1     AN ACT concerning local government.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4     Section 5. The Counties Code is amended by adding Section
5 5-1063.5 as follows:

6     (55 ILCS 5/5-1063.5 new)
7     Sec. 5-1063.5. Permits for demolition and renovation;
8 asbestos. Before a county may issue a demolition or renovation
9 permit for property that is regulated under Part 61 of Title 40
10 of the Code of Federal Regulations (NESHAP), the county must
11 notify the permit applicant of the requirement to file a NESHAP
12 notification form with the Illinois Environmental Protection
13 Agency, as required by Section 61.145(b) of Title 40 of the
14 Code of Federal Regulations. A county may seek assistance from
15 the Illinois Environmental Protection Agency or any other State
16 agency in developing procedures to implement the provisions of
17 this Section.

18     Section 10. The Illinois Municipal Code is amended by
19 adding Section 11-39-2.5 as follows:

21     Sec. 11-39-2.5. Permits for demolition and renovation;

1 asbestos. Before a municipality may issue a demolition or
2 renovation permit for property that is regulated under Part 61
3 of Title 40 of the Code of Federal Regulations (NESHAP), the
4 municipality must notify the permit applicant of the
5 requirement to file a NESHAP notification form with the
6 Illinois Environmental Protection Agency, as required by
7 Section 61.145(b) of Title 40 of the Code of Federal
8 Regulations. A municipality may seek assistance from the
9 Illinois Environmental Protection Agency or any other State
10 agency in developing procedures to implement the provisions of
11 this Section.

12     Section 90. The State Mandates Act is amended by adding
13 Section 8.35 as follows:

14     (30 ILCS 805/8.35 new)
15     Sec. 8.35. Exempt mandate. Notwithstanding Sections 6 and 8
16 of this Act, no reimbursement by the State is required for the
17 implementation of any mandate created by this amendatory Act of
18 the 96th General Assembly.

19     Section 99. Effective date. This Act takes effect 90 days
20 after becoming law.
