AMENDMENT TO SENATE BILL 2962

2    AMENDMENT NO. ______. Amend Senate Bill 2962 by replacing
3line 16 on page 2 through line 4 on page 3 with the following:
4    "Subject to federal approval, the community spouse
5resource allowance shall be established and maintained as
6follows: a base amount of $109,560 plus an additional amount
7of $2,784 added to the base amount each year for a period of 10
8years commencing with calendar year 2024 through calendar year
92034. In addition to the base amount and the additional amount
10shall be any increase each year from the prior year to the
11maximum resource allowance permitted under Section
121924(f)(2)(A)(ii)(II) of the Social Security Act. Subject to
13federal approval, beginning January 1, 2034 the community
14spouse resource allowance shall be established and maintained
15at the maximum amount permitted under Section
161924(f)(2)(A)(ii)(II) of the Social Security Act, as now or
17hereafter amended, or an amount set after a fair hearing, or
18the amount transferred by the institutionalized spouse to the

1community spouse by court order, whichever is greater. Subject
2to federal approval, the community spouse resource allowance
3shall be established and maintained at the higher of $109,560
4or the minimum level permitted pursuant to Section 1924(f)(2)
5of the Social Security Act, as now or hereafter amended, or an
6amount set after a fair hearing, whichever is greater. The
7monthly maintenance allowance for the community spouse shall
8be established and maintained at the higher of $2,739 per
9month or the minimum level permitted pursuant to Section
101924(d)(3) of the Social Security Act, as now or hereafter
11amended, or an amount set after a fair hearing, whichever is
