 1                    AMENDMENT TO SENATE BILL 124
 2        AMENDMENT NO.     .  Amend Senate Bill 124  by  replacing
 3    the title with the following:
 4        "AN  ACT  to  amend the Illinois Insurance Code by adding
 5    Sections 155.31 and 155.32."; and
 6    by replacing everything after the enacting  clause  with  the
 7    following:
 8        "Section  5.   The  Illinois Insurance Code is amended by
 9    adding Sections 155.31 and 155.32 as follows:
10        (215 ILCS 5/155.31 new)
11        Sec.  155.31.   Day  care  and  group  day  care   homes;
12    coverage.
13        (a)  No  insurer providing insurance coverage, as defined
14    in subsection (b) of  Section  143.13  of  this  Code,  shall
15    nonrenew  or cancel an insurance policy on a day care home or
16    group day care home, as defined in  the  Child  Care  Act  of
17    1969,  solely  on  the basis that the insured operates a duly
18    licensed day care home or group day care home on the  insured
19    premises.
20        (b)  An  insurer  providing  such insurance coverage to a
21    licensed day care home or licensed group day  care  home  may

 1    provide  such  coverage with a separate policy or endorsement
 2    to a policy of  fire  and  extended  coverage  insurance,  as
 3    defined in subsection (b) of Section 143.13.
 4        (c)  Notwithstanding  subsections  (a)  and  (b)  of this
 5    Section, the insurer providing such coverage shall be allowed
 6    to cancel or nonrenew an insurance policy on a day care  home
 7    or  group  day  care  home  based upon the authority provided
 8    under Sections 143.21 and 143.21.1 of this Code.
 9        (215 ILCS 5/155.32 new)
10        Sec. 155.32.  Policy explanations;  language  other  than
11    English.  An  insurance carrier licensed to provide insurance
12    as defined in subsections (a) and (b) of  Section  143.13  of
13    this  Code  may  provide  insurance  policies,  endorsements,
14    riders,  and  any  explanatory  or  advertising material in a
15    language other than English.  In the event of  a  dispute  or
16    complaint  regarding  the  insurance or advertising material,
17    the English language version of the insurance coverage  shall
18    control the resolution of the dispute or complaint.".
