AMENDMENT TO HOUSE BILL 1981

2    AMENDMENT NO. ______. Amend House Bill 1981 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Property Tax Code is amended by adding
5Section 3-70 as follows:
 
6    (35 ILCS 200/3-70 new)
7    Sec. 3-70. Cessation of Township Assessor. If the office of
8Township Assessor in a coterminous township ceases as provided
9in Section 25-30 of the Township Code, then the coterminous
10municipality shall assume the duties of the Township Assessor
11under this Code.
 
12    Section 10. The Township Code is amended by changing
13Section 50-20 and by adding Section 25-30 as follows:

1    Sec. 25-30. Discontinuance of a coterminous township.
2    (a) Notwithstanding any provision of Section 25-10 to the
3contrary, the board of trustees of a coterminous township may,
4by ordinance, submit a proposition to discontinue township
5organization to the electors of the township at a general
6election or consolidated election in accordance with general
7election law.
8    The proposition shall be in substantially the following
9form:
10        Shall the township organization be continued in (name
11    of township)?
12    The votes shall be recorded as "Yes" or "No".
13    If it appears by the returns of the election that a
14majority of the votes of the township cast on the question of
15the continuance of township organization at the election are
16against the proposed option for continuance, then township
17organization shall cease in the township on January 1 of the
18calendar year immediately following the calendar year that the
19proposition was approved by the electors. Upon discontinuance
20of township organization, all powers, duties, assets,
21property, liabilities, obligations, and responsibilities of
22the township shall be assumed by the coterminous municipality.
23    (b) If it appears by the returns of the election that a
24majority of the votes of the township cast on the question of
25the continuance of township organization are against
26continuance, then the office of Township Supervisor and the

1office of Township Assessor shall cease in the township at the
2next January 1 after the proposition was approved. If the
3office of Township Supervisor ceases, then the coterminous
4municipality shall assume the duties of Township Supervisor. If
5the office of Township Assessor ceases, then the coterminous
6municipality shall assume the duties of the Township Assessor
7under the Property Tax Code and the Public Health District Act.
8    (c) The coterminous municipality shall assume all taxing
9authority of the township abolished under this Section. For
10purposes of distribution of revenue, the coterminous
11municipality shall assume the powers, duties, and obligations
12of the township.
13    (d) Upon discontinuance of township organization, the
14records of the township shall be deposited in the city clerk's
15office. The coterminous municipality may close up all
16unfinished business of the township and sell and dispose of any
17of the property belonging to the township, as fully as might
18have been done by the township itself, for benefit of the
19inhabitants of the municipality.
20    (e) Nothing in this Section shall prevent the coterminous
21municipality from entering into an intergovernmental agreement
22or contract to provide for general assistance or property
23assessment duties for services under its jurisdiction.

25    Sec. 50-20. Counties with no township collector. No

1collector in counties under 100,000.
2    (a) No collector in counties under 100,000. In counties
3under township organization, having a population of less than
4100,000, there shall be no township collector elected. The
5county collector shall be ex-officio township collector, and
6all the duties of the township collector shall devolve upon and
7be performed by the county collector.
8    (b) No collector in counties over 2,000,000. In counties
9having a population of more than 2,000,000 inhabitants there
10shall be no township collector elected on and after the
11effective date of this amendatory Act of the 97th General
12Assembly. Upon the completion of the terms of office of
13township collectors holding office on the effective date of
14this amendatory Act of the 97th General Assembly, the township
15assessor shall be the ex-officio township collector, and all
16the duties of the township collector shall devolve upon and be
17performed by the township assessor.

19    Section 15. The Public Health District Act is amended by
20adding Section 25 as follows:
 
21    (70 ILCS 905/25 new)
22    Sec. 25. Cessation of Township Assessor. If the office of
23Township Assessor in a coterminous township ceases as provided
24in Section 25-30 of the Township Code, then the city council

1members of the coterminous municipality shall be the board of
2health for the public health district under this Act.
 
3    Section 20. The Illinois Public Aid Code is amended by
4adding Section 12-3.1 as follows:
 
5    (305 ILCS 5/12-3.1 new)
6    Sec. 12-3.1. Discontinuance of a coterminous township.
7Upon discontinuance of a coterminous township, the coterminous
8municipality shall provide funds for and administer the public
9aid program provided for under Article VI of this Code.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
