      215 ILCS 5/155.31 new
          Amends the Illinois  Insurance  Code.   Provides  that  a
      company  may  not cancel or refuse to issue or renew a policy
      of  homeowners  or  renters  insurance  because  the  insured
      premises are operated as a day care home or  group  day  care
      home.    Provides that losses arising out of or in connection
      with day care provided in a day care home or group  day  care
      home  may  not  be  covered  under  a  homeowners  or renters
      insurance policy.  Requires a separate policy or  endorsement
      for  which  premiums  are  assessed and paid for coverage for
      those losses.

 1        AN ACT to amend the Illinois  Insurance  Code  by  adding
 2    Section 155.31.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Insurance  Code  is  amended  by
 6    adding Section 155.31 as follows:
 7        (215 ILCS 5/155.31 new)
 8        Sec. 155.31.  Family day care providers; coverage.
 9        (a)  A  company  offering  personal  multi-peril property
10    insurance policies covering real  property  used  principally
11    for   residential  purposes  or  any  household  or  personal
12    property that is usual or incidental to the occupancy of  any
13    premises  used  for  residential  purposes (commonly known as
14    "homeowners" or "renters" insurance) may not cancel or refuse
15    to issue or renew a policy on a private home  solely  on  the
16    basis that the policyholder operates a day care home or group
17    day  care  home, as defined in the Child Care Act of 1969, at
18    the location.
19        (b)  A homeowners or renters  insurance  policy  may  not
20    provide  coverage  for losses arising out of or in connection
21    with day care provided in a day care home or group  day  care
22    home.   Coverage  for  losses arising out of or in connection
23    with the provision of day care in a day care  home  or  group
24    day  care  home  may  be  provided under a separate policy or
25    endorsement for which premiums are assessed and paid.
