1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-1063.5 as follows:
 
6    (55 ILCS 5/5-1063.5 new)
7    Sec. 5-1063.5. Permits for demolition and renovation;
8asbestos. Before a county may issue a demolition or renovation
9permit for property that is regulated under Part 61 of Title 40
10of the Code of Federal Regulations (NESHAP), the county must
11notify the permit applicant of the requirement to file a NESHAP
12notification form, as required by Section 61.145(b) of Title 40
13of the Code of Federal Regulations, and the permit applicant
14must certify as a part of the permit application that the
15NESHAP notification form has been filed with the Illinois
16Environmental Protection Agency. A county may seek assistance
17from the Illinois Environmental Protection Agency or any other
18State agency in developing procedures to implement the
19provisions of this Section.
 
20    Section 10. The Illinois Municipal Code is amended by
21adding Section 11-39-2.5 as follows:

1    (65 ILCS 5/11-39-2.5 new)
2    Sec. 11-39-2.5. Permits for demolition and renovation;
3asbestos. Before a municipality may issue a demolition or
4renovation permit for property that is regulated under Part 61
5of Title 40 of the Code of Federal Regulations (NESHAP), the
6municipality must notify the permit applicant of the
7requirement to file a NESHAP notification form, as required by
8Section 61.145(b) of Title 40 of the Code of Federal
9Regulations, and the permit applicant must certify as a part of
10the permit application that the NESHAP notification form has
11been filed with the Illinois Environmental Protection Agency. A
12municipality may seek assistance from the Illinois
13Environmental Protection Agency or any other State agency in
14developing procedures to implement the provisions of this
15Section.
 
16    Section 90. The State Mandates Act is amended by adding
17Section 8.35 as follows:
 
18    (30 ILCS 805/8.35 new)
19    Sec. 8.35. Exempt mandate. Notwithstanding Sections 6 and 8
20of this Act, no reimbursement by the State is required for the
21implementation of any mandate created by this amendatory Act of
22the 96th General Assembly.
 
23    Section 99. Effective date. This Act takes effect 90 days
24after becoming law.
