AMENDMENT TO SENATE BILL 3336

2    AMENDMENT NO. ______. Amend Senate Bill 3336 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing the heading of Article XV of Chapter 11 and Sections
611-1502, 11-1504, 11-1505, 11-1505.1, 11-1507, 11-1510,
711-1511, 11-1514, and 11-1517 and by adding Section 1-131.5 as
8follows:
 
9    (625 ILCS 5/1-131.5 new)
10    Sec. 1-131.5. In-line speed skates. Roller skates (1) that
11are equipped with wheels arranged in a straight line and (2) on
12which the top of the boot affixed to the frame holding the
13wheels does not extend more than one inch above the wearer's
14ankle joint.

ARTICLE XV. BICYCLES AND IN-LINE SPEED SKATES

3    Sec. 11-1502. Traffic laws apply to persons riding bicycles
4or using in-line speed skates. Every person riding a bicycle or
5using in-line speed skates upon a highway shall be granted all
6of the rights and shall be subject to all of the duties
7applicable to the driver of a vehicle by this Code, except as
8to special regulations in this Article XV and except as to
9those provisions of this Code which by their nature can have no
10application.

13    Sec. 11-1504. Clinging to vehicles. No person riding upon
14any bicycle, coaster, roller skates, sled, or toy vehicle, or
15using in-line speed skates shall attach the same or himself to
16any vehicle upon a roadway.

22    (a) Any person operating a bicycle or motorized pedal cycle
23or using in-line speed skates upon a roadway at less than the

1normal speed of traffic at the time and place and under the
2conditions then existing shall ride as close as practicable and
3safe to the right-hand curb or edge of the roadway except under
4the following situations:
5        1. When overtaking and passing another bicycle,
6    motorized pedal cycle, skater, or vehicle proceeding in the
7    same direction; or
8        2. When preparing for a left turn at an intersection or
9    into a private road or driveway; or
10        3. When reasonably necessary to avoid conditions
11    including, but not limited to, fixed or moving objects,
12    parked or moving vehicles, bicycles, motorized pedal
13    cycles, pedestrians, animals, surface hazards, or
14    substandard width lanes that make it unsafe to continue
15    along the right-hand curb or edge. For purposes of this
16    subsection, a "substandard width lane" means a lane that is
17    too narrow for a bicycle, or motorized pedal cycle, or
18    in-line speed skater and a vehicle to travel safely side by
19    side within the lane; or .
20        4. When approaching a place where a right turn is
21    authorized.
22    (b) Any person operating a bicycle or motorized pedal cycle
23or using in-line speed skates upon a one-way highway with two
24or more marked traffic lanes may ride or skate as near the
25left-hand curb or edge of such roadway as practicable.

2    Sec. 11-1505.1. Persons riding bicycles or motorized pedal
3cycles or using in-line speed skates upon a roadway shall not
4ride or skate more than 2 abreast, except on paths or parts of
5roadways set aside for their exclusive use. Persons riding or
6skating 2 abreast shall not impede the normal and reasonable
7movement of traffic and, on a laned roadway, shall ride or
8skate within a single lane subject to the provisions of Section
911-1505.

12    Sec. 11-1507. Lamps and other equipment on bicycles.
13    (a) Every bicycle when in use at nighttime shall be
14equipped with a lamp on the front which shall emit a white
15light visible from a distance of at least 500 feet to the front
16and with a red reflector on the rear of a type approved by the
17Department which shall be visible from all distances from 100
18feet to 600 feet to the rear when directly in front of lawful
19lower beams of headlamps on a motor vehicle. A lamp emitting a
20red light visible from a distance of 500 feet to the rear may
21be used in addition to the red reflector.
22    (b) A bicycle shall not be equipped with nor shall any
23person use upon a bicycle any siren. This subsection (b) does
24not apply to a bicycle that is a police vehicle or fire

1department vehicle.
2    (c) Every bicycle shall be equipped with a brake which will
3adequately control movement of and stop and hold such bicycle.
4    (d) No person shall sell a new bicycle or pedal for use on
5a bicycle that is not equipped with a reflex reflector
6conforming to specifications prescribed by the Department, on
7each pedal, visible from the front and rear of the bicycle
8during darkness from a distance of 200 feet.
9    (e) No person shall sell or offer for sale a new bicycle
10that is not equipped with side reflectors. Such reflectors
11shall be visible from each side of the bicycle from a distance
12of 500 feet and shall be essentially colorless or red to the
13rear of the center of the bicycle and essentially colorless or
14amber to the front of the center of the bicycle provided. The
15requirements of this paragraph may be met by reflective
16materials which shall be at least 3/16 of an inch wide on each
17side of each tire or rim to indicate as clearly as possible the
18continuous circular shape and size of the tires or rims of such
19bicycle and which reflective materials may be of the same color
20on both the front and rear tire or rim. Such reflectors shall
21conform to specifications prescribed by the Department.
22    (f) No person shall sell or offer for sale a new bicycle
23that is not equipped with an essentially colorless front-facing
24reflector.
25    (g) A person using in-line speed skates on a highway shall
26have installed on his or her person a white light visible from

1a distance of at least 500 feet to the front and with a red
2reflector on the rear of a type approved by the Department
3which is visible from all distances from 100 feet to 600 feet
4to the rear when directly in front of lawful lower beams of

6visible from a distance of 500 feet to the rear may be used in
7addition to the red reflector.

10    Sec. 11-1510. Left Turns.
11    (a) A person riding a bicycle or moped intending to turn
12left shall follow a course described in Section 11-801 or in
13paragraph (b) of this Section.
14    (b) A person riding a bicycle or moped intending to turn
15left shall approach the turn as close as practicable to the
16right curb or edge of the roadway. After proceeding across the
17intersecting roadway to the far corner of the curb or
18intersection of the roadway edges, the bicyclist or moped
19driver shall stop, as much as practicable out of the way of
20traffic. After stopping the person shall yield to any traffic
21proceeding in either direction along the roadway such person
22had been using. After yielding, the bicycle or moped driver
23shall comply with any official traffic control device or police
24officer regulating traffic on the highway along which he
25intends to proceed, and the bicyclist or moped driver may

1proceed in the new direction.
2    (c) Notwithstanding the foregoing provisions, the
3Department and local authorities in their respective
4jurisdictions may cause official traffic-control devices to be
5placed and thereby require and direct that a specific course be
6traveled by turning bicycles and moped, and when such devices
7are so placed, no person shall turn a bicycle or moped other
8than as directed and required by such devices.
9    (d) A person using in-line speed skates and intending to
10turn left must comply with the requirements of Section 11-1001
11and 11-1002 of this Code.

14    Sec. 11-1511. Turn and stop signals. (a) Except as provided
15in this Section, a person riding a bicycle or using in-line
16speed skates shall comply with Section 11-804.
17    (b) A signal of intention to turn right or left when
18required shall be given during not less than the last 100 feet
19traveled by the bicycle or skater before turning, and shall be
20given while the bicycle or skater is stopped waiting to turn. A
21signal by hand and arm need not be given continuously if the
22hand is needed in the control or operation of the bicycle.

1    Sec. 11-1514. Bicycle or in-line speed skate racing. (a)
2Bicycle or in-line speed skate racing on a highway shall not be
3unlawful when a racing event has been approved by State or
4local authorities on any highway under their respective
5jurisdictions. Approval of bicycle or in-line speed skate
6highway racing events shall be granted only under conditions
7which assure reasonable safety for all race participants,
8spectators and other highways users, and which prevent
9unreasonable interference with traffic flow which would
10seriously inconvenience other highway users.
11    (b) By agreement with the approving authority,
12participants in an approved bicycle or in-line speed skate
13highway racing event may be exempted from compliance with any
14traffic laws otherwise applicable thereto, provided that
15traffic control is adequate to assure the safety of all highway
16users.

18    (625 ILCS 5/11-1517 new)
19    Sec. 11-1517. Electronic communication devices-bicyclists.
20    (a) As used in this Section:
21    "Electronic communication device" means an electronic
22device, including but not limited to a wireless telephone,
23personal digital assistant, or a portable or mobile computer
24while being used for the purpose of composing, reading, or
25sending an electronic message, but does not include a global

1positioning system or navigation system.
2    "Electronic message" means a self-contained piece of
3digital communication that is designed or intended to be
4transmitted between physical devices. "Electronic message"
5includes, but is not limited to electronic mail, a text
6message, an instant message, or a command or request to access
7an Internet site.
8    (b) A person may not ride a bicycle or use in-line speed
9skates on a roadway, sidewalk, or bicycle path while using an
10electronic communication device to compose, send, or read an
11electronic message.
12    (c) This Section does not apply to:
13        (1) a law enforcement officer while performing his or
14    her official duties;
15        (2) a bicyclist or in-line speed skater using an
16    electronic communication device for the sole purpose of
17    reporting an emergency situation and continued
18    communication with emergency personnel during the
19    emergency situation;
20        (3) a bicyclist or in-line speed skater using an
21    electronic communication device in hands-free or
22    voice-activated mode; or
23        (4) a bicyclist or in-line speed skater using an
24    electronic communication device while stopped on the
25    shoulder of a roadway.".
