board shall determine and oversee all steps
15required to divide the resources and assets of the road
16districts that replaces the county unit road district. The
17county unit road district shall be eliminated and the new road
18districts shall be created simultaneously on a date set by the
19board, no later than 365 days from the date of the election to
20eliminate the county unit road district. The board shall
21designate the title of and appoint the head or heads of the
22various divisions of the new road districts. The positions
23shall be voted on at the next general election after the
24election to eliminate the county unit road district and every 4
25years thereafter. If the board adopts a road district system
26where municipalities are a geographic boundary, the

1commissioner in charge of the roads within a municipality shall
2automatically be the supervisor based upon the election process
3and terms for each municipality.
 
4    Section 99. Effective date. This Act takes effect July 1,
52011.".
