AMENDMENT TO HOUSE BILL 1981

2    AMENDMENT NO. ______. Amend House Bill 1981 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Property Tax Code is amended by adding
5Section 3-70 as follows:
 
6    (35 ILCS 200/3-70 new)
7    Sec. 3-70. Cessation of Township Assessor. If the office of
8Township Assessor in a coterminous township ceases as provided
9in Section 25-30 of the Township Code, then the coterminous
10municipality shall assume the duties of the Township Assessor
11under this Code.
 
12    Section 10. The Township Code is amended by changing
13Section 50-20 and by adding Section 25-30 as follows:

1    Sec. 25-30. Discontinuance of a coterminous township.
2    (a) Notwithstanding any provision of Section 25-10 to the
3contrary, the board of trustees of a coterminous township may,
4by ordinance, submit a proposition to discontinue township
5organization to the electors of the township at a general
6election or consolidated election in accordance with general
7election law. The proposition must be approved by the corporate
8authorities of the coterminous municipality prior to placement
9on a ballot.
10    The proposition shall be in substantially the following
11form:
12        Shall the township organization be continued in (name
13    of township)?
14    The votes shall be recorded as "Yes" or "No".
15    If it appears by the returns of the election that a
16three-fifths majority of the votes of the township cast on the
17question of the continuance of township organization at the
18election are against the proposed option for continuance, then
19township organization shall cease in the township on January 1
20of the calendar year immediately following the calendar year
21that the proposition was approved by the electors. Upon
22discontinuance of township organization, all powers, duties,
23assets, property, liabilities, obligations, and
24responsibilities of the township shall be assumed by the
25coterminous municipality.
26    (b) If it appears by the returns of the election that a

1majority of the votes of the township cast on the question of
2the continuance of township organization are against
3continuance, then the office of Township Supervisor and the
4office of Township Assessor shall cease in the township at the
5next January 1 after the proposition was approved. If the
6office of Township Supervisor ceases, then the coterminous
7municipality shall assume the duties of Township Supervisor. If
8the office of Township Assessor ceases, then the coterminous
9municipality shall assume the duties of the Township Assessor
10under the Property Tax Code and the Public Health District Act.
11    (c) The coterminous municipality shall assume all taxing
12authority of the township abolished under this Section. For
13purposes of distribution of revenue, the coterminous
14municipality shall assume the powers, duties, and obligations
15of the township.
16    (d) Upon discontinuance of township organization, the
17records of the township shall be deposited in the city clerk's
18office. The coterminous municipality may close up all
19unfinished business of the township and sell and dispose of any
20of the property belonging to the township, as fully as might
21have been done by the township itself, for benefit of the
22inhabitants of the municipality.
23    (e) Nothing in this Section shall prevent the coterminous
24municipality from entering into an intergovernmental agreement
25or contract to provide for general assistance or property
26assessment duties for services under its jurisdiction.

1    (60 ILCS 1/50-20)
2    Sec. 50-20. Counties with no township collector. No
3collector in counties under 100,000.
4    (a) No collector in counties under 100,000. In counties
5under township organization, having a population of less than
6100,000, there shall be no township collector elected. The
7county collector shall be ex-officio township collector, and
8all the duties of the township collector shall devolve upon and
9be performed by the county collector.
10    (b) No collector in counties over 2,000,000. In counties
11having a population of more than 2,000,000 inhabitants there
12shall be no township collector elected on and after the
13effective date of this amendatory Act of the 97th General
14Assembly. Upon the completion of the terms of office of
15township collectors holding office on the effective date of
16this amendatory Act of the 97th General Assembly, the township
17assessor shall be the ex-officio township collector, and all
18the duties of the township collector shall devolve upon and be
19performed by the township assessor.

21    Section 15. The Public Health District Act is amended by
22adding Section 25 as follows:

1    Sec. 25. Cessation of Township Assessor. If the office of
2Township Assessor in a coterminous township ceases as provided
3in Section 25-30 of the Township Code, then the city council
4members of the coterminous municipality shall be the board of
5health for the public health district under this Act.
 
6    Section 20. The Illinois Public Aid Code is amended by
7adding Section 12-3.1 as follows:
 
8    (305 ILCS 5/12-3.1 new)
9    Sec. 12-3.1. Discontinuance of a coterminous township.
10Upon discontinuance of a coterminous township, the coterminous
11municipality shall provide funds for and administer the public
12aid program provided for under Article VI of this Code.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.".
