AMENDMENT TO SENATE BILL 2032

AMENDMENT NO. ______. Amend Senate Bill 2032 by replacing everything after the enacting clause with the following:

"Section 5. The Local Records Act is amended by adding Section 25 as follows:

(50 ILCS 205/25 new)

Sec. 25. Publication by internet posting; digital maintenance of public records. Notwithstanding any other provision of law:

(1) Subject to paragraph (2) of this Section, any requirement for a school district or a unit of local government to publish any notice, agenda, record, or other information or material in a newspaper by law including, but not limited to, the Open Meetings Act, the Illinois Municipal Budget Law, the Intergovernmental Cooperation Act, the Counties Code, the Township Code, the Illinois Municipal Code, the Election Code, the School Code, the Airport Authorities Act, or the Civic Center Code, may instead publish such notice, agenda, record, or other information on its website or on data.illinois.gov or any successor website to data.illinois.gov maintained by, or on behalf of, the State of Illinois.

(2) Before January 1, 2021, a school district or unit of local government that publishes any notice, agenda, record, or other information or material on its website or data.illinois.gov as provided for in this Section shall also post a notice in the newspaper or newspapers where the notice, agenda, record, or other information or material would otherwise have been required to be posted absent the provisions of this Section. The notice in the newspaper or newspapers shall provide the website address where the full notice, agenda, record, or other information or material may be found.

(3) Any requirement that a school district or unit of local government store or maintain any public record in microfilm or microfiche form shall be satisfied by the school district's or unit of local government's maintenance of such public record in digital form.".
