1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-1063.5 as follows:
 
6    (55 ILCS 5/5-1063.5 new)
7    Sec. 5-1063.5. Permits for demolition and renovation;
8asbestos. Before a county may issue a demolition or renovation
9permit for property that is regulated under Part 61 of Title 40
10of the Code of Federal Regulations (NESHAP), the county must
11notify the permit applicant of the requirement to file a NESHAP
12notification form with the Illinois Environmental Protection
13Agency, as required by Section 61.145(b) of Title 40 of the
14Code of Federal Regulations. A county may seek assistance from
15the Illinois Environmental Protection Agency or any other State
16agency in developing procedures to implement the provisions of
17this Section.
 
18    Section 10. The Illinois Municipal Code is amended by
19adding Section 11-39-2.5 as follows:

1asbestos. Before a municipality may issue a demolition or
2renovation permit for property that is regulated under Part 61
3of Title 40 of the Code of Federal Regulations (NESHAP), the
4municipality must notify the permit applicant of the
5requirement to file a NESHAP notification form with the
6Illinois Environmental Protection Agency, as required by
7Section 61.145(b) of Title 40 of the Code of Federal
8Regulations. A municipality may seek assistance from the
9Illinois Environmental Protection Agency or any other State
10agency in developing procedures to implement the provisions of
11this Section.
 
12    Section 90. The State Mandates Act is amended by adding
13Section 8.35 as follows:
 
14    (30 ILCS 805/8.35 new)
15    Sec. 8.35. Exempt mandate. Notwithstanding Sections 6 and 8
16of this Act, no reimbursement by the State is required for the
17implementation of any mandate created by this amendatory Act of
18the 96th General Assembly.
 
19    Section 99. Effective date. This Act takes effect 90 days
20after becoming law.
