1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by adding
5Section 6-111.5 as follows:
 
6    (605 ILCS 5/6-111.5 new)
7    Sec. 6-111.5. Elimination of county unit road districts. A
8county unit road district may be eliminated by referendum. The
9process, petition, and referendum requirements shall be
10identical to those requirements used to form a county unit road
11district under Section 6-111 of this Code, except that the
12referendum question shall be "Shall the county unit road
13district in .... County, Illinois be eliminated and road
14districts be created in its place?".
15    (a) If a majority of voters at any general election votes
16to eliminate a county unit road district, the county board of
17the county shall determine what road districts to adopt in
18place of the eliminated county unit road district. The county
19board shall form a committee of no more than 9 persons to study
20and recommend to the board what type of road districts and what
21geographic boundaries should be put into place. The committee
22should consider mileage of roads, tax base, population, and
23natural and manmade geographic limitations in recommending the

1geographic boundaries. The corporate limits of any
2municipality within the county may be its own geographic unit
3for the proposed new road districts. The committee shall also
4recommend the distribution of county unit road district assets
5and resources.
6    (b) The committee may prepare more than one proposal, but
7not more than 3 proposals, to present to the board for a final
8decision. The committee shall be formed, a budget set, and a
9chairperson determined by the board within 60 days of the
10election to eliminate the county unit road district. The
11committee shall present the proposal or proposals to the board
12within 150 days of the election.
13    (c) The board shall hold public hearings as it determines
14is necessary for public review and comment on the proposal or
15proposals of the committee within 60 days of receiving the
16proposal or proposals from the committee. Within 30 days after
17the public hearing or hearings, the board may return the
18proposal or any number of the proposals to the committee for a
19review and consideration of amendments based upon the comments
20from the public hearing or hearings. If the board returns the
21proposal to the committee for review and possible amendment,
22the committee has 30 days to complete its review, make any
23amendments, and return the final proposal or proposals to the
24board.
25    (d) No more than 30 days from the date of the last public
26hearing, or from the receipt of the final proposal or proposals

1from the committee if the board sent the proposal or proposals
2back to the committee for review and consideration of
3amendment, the board shall make a final determination as to
4what form of road districts shall replace the county unit road
5district.
6    (e) The board shall determine and oversee all steps
7required to divide the resources and assets of the road
8districts that replaces the county unit road district. The
9county unit road district shall be eliminated and the new road
10districts shall be created simultaneously on a date set by the
11board, no later than 365 days from the date of the election to
12eliminate the county unit road district. The board shall
13designate the title of and appoint the head or heads of the
14various divisions of the new road districts. The positions
15shall be voted on at the next general election after the
16election to eliminate the county unit road district and every 4
17years thereafter. If the board adopts a road district system
18where municipalities are a geographic boundary, the
19commissioner in charge of the roads within a municipality shall
20automatically be the supervisor based upon the election process
21and terms for each municipality.
 
22    Section 99. Effective date. This Act takes effect July 1,
232011.
