 1        AN ACT concerning education, amending named Acts.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.   The  School  Code  is  amended  by  changing
 5    Sections  3-12,  21-0.01,  21-1a, 21-1b, 21-1c, 21-2, 21-2.1,
 6    21-2a, 21-3, 21-4,  21-5,  21-7.1,  21-9,  21-11.3,  21-11.4,
 7    21-12,  21-14,  21-16,  21-17,  21-21,  21-25,  and 34-83 and
 8    adding Sections 2-3.11c and 3-11.5 as follows:

 9        (105 ILCS 5/2-3.11c new)
10        Sec. 2-3.11c.  Teacher  supply  and  demand  report.   To
11    report  annually,  on  or  before  January 1, on the relative
12    supply and demand for education staff of the  public  schools
13    to the Governor, to the General Assembly, and to institutions
14    of  higher  education  that prepare teachers, administrators,
15    school service personnel, other certificated individuals, and
16    other professionals employed by  school  districts  or  joint
17    agreements.    The   report   shall   contain  the  following
18    information:
19             (1)  the relative supply and  demand  for  teachers,
20        administrators,     and     other     certificated    and
21        non-certificated personnel by field,  content  area,  and
22        levels;
23             (2)  State  and regional analyses of fields, content
24        areas, and levels with an over-supply or under-supply  of
25        educators; and
26             (3)  projections  of  likely  high  demand  and  low
27        demand  for  educators,  in a manner sufficient to advise
28        the  public,  individuals,  and  institutions   regarding
29        career opportunities in education.

 1        Sec.  3-11.5.   Regional  professional development review
 2    committee.  The  regional  superintendent  of  schools  shall
 3    constitute   a   regional   professional  development  review
 4    committee or committees, as  provided  in  paragraph  (2)  of
 5    subsection  (g)  of Section 21-14 of this Code, to advise the
 6    regional superintendent of schools, upon his or her  request,
 7    and  to  hear  appeals  relating  to  the renewal of teaching
 8    certificates, in accordance with Section 21-14 of this  Code.
 9    The  expenses  of these review committees shall be funded, in
10    part, from the fees collected pursuant to  Section  21-16  of
11    this Code and deposited into the institute fund.

12        (105 ILCS 5/3-12) (from Ch. 122, par. 3-12)
13        Sec.  3-12.  Institute fund. All certificate examination,
14    registration fees and a portion of renewal and duplicate fees
15    shall be kept by the regional superintendent as described  in
16    Section  21-16  of  this  Code, together with a record of the
17    names of the persons paying them. Such  fees  fund  shall  be
18    deposited  into  the  institute fund and shall be used by the
19    regional superintendent to defray  expenses  associated  with
20    the  work  of  the  regional  professional development review
21    committees  established  pursuant   to   paragraph   (2)   of
22    subsection  (g)  of  Section 21-14 of this Code to advise the
23    regional superintendent, upon his or her request, and to hear
24    appeals relating to the renewal of teaching certificates,  in
25    accordance  with  Section  21-14  of  this  Code;  to  defray
26    expenses  connected  with  improving the technology necessary
27    for the  efficient  processing  of  certificates;  to  defray
28    expenses  incidental  to  teachers'  institutes, workshops or
29    meetings of  a  professional  nature  that  are  designed  to
30    promote  the  professional  growth  of  teachers  or  for the
31    purpose of defraying the expense of any  general  or  special
32    meeting  of teachers or school personnel of the region, which
33    has been approved by the regional superintendent.

 1        The regional superintendent shall on or before January  1
 2    of  each  year  publish in a newspaper of general circulation
 3    published in the region or shall post in each school building
 4    under his jurisdiction an accounting of (1)  the  balance  on
 5    hand  in  the Institute fund at the beginning of the previous
 6    year; (2) all receipts within the previous year deposited  in
 7    the  fund, with the sources from which they were derived; (3)
 8    the amount distributed from the fund  and  the  purposes  for
 9    which  such  distributions  were made; and (4) the balance on
10    hand in the fund.

12        (105 ILCS 5/21-0.01)
13        Sec. 21-0.01.  Powers after January 1, 1998. Beginning on
14    January 1, 1998 and thereafter, the State Board of Education,
15    in consultation with the State Teacher  Certification  Board,
16    shall  have  the  power  and  authority  to  do  all  of  the
17    following:
18             (1)  set  standards  for  teaching,  supervising, or
19        holding  other  certificated  employment  in  the  public
20        schools, and  administer  the  certification  process  as
21        provided  in  this  Article;  provided, however, that the
22        State  Teacher  Certification  Board  shall   be   solely
23        responsible   for   the   renewal  of  Standard  Teaching
24        Certificates as provided in  Sections  Section  21-2  and
25        21-14 of this Code;
26             (2)  approve  and evaluate teacher and administrator
27        preparation programs;
28             (3)  enter  into  agreements   with   other   states
29        relative   to   reciprocal   approval   of   teacher  and
30        administrator preparation programs;
31             (4)  establish standards for  the  issuance  of  new
32        types of certificates; and
33             (5)  take   such   other   action  relating  to  the

 1        improvement of instruction in the public schools  through
 2        teacher  education  and professional development and that
 3        attracts  qualified  candidates  into  teacher   training
 4        programs as is appropriate and consistent with applicable
 5        laws.

 7        (105 ILCS 5/21-1a) (from Ch. 122, par. 21-1a)
 8        Sec. 21-1a. Tests required for certification.
 9        (a)  After  July  1,  1988,  in  addition  to  all  other
10    requirements,  early  childhood,  elementary,  special,  high
11    school,  school  service personnel, or, except as provided in
12    Section 34-6, administrative certificates shall be issued  to
13    persons who have satisfactorily passed a test of basic skills
14    and  subject matter knowledge.  The tests of basic skills and
15    subject matter knowledge shall be the tests which  from  time
16    to  time  are  designated  by the State Board of Education in
17    consultation with the State Teacher Certification  Board  and
18    may  be tests prepared by an educational testing organization
19    or  tests  designed  by  the  State  Board  of  Education  in
20    consultation with the State Teacher Certification Board.  The
21    areas to be covered by the test of basic skills shall include
22    the  basic  skills   of   reading,   writing,   grammar   and
23    mathematics.   The  test  of  subject  matter knowledge shall
24    assess content knowledge in the specific subject  field.  The
25    tests shall be designed to be racially neutral to assure that
26    no  person  in  taking  the  tests  is  thereby discriminated
27    against on the basis of race, color, national origin or other
28    factors unrelated to the person's ability  to  perform  as  a
29    certificated  employee.  The score required to pass the tests
30    of basic skills and subject matter knowledge shall  be  fixed
31    by  the  State  Board  of  Education in consultation with the
32    State Teacher Certification Board.  The tests shall  be  held
33    not  fewer  than 3 times a year at such time and place as may

 1    be designated by the State Board of Education in consultation
 2    with the State Teacher Certification Board.
 3        (b)  Except as provided in Section 34-6,  the  provisions
 4    of  subsection (a) of this Section shall apply equally in any
 5    school district subject to  Article  34,  provided  that  the
 6    State  Board  of Education shall determine which certificates
 7    issued under Sections 34-8.1 and 34-83 prior to July 1,  1988
 8    are comparable to any early childhood certificate, elementary
 9    school   certificate,   special   certificate,   high  school
10    certificate,  school   service   personnel   certificate   or
11    administrative  certificate  issued  under this Article as of
12    July 1, 1988.
13        (c)  A person who holds an early  childhood,  elementary,
14    special,  high school or school service personnel certificate
15    issued under this Article on or at any time  before  July  1,
16    1988,  including  a  person  who  has  been  issued  any such
17    certificate pursuant to Section 21-11.1 or in exchange for  a
18    comparable   certificate  theretofore  issued  under  Section
19    34-8.1 or Section 34-83, shall not be  required  to  take  or
20    pass  the  tests in order to thereafter have such certificate
21    renewed.
22        (d)  The State Board of Education  in  consultation  with
23    the  State  Teacher Certification Board shall conduct a pilot
24    administration of the tests  by  administering  the  test  to
25    students completing teacher education programs in the 1986-87
26    school  year  for  the  purpose of determining the effect and
27    impact of testing candidates for certification.
28        (e)  The rules and regulations developed to implement the
29    required test of basic skills and  subject  matter  knowledge
30    shall  include  the requirements of subsections (a), (b), and
31    (c) and shall include specific  regulations  to  govern  test
32    selection;  test  validation  and  determination of a passing
33    score;   administration   of   the   tests;   frequency    of
34    administration;  applicant  fees;  frequency  of  applicants'

 1    taking  the tests; the years for which a score is valid; and,
 2    waiving certain additional tests for additional  certificates
 3    to  individuals  who  have  satisfactorily passed the test of
 4    basic skills and subject  matter  knowledge  as  required  in
 5    subsection  (a).  The State Board of Education shall provide,
 6    by rule, specific policies  that  assure  uniformity  in  the
 7    difficulty  level  of  each form of the basic skills test and
 8    each subject matter  knowledge  test  from  test-to-test  and
 9    year-to-year.   The State Board of Education shall also set a
10    passing score for the tests.
11        (f)  The State Teacher Certification Board  may  issue  a
12    nonrenewable  temporary  certificate between July 1, 1988 and
13    August 31, 1988 to individuals who have taken  the  tests  of
14    basic  skills and subject matter knowledge prescribed by this
15    Section but have not received such test scores by August  31,
16    1988.   Such  temporary certificates shall expire on December
17    31, 1988.
18        (g)  Beginning February 15, 2000 July 1, 1999, the  State
19    Board  of  Education,  in consultation with the State Teacher
20    Certification Board, shall implement  and  administer  a  new
21    system   of  certification  for  teachers  in  the  State  of
22    Illinois.  The State Board of Education, in consultation with
23    the State  Teacher  Certification  Board,  shall  design  and
24    implement a system of examinations and various other criteria
25    which  shall  be  required  prior  to the issuance of Initial
26    Teaching Certificates  and  Standard  Teaching  Certificates.
27    These examinations and indicators shall be based on national
28    and  State  professional teaching standards, as determined by
29    the State Board of Education, in consultation with the  State
30    Teacher Certification Board. The State Board of Education may
31    adopt  any  and  all  regulations  necessary to implement and
32    administer this Section.
33        (h)  The State Board of Education  shall  report  to  the
34    Illinois    General    Assembly   and   the   Governor   with

 1    recommendations for further changes and improvements  to  the
 2    teacher  certification  system no later than July 1, 1999 and
 3    on an annual basis until July 1, 2001.

 5        (105 ILCS 5/21-1b) (from Ch. 122, par. 21-1b)
 6        Sec. 21-1b.  Subject endorsement  on  certificates.   All
 7    certificates  initially  issued under this Article after June
 8    30, 1986, shall be specifically endorsed by the  State  Board
 9    of  Education  for each subject the holder of the certificate
10    is legally qualified to teach, such endorsements to  be  made
11    in  accordance  with standards promulgated by the State Board
12    of  Education  in  consultation  with   the   State   Teacher
13    Certification Board.  All certificates which are issued under
14    this Article prior to July 1, 1986 may, by application to the
15    State  Board  of Education, be specifically endorsed for each
16    subject  the  holder   is   legally   qualified   to   teach.
17    Endorsements  issued  under  this  Section shall not apply to
18    substitute teacher's certificates issued under  Section  21-9
19    of  this  Code.   Each  application  for  endorsement  of  an
20    existing  teaching  certificate shall be accompanied by a $20
21    nonrefundable fee.
22        Commencing July 1, 1999, each application for endorsement
23    of an existing teaching certificate shall be accompanied by a
24    $30 nonrefundable fee January  1,  1994,  an  additional  $10
25    shall be charged for each application for endorsement.  There
26    is hereby created a Teacher Certificate Fee Revolving Fund as
27    a  special  fund  within the State Treasury.  The proceeds of
28    each $30 the additional  $10  fee  shall  be  paid  into  the
29    Teacher  Certificate  Fee  Revolving  Fund; and the moneys in
30    that Fund shall be  appropriated  and  used  to  provide  the
31    technology  and  other resources necessary for the timely and
32    efficient processing of certification requests.

 1        (105 ILCS 5/21-1c) (from Ch. 122, par. 21-1c)
 2        Sec. 21-1c.  Exclusive certificate authority.   Only  the
 3    State  Board  of  Education  and  State Teacher Certification
 4    Board, acting in accordance with the applicable provisions of
 5    this Act and the rules, regulations and standards promulgated
 6    thereunder, shall have the authority to issue or endorse  any
 7    certificate  required  for  teaching,  supervising or holding
 8    certificated employment in the public schools; and  no  other
 9    State  agency  shall  have  any  power  or  authority  (i) to
10    establish  or   prescribe   any   qualifications   or   other
11    requirements applicable to the issuance or endorsement of any
12    such  certificate,  or  (ii)  to  establish  or prescribe any
13    licensure or equivalent requirement which must  be  satisfied
14    in  order to teach, supervise or hold certificated employment
15    in the public schools.  This Section does  not  prohibit  the
16    State  Board  of  Education,  in  consultation with the State
17    Teacher Certification  Board,  from  delegating  to  regional
18    superintendents  of  schools the authority to grant temporary
19    employment  authorizations  to   teacher   applicants   whose
20    qualifications  have  been  confirmed  by  the State Board of
21    Education,   in   consultation   with   the   State   Teacher
22    Certification Board.

24        (105 ILCS 5/21-2) (from Ch. 122, par. 21-2)
25        Sec. 21-2.  Grades of certificates.
26        (a)  Until  February  15,  2000   July   1,   1999,   all
27    certificates   issued  under  this  Article  shall  be  State
28    certificates valid, except as limited  in  Section  21-1,  in
29    every school district coming under the provisions of this Act
30    and  shall  be  limited  in  time  and designated as follows:
31    Provisional  vocational  certificate,  temporary  provisional
32    vocational   certificate,   early   childhood    certificate,
33    elementary  school  certificate,  special  certificate,  high

 1    school  certificate,  school  service  personnel certificate,
 2    administrative  certificate,  provisional  certificate,   and
 3    substitute  certificate.  The requirement of student teaching
 4    under  close  and  competent  supervision  for  obtaining   a
 5    teaching  certificate  may  be  waived  by  the State Teacher
 6    Certification Board upon presentation to  the  Board  by  the
 7    teacher of evidence of 5 years successful teaching experience
 8    on  a  valid  certificate  and  graduation  from a recognized
 9    institution of higher learning with a bachelor's degree  with
10    not less than 120 semester hours and a minimum of 16 semester
11    hours in professional education.
12        (b)  Initial  Teaching  Certificate.   Beginning February
13    15, 2000 July 1, 1999, persons  who  (1)  have  completed  an
14    approved  teacher preparation program, (2) are recommended by
15    an   approved   teacher   preparation   program,   (3)   have
16    successfully completed  the  Initial  Teaching  Certification
17    examinations  required  by  the State Board of Education, and
18    (4) have met all other  criteria  established  by  the  State
19    Board  of  Education  in  consultation with the State Teacher
20    Certification Board, shall  be  issued  an  Initial  Teaching
21    Certificate  valid  for  4  years  of teaching, as defined in
22    Section 21-14 of this Code.   Initial  Teaching  Certificates
23    shall   be  issued  for  categories  corresponding  to  Early
24    Childhood, Elementary,  Secondary,  and  Special  K-12,  with
25    special  certification  designations  for  Special Education,
26    Bilingual Education, fundamental  learning  areas  (including
27    Language Arts, Reading, Mathematics, Science, Social Science,
28    Physical  Development  and  Health,  Fine  Arts,  and Foreign
29    Language), and other areas designated by the State  Board  of
30    Education,   in   consultation   with   the   State   Teacher
31    Certification Board.
32        (c)  Standard  Certificate.   Beginning February 15, 2000
33    July 1, 1999, persons who  (1)  have  completed  4  years  of
34    teaching,  as  defined in Section 21-14 of this Code, with an

 1    Initial Certificate, have successfully completed the Standard
 2    Teaching Certificate examinations, and  have  met  all  other
 3    criteria  established  by  the  State  Board  of Education in
 4    consultation with the State Teacher Certification  Board,  or
 5    (2)  have completed 4 years of teaching on a valid equivalent
 6    certificate in another  State  or  territory  of  the  United
 7    States,  or have completed 4 years of teaching in a nonpublic
 8    Illinois elementary  or  secondary  school  with  an  Initial
 9    Certificate,  and  have met all other criteria established by
10    the State Board of Education, in consultation with the  State
11    Teacher  Certification  Board,  or  (3)  were issued teaching
12    certificates prior to February 15, 2000 July 1, 1999 and  are
13    renewing  those  certificates after February 15, 2000 July 1,
14    1999, shall be issued a  Standard  Certificate  valid  for  5
15    years,  which  may be renewed thereafter every 5 years by the
16    State  Teacher  Certification  Board  based   on   proof   of
17    continuing  education  or professional development. Beginning
18    July 1, 2003, persons who have completed 4 years of teaching,
19    as described in clauses (1) and (2) of this  subsection  (c),
20    have successfully completed the Standard Teaching Certificate
21    Examinations,  and have met all other criteria established by
22    the State Board of Education, in consultation with the  State
23    Teacher   Certification   Board,  shall  be  issued  Standard
24    Certificates.  Standard  Certificates  shall  be  issued  for
25    categories  corresponding  to  Early  Childhood,  Elementary,
26    Secondary,  and  Special  K-12,  with  special  certification
27    designations  for  Special  Education,  Bilingual  Education,
28    fundamental learning areas (including Language Arts, Reading,
29    Mathematics,  Science,  Social  Science, Physical Development
30    and Health, Fine Arts, and Foreign Language), and other areas
31    designated by the State Board of Education,  in  consultation
32    with the State Teacher Certification Board.
33        (d)  Master  Certificate.   Beginning  February  15, 2000
34    July 1, 1999, persons who have successfully achieved National

 1    Board  certification   through   the   National   Board   for
 2    Professional  Teaching  Standards  shall  be  issued a Master
 3    Certificate, valid for 10 7 years  and  renewable  thereafter
 4    every  10  7  years  through compliance with requirements set
 5    forth by the State Board of Education, in  consultation  with
 6    the State Teacher Certification Board.

 9        (105 ILCS 5/21-2.1) (from Ch. 122, par. 21-2.1)
10        Sec. 21-2.1.  Early childhood certificate.
11        (a)  An early childhood certificate shall be valid for  4
12    years  for  teaching children up to 6 years of age, exclusive
13    of children enrolled in kindergarten, in facilities  approved
14    by  the State Superintendent of Education.  Beginning July 1,
15    1988, such  certificate  shall  be  valid  for  4  years  for
16    Teaching  children  through grade 3 in facilities approved by
17    the  State  Superintendent  of  Education.   Subject  to  the
18    provisions of Section 21-1a, it shall be  issued  to  persons
19    who  have  graduated  from a recognized institution of higher
20    learning with a bachelor's degree and with not fewer than 120
21    semester hours  including  professional  education  or  human
22    development or, until July 1, 1992, to persons who have early
23    childhood  education  instruction  and  practical  experience
24    involving  supervised work with children under 6 years of age
25    or with children through  grade  3.  Such  persons  shall  be
26    recommended   for   the  early  childhood  certificate  by  a
27    recognized  institution  as  having  completed  an   approved
28    program of preparation which includes the requisite hours and
29    academic  and  professional  courses and practical experience
30    approved  by  the  State  Superintendent  of   Education   in
31    consultation with the State Teacher Certification Board.
32        (b)  Beginning  February  15,  2000 July 1, 1999, Initial
33    and Standard Early Childhood Education Certificates shall  be

 1    issued  to  persons  who meet the criteria established by the
 2    State Board of Education.

 4        (105 ILCS 5/21-2a) (from Ch. 122, par. 21-2a)
 5        Sec. 21-2a. Required instruction for all teachers.  After
 6    September  1,  1981 and until January 1, 1999, in addition to
 7    all other requirements, the successful completion  of  course
 8    work  which  includes  instruction  on  the psychology of the
 9    exceptional child,  the  identification  of  the  exceptional
10    child,  including,  but  not limited to the learning disabled
11    and  methods  of  instruction  for  the  exceptional   child,
12    including,  but not limited to the learning disabled shall be
13    a prerequisite to a person receiving  any  of  the  following
14    certificates:  early  childhood, elementary, special and high
15    school.
16        After January 1, 1999, the State Board of Education shall
17    ensure  that  the  curriculum  for   all   approved   teacher
18    preparation  programs  includes,  and  that  all  prospective
19    teachers  pursuing Early Childhood, Elementary, Secondary, or
20    Special  K-12  certificates  receive,  instruction   on   the
21    psychology  of,  the  identification  of,  and the methods of
22    instruction for  the  exceptional  child,  including  without
23    limitation   the  learning  disabled.   This  instruction  on
24    exceptional children may  be  provided  in  one  concentrated
25    course  or  may  be integrated among other courses within the
26    teacher preparation program as shall  be  determined  by  the
27    State Board of Education.

30        Sec. 21-3.  Elementary certificate.
31        (a)  An  elementary school certificate shall be valid for
32    4 years for teaching in the kindergarten and lower  9  grades

 1    of  the common schools.  Subject to the provisions of Section
 2    21-1a, it shall be issued to persons who have graduated  from
 3    a recognized institution of higher learning with a bachelor's
 4    degree  and with not fewer than 120 semester hours and with a
 5    minimum of  16  semester  hours  in  professional  education,
 6    including   5   semester  hours  in  student  teaching  under
 7    competent  and  close  supervision.  Such  persons  shall  be
 8    recommended for the elementary certificate  by  a  recognized
 9    institution  as  having  completed  an  approved  program  of
10    preparation  which  includes intensive preservice training in
11    the  humanities,  natural  sciences,  mathematics   and   the
12    academic  and  professional  courses  approved  by  the State
13    Superintendent of Education in consultation  with  the  State
14    Teacher Certification Board.
15        (b)  Beginning  February  15,  2000 July 1, 1999, Initial
16    and Standard  Elementary  Certificates  shall  be  issued  to
17    persons who meet all of the criteria established by the State
18    Board of Education for elementary education.

20        (105 ILCS 5/21-4) (from Ch. 122, par. 21-4)
21        Sec. 21-4.  Special certificate.
22        (a)  A special certificate shall be valid for 4 years for
23    teaching  the special subjects named therein in all grades of
24    the common schools. Subject  to  the  provisions  of  Section
25    21-1a,  it shall be issued to persons who have graduated from
26    a recognized institution of higher learning with a bachelor's
27    degree and with not fewer than 120 semester hours including a
28    minimum of 16 semester hours in professional education, 5  of
29    which  shall be in student teaching under competent and close
30    supervision. When the holder of such certificate has earned a
31    master's degree, including eight semester hours  of  graduate
32    professional  education  from  a  recognized  institution  of

 1    may be endorsed for supervision.
 2        Such  persons  shall  be  recommended  for  the   special
 3    certificate  by  a recognized institution as having completed
 4    an approved program of preparation  which  includes  academic
 5    and professional courses approved by the State Superintendent
 6    of   Education   in   consultation  with  the  State  Teacher
 7    Certification Board.
 8        (b)  Those  persons  holding  special   certificates   on
 9    February  15,  2000 July 1, 1999 shall be eligible for one of
10    the following:
11             (1)  The  issuance  of   Standard   Elementary   and
12        Standard  Secondary Certificates with appropriate special
13        certification designations as  determined  by  the  State
14        Board  of  Education,  in  consultation  with  the  State
15        Teacher  Certification  Board,  and consistent with rules
16        adopted  by  the  State  Board   of   Education.    These
17        certificates  shall  be renewed as provided in subsection
18        (c) of Section 21-2.
19             (2)  The   issuance   of   Standard   Special   K-12
20        Certificates  with  appropriate   special   certification
21        designations,  which  shall  be  renewed  as  provided in
22        subsection (c) of Section 21-2.  These certificates shall
23        not be eligible for additional certification designations
24        except as approved by the State Board  of  Education,  in
25        consultation with the State Teacher Certification Board.
26        (c)  Those persons eligible to receive K-12 certification
27    after  February 15, 2000 July 1, 1999 shall be issued Initial
28    Elementary   and   Initial   Secondary   Certificates    with
29    appropriate  special  certification  designations pursuant to
30    this  Section  or  Initial  Special  K-12  Certificates  with
31    appropriate special certification  designations  pursuant  to
32    this  Section.  These Initial K-12 Special Certificates shall
33    not be eligible  for  additional  certification  designations
34    except  as  approved  by  the  State  Board  of Education, in

 1    consultation with the State Teacher Certification Board.
 2        (d)  Beginning February 15, 2000, all persons  exchanging
 3    a  special  certificate  are  exempt  from  the provisions of
 4    Section 2-3.71 of this Code, provided they meet all the other
 5    requirements for teaching as established by the  State  Board
 6    of   Education,   in  consultation  with  the  State  Teacher
 7    Certification Board.
 8        Beginning February 15,  2000,  all  persons  receiving  a
 9    special education designation on either a special certificate
10    or  an  elementary  certificate issued pursuant to subsection
11    (c) of this Section are exempt from the provisions of Section
12    2-3.71 of  this  Code,  provided  they  meet  all  the  other
13    requirements  for  teaching as established by the State Board
14    of  Education,  in  consultation  with  the   State   Teacher
15    Certification Board.
16        Certificates   exchanged   or  issued  pursuant  to  this
17    subsection (d) shall be  valid  for  teaching  children  with
18    disabilities, as defined in Section 14-1.02 of this Code, and
19    these   special  certificates  shall  be  called  Initial  or
20    Standard Special Preschool - Age 21 Certificates.  Nothing in
21    this subsection (d) shall be construed  to  adversely  affect
22    the  rights  of any person presently certificated, any person
23    whose certification is currently pending, or any  person  who
24    is  currently  enrolled or enrolls prior to February 15, 2000
25    in an approved Special K-12 certification program.

28        (105 ILCS 5/21-5) (from Ch. 122, par. 21-5)
29        Sec. 21-5.  High school certificate.
30        (a)  A high school certificate shall be valid for 4 years
31    for  teaching  in  grades  6  to  12  inclusive of the common
32    schools. Subject to the provisions of Section 21-1a, it shall
33    be issued to persons who have  graduated  from  a  recognized

 1    institution  of  higher learning with a bachelor's degree and
 2    with not fewer than 120 semester hours including 16  semester
 3    hours  in  professional  education,  5  of  which shall be in
 4    student teaching under competent and  close  supervision  and
 5    with  one  or  more  teaching  fields.  Such persons shall be
 6    recommended for the high school certificate by  a  recognized
 7    institution  as  having  completed  an  approved  program  of
 8    preparation  which  includes  the  academic  and professional
 9    courses approved by the State Superintendent of Education  in
10    consultation with the State Teacher Certification Board.
11        (b)  Beginning  February  15,  2000 July 1, 1999, Initial
12    and  Standard  Secondary  Certificates  shall  be  issued  to
13    persons who meet all of the criteria established by the State
14    Board of Education for secondary education.

16        (105 ILCS 5/21-7.1) (from Ch. 122, par. 21-7.1)
17        Sec. 21-7.1.  Administrative certificate.
18        (a)  After   July   1,   1999   January   1,   1986,   an
19    administrative certificate valid for 5 years  of  supervising
20    and  administering in the public common schools may be issued
21    to persons who have graduated from  a  regionally  accredited
22    recognized  institution  of  higher  learning with a master's
23    degree  and  who  have  been  recommended  certified   by   a
24    recognized  institution these institutions of higher learning
25    as having completed a program of preparation for one or  more
26    of   these   endorsements.  Such  programs  of  academic  and
27    professional preparation required for  endorsement  shall  be
28    administered  by the institution in accordance with standards
29    set  forth  by  the  State  Superintendent  of  Education  in
30    consultation with the State Teacher Certification Board.
31        (b)  No administrative certificate shall  be  issued  for
32    the  first  time  after  June  30,  1987  and  no endorsement
33    provided for by this Section shall be made or affixed  to  an

 1    administrative  certificate for the first time after June 30,
 2    1987  unless  the  person   to   whom   such   administrative
 3    certificate  is  to  be  issued  or  to  whose administrative
 4    certificate such  endorsement  is  to  be  affixed  has  been
 5    required to demonstrate as a part of a program of academic or
 6    professional    preparation   for   such   certification   or
 7    endorsement: (i) an understanding of the knowledge called for
 8    in establishing productive parent-school relationships and of
 9    the  procedures  fostering   the   involvement   which   such
10    relationships  demand;  and  (ii)  an  understanding  of  the
11    knowledge  required  for  establishing  a high quality school
12    climate  and  promoting  good  classroom   organization   and
13    management,  including  rules  of  conduct  and instructional
14    procedures  appropriate  to  accomplishing   the   tasks   of
15    schooling;  and  (iii)  a  demonstration of the knowledge and
16    skills called for in providing instructional leadership.  The
17    standards  for  demonstrating  an   understanding   of   such
18    knowledge  shall be set forth by the State Board of Education
19    in consultation with the State Teacher  Certification  Board,
20    and  shall  be administered by the recognized institutions of
21    higher learning as part  of  the  programs  of  academic  and
22    professional   preparation  required  for  certification  and
23    endorsement under this Section.  As used in this  subsection:
24    "establishing  productive  parent-school relationships" means
25    the  ability  to  maintain  effective  communication  between
26    parents  and  school   personnel,   to   encourage   parental
27    involvement in schooling, and to motivate school personnel to
28    engage  parents in encouraging student achievement, including
29    the development of  programs  and  policies  which  serve  to
30    accomplish  this  purpose;  and  "establishing a high quality
31    school  climate"  means  the  ability  to  promote   academic
32    achievement,  to  maintain discipline, to recognize substance
33    abuse problems among students  and  utilize  appropriate  law
34    enforcement  and  other  community resources to address these

 1    problems, to support teachers and students in their education
 2    endeavors, to establish learning objectives  and  to  provide
 3    instructional   leadership,   including  the  development  of
 4    policies and programs which serve to accomplish this purpose;
 5    and "providing instructional leadership" means the ability to
 6    effectively evaluate school  personnel,  to  possess  general
 7    communication  and interpersonal skills, and to establish and
 8    maintain appropriate classroom  learning  environments.   The
 9    provisions  of  this  subsection shall not apply to or affect
10    the initial issuance or making on or before June 30, 1987  of
11    any  administrative  certificate  or endorsement provided for
12    under this Section, nor shall such  provisions  apply  to  or
13    affect   the   renewal  after  June  30,  1987  of  any  such
14    certificate or endorsement initially issued  or  made  on  or
15    before June 30, 1987.
16        (c)  Administrative  certificates  shall be renewed every
17    five years with the first renewal being five years  following
18    the initial receipt of an administrative certificate. Renewal
19    requirements   for  administrators  whose  positions  require
20    certification shall be  based  upon  evidence  of  continuing
21    professional  education  which  promotes the following goals:
22    (1)  Improving  administrators'  knowledge  of  instructional
23    practices and administrative procedures; (2) Maintaining  the
24    basic level of competence required for initial certification;
25    and  (3)  Improving  the  mastery  of  skills  and  knowledge
26    regarding the improvement of teaching performance in clinical
27    settings  and assessment of the levels of student performance
28    in  their  schools.    Evidence  of  continuing  professional
29    education must include verification of biennial attendance in
30    a program developed by the Illinois  Administrators'  Academy
31    and verification of annual participation in a school district
32    approved    activity    which   contributes   to   continuing
33    professional education.  The State  Board  of  Education,  in
34    consultation  with  the  State  Teacher  Certification Board,

 1    shall develop procedures for implementing  this  Section  and
 2    shall  administer the renewal of administrative certificates.
 3    Failure  to  submit  satisfactory  evidence   of   continuing
 4    professional  education  which  contributes  to promoting the
 5    goals  of  this  Section  shall   result   in   a   loss   of
 6    administrative certification.
 7        (d)  Any  limited  or life supervisory certificate issued
 8    prior to July 1, 1968 shall continue  to  be  valid  for  all
 9    administrative   and  supervisory  positions  in  the  public
10    schools for which it is valid as of that date as long as  its
11    holder  meets the requirements for registration or renewal as
12    set forth in the statutes or until revoked according to law.
13        (e)  The  administrative  or  supervisory  positions  for
14    which the certificate shall be valid shall be  determined  by
15    one  or  more of 3 endorsements: general supervisory, general
16    administrative and superintendent.
17        Subject to the provisions of Section 21-1a,  endorsements
18    shall  be  made  under  conditions set forth in this Section.
19    The State Board of Education shall, in consultation with  the
20    State  Teacher  Certification  Board, adopt rules pursuant to
21    the  Illinois  Administrative  Procedure  Act,   establishing
22    requirements  for obtaining administrative certificates where
23    the  minimum  administrative  or   supervisory   requirements
24    surpass those set forth in this Section.
25        The State Teacher Certification Board shall file with the
26    State  Board  of  Education  a  written  recommendation  when
27    considering    additional   administrative   or   supervisory
28    requirements.  All additional  requirements  shall  be  based
29    upon the requisite knowledge necessary to perform those tasks
30    required  by  the  certificate.  The State Board of Education
31    shall in consultation with the  State  Teacher  Certification
32    Board,  establish  standards  within  its  rules  which shall
33    include the academic and professional requirements  necessary
34    for  certification.   These  standards  shall  at  a  minimum

 1    contain, but not be limited to, those used by the State Board
 2    of Education in determining whether additional knowledge will
 3    be  required.   Additionally,  the  State  Board of Education
 4    shall in consultation with the  State  Teacher  Certification
 5    Board,  establish  provisions  within  its  rules whereby any
 6    member of the educational community or the public may file  a
 7    formal    written   recommendation   or   inquiry   regarding
 8    requirements.
 9             (1)  Until July 1,  2003,  the  general  supervisory
10        endorsement   shall  be  affixed  to  the  administrative
11        certificate of any holder who has at  least  16  semester
12        hours   of  graduate  credit  in  professional  education
13        including  8  semester  hours  of  graduate   credit   in
14        curriculum  and  research and who has at least 2 years of
15        full-time teaching experience or school service personnel
16        experience  in  public   schools,   schools   under   the
17        supervision  of  the  Department  of Corrections, schools
18        under   the   administration   of   the   Department   of
19        Rehabilitation Services, or nonpublic schools meeting the
20        standards established  by  the  State  Superintendent  of
21        Education    or   comparable   out-of-state   recognition
22        standards  approved  by  the  State   Superintendent   of
23        Education.
24             Such  endorsement shall be required for supervisors,
25        curriculum directors and for  such  similar  and  related
26        positions  as  determined  by the State Superintendent of
27        Education  in  consultation  with   the   State   Teacher
28        Certification Board.
29             (2)  The general administrative endorsement shall be
30        affixed  to  the administrative certificate of any holder
31        who has at least 20 semester hours of graduate credit  in
32        educational administration and supervision and who has at
33        least  2 years of full-time teaching experience or school
34        service personnel experience in public  schools,  schools

 1        under  the  supervision of the Department of Corrections,
 2        schools under the administration  of  the  Department  of
 3        Rehabilitation Services, or nonpublic schools meeting the
 4        standards  established  by  the  State  Superintendent of
 5        Education   or   comparable   out-of-state    recognition
 6        standards   approved   by  the  State  Superintendent  of
 7        Education.
 8             Such endorsement shall be  required  for  principal,
 9        assistant     principal,     assistant    or    associate
10        superintendent, junior college dean and  for  related  or
11        similar    positions   as   determined   by   the   State
12        Superintendent of  Education  in  consultation  with  the
13        State Teacher Certification Board.
14             Notwithstanding  any  other  provisions of this Act,
15        after January 1, 1990 and  until  January  1,  1991,  any
16        teacher  employed  by  a  district  subject to Article 34
17        shall  be   entitled   to   receive   an   administrative
18        certificate  with  a  general  administrative endorsement
19        affixed thereto if he or she: (i) had at least 3 years of
20        experience as a certified teacher for such district prior
21        to August 1, 1985; (ii) obtained a Master's degree  prior
22        to  August  1, 1985; (iii) completed at least 20 hours of
23        graduate credit in education courses (including at  least
24        12  hours  in educational administration and supervision)
25        prior to September 1,  1987;  and  (iv)  has  received  a
26        rating of superior for at least each of the last 5 years.
27        Any person who obtains an administrative certificate with
28        a  general  administrative  endorsement  affixed  thereto
29        under  this  paragraph shall not be qualified to serve in
30        any administrative position except assistant principal.
31             (3)  The chief school business official  endorsement
32        shall be affixed to the administrative certificate of any
33        holder  who  qualifies  by  having a Master's degree, two
34        years of administrative  experience  in  school  business

 1        management,  and  a  minimum  of  20  semester  hours  of
 2        graduate  credit  in  a  program established by the State
 3        Superintendent of  Education  in  consultation  with  the
 4        State  Teacher Certification Board for the preparation of
 5        school business administrators.  Such  endorsement  shall
 6        also  be affixed to the administrative certificate of any
 7        holder who qualifies  by  having  a  Master's  Degree  in
 8        Business  Administration,  Finance  or  Accounting from a
 9        regionally accredited institution of higher education.
10             After June  30,  1977,  such  endorsement  shall  be
11        required  for  any  individual  first employed as a chief
12        school business official.
13        (4)  The superintendent endorsement shall be  affixed  to
14    the   administrative   certificate  of  any  holder  who  has
15    completed 30 semester hours of  graduate  credit  beyond  the
16    master's   degree   in  a  program  for  the  preparation  of
17    superintendents of schools including  16  semester  hours  of
18    graduate  credit  in  professional  education  and who has at
19    least 2 years experience as an administrator or supervisor in
20    the public schools  or  the  State  Board  of  Education   or
21    education service regions or in nonpublic schools meeting the
22    standards   established   by   the  State  Superintendent  of
23    Education or comparable  out-of-state  recognition  standards
24    approved  by  the State Superintendent of Education and holds
25    general supervisory or general administrative endorsement, or
26    who has  had  2  years  of  experience  as  a  supervisor  or
27    administrator   while   holding   an   all-grade  supervisory
28    certificate or  a  certificate  comparable  in  validity  and
29    educational and experience requirements.
30        After  June  30, 1968, such endorsement shall be required
31    for a superintendent of schools, except as  provided  in  the
32    second paragraph of this Section and in Section 34-6.
33        Any  person  appointed  to the position of superintendent
34    between the effective date of this Act and June 30, 1993 in a

 1    school district organized pursuant  to  Article  32  with  an
 2    enrollment of at least 20,000 pupils shall be exempt from the
 3    provisions of this Subsection (4) until June 30, 1996.
 4        (f)  All  official  interpretations or acts of issuing or
 5    denying administrative certificates or  endorsements  by  the
 6    State Teacher's Certification Board, State Board of Education
 7    or the State Superintendent of Education, from the passage of
 8    P.A.  81-1208  on November 8, 1979 through September 24, 1981
 9    are hereby declared valid and legal acts in all respects  and
10    further  that  the purported repeal of the provisions of this
11    Section by P.A. 81-1208 and P.A. 81-1509 is declared null and
12    void.

14        (105 ILCS 5/21-9) (from Ch. 122, par. 21-9)
15        Sec.  21-9.   Substitute  certificates   and   substitute
16    teaching.
17        (a)  A substitute teacher's certificate may be issued for
18    teaching   in   all  grades  of  the  common  schools.   Such
19    certificate may be  issued  upon  request  of  the   regional
20    superintendent of schools of any  region in which the teacher
21    is to teach.  A substitute teacher's certificate is valid for
22    teaching   in   the  public  schools  of  any  county.   Such
23    certificate may be issued to persons who either  (a)  hold  a
24    certificate    valid  for  teaching  in the common schools as
25    shown on the face of the certificate, (b) hold a bachelor  of
26    arts degree from an institution of higher learning accredited
27    by the North Central Association or other comparable regional
28    accrediting   association  or  have  been  graduated  from  a
29    recognized institution of higher learning with  a  bachelor's
30    degree,  or  (c)  have had 2 years of teaching experience and
31    meet such other rules and regulations as may  be  adopted  by
32    the  State  Board of Education in consultation with the State
33    Teacher Certification Board.  Such certificate  shall  expire

 1    on June 30 in the fourth year from date of issue.  Substitute
 2    teacher's  certificates  are  not  subject  to endorsement as
 3    described in Section 21-1b of this Code.
 4        (b)  A teacher holding a substitute teacher's certificate
 5    may teach only in the place of a  certified  teacher  who  is
 6    under  contract  with  the employing board and may teach only
 7    when no appropriate fully certified teacher is  available  to
 8    teach  in  a substitute capacity.  A teacher holding an early
 9    childhood certificate,  an  elementary  certificate,  a  high
10    school   certificate,  or  a  special  certificate  may  also
11    substitute teach in grades K-12 but only in the  place  of  a
12    certified  teacher  who  is under contract with the employing
13    board.  A substitute teacher may teach only for a period  not
14    to exceed 90 paid school days or 450 paid school hours in any
15    one  school  district  in  any  one  school term.  Where such
16    teaching is partly on a daily and partly on an hourly  basis,
17    a  school  day  shall  be considered as 5 hours. The teaching
18    limitations imposed by this subsection upon teachers  holding
19    substitute   certificates  shall  not  apply  in  any  school
20    district operating under Article 34.

23        Sec. 21-11.3.  Resident teacher certificate.  A  resident
24    teacher certificate shall be valid for 2 years for employment
25    as a resident teacher in a public school.  It shall be issued
26    only   to  persons  who  have  graduated  from  a  regionally
27    accredited recognized institution of higher education with  a
28    bachelor's   degree,   who  are  enrolled  in  a  program  of
29    preparation approved by the State Superintendent of Education
30    in consultation with the State Teacher  Certification  Board,
31    and  who  have  passed  the  appropriate tests as required in
32    Section 21-1a  and  as  determined  by  the  State  Board  of
33    Education.   A resident teacher certificate may be issued for

 1    teaching children through grade 3 or for grades K-9, 6-12, or
 2    K-12 in a special subject area and  may  not  be  renewed.  A
 3    resident teacher may teach only in conjunction with and under
 4    the  direction  of a certified teacher and shall not teach in
 5    place of a certified teacher.

 7        (105 ILCS 5/21-11.4)
 8        Sec. 21-11.4.  Illinois Teacher Corps.
 9        (a)  The General Assembly finds and determines  that  (i)
10    it   is   important  to  encourage  the  entry  of  qualified
11    professionals into elementary and  secondary  teaching  as  a
12    second career; and (ii) there are a number of individuals who
13    have bachelors' degrees, experience in the work force, and an
14    interest  in serving youth that creates a special talent pool
15    with great potential for  enriching  the  lives  of  Illinois
16    children  as  teachers.  To provide this talent pool with the
17    opportunity to serve children as teachers, school  districts,
18    colleges,  and  universities  are  encouraged, as part of the
19    public policy of this  State,  to  enter  into  collaborative
20    programs   to   educate   and  induct  these  non-traditional
21    candidates into the teaching profession.  To  facilitate  the
22    certification   of   such  candidates,  the  State  Board  of
23    Education,   in   consultation   with   the   State   Teacher
24    Certification Board,  shall  assist  institutions  of  higher
25    education and school districts with the implementation of the
26    Illinois Teacher Corps.
27        (b)  Individuals  who  wish  to become candidates for the
28    Illinois Teacher Corps program must earn a  resident  teacher
29    certificate as defined in Section 21-11.3, including:
30             (1)  graduation   from   a   regionally   accredited
31        recognized   institution   of  higher  education  with  a
32        bachelor's degree and at least a 3.00 out of a 4.00 grade
33        point average;

 1             (2)  a minimum of 5 years of professional experience
 2        in the area the candidate wishes to teach;
 3             (3)  passing the examinations required by the  State
 4        Board of Education;
 5             (4)  enrollment  in  a  Masters  of Education Degree
 6        program approved by the State Superintendent of Education
 7        in consultation  with  the  State  Teacher  Certification
 8        Board; and
 9             (5)  completion of a 6 week summer intensive teacher
10        preparation  course  which  is the first component of the
11        Masters Degree program.
12        (c)  School districts may hire an Illinois Teacher  Corps
13    candidate  after  the  candidate  has  received  his  or  her
14    resident  teacher  certificate.   The school district has the
15    responsibility of ensuring that the  candidates  receive  the
16    supports   necessary   to  become  qualified,  competent  and
17    productive teachers.  To be eligible to  participate  in  the
18    Illinois Teacher Corps program, school districts must provide
19    a minimum of the following supports to the candidates:
20             (1)  a  salary  and  benefits  package as negotiated
21        through the teacher contracts;
22             (2)  a mentor certified  teacher  who  will  provide
23        guidance  to  one  or  more  candidates  under  a program
24        developed collaboratively  by  the  school  district  and
25        university;
26             (3)  at  least  quarterly  evaluations  performed of
27        each candidate jointly by  the  mentor  teacher  and  the
28        principal of the school or the principal's designee; and
29             (4)  a  written  and signed document from the school
30        district outlining the support the  district  intends  to
31        provide  to  the  candidates,  for  approval by the State
32        Teacher Certification Board.
33        (d)  Illinois institutions of higher education shall work
34    collaboratively with school districts and the  State  Teacher

 1    Certification  Board  to  academically prepare the candidates
 2    for the teaching profession.  To be eligible to  participate,
 3    the  College  or  School  of  Education  of  a  participating
 4    Illinois  institution  of  higher  education  must  develop a
 5    curriculum that provides, upon completion, a  Masters  Degree
 6    in  Education for the candidates.  The Masters Degree program
 7    must:
 8             (1)  receive  approval  from   the   State   Teacher
 9        Certification Board; and
10             (2)  take  no  longer  than 3 summers and 2 academic
11        years  to  complete,  and  balance  the  needs  and  time
12        constraints of the candidates.
13        (e)  Upon successful completion  of  the  Masters  Degree
14    program,   the   candidate    receives  an  Initial  Teaching
15    Certificate in the State of Illinois.
16        (f)  If an individual wishes to become a candidate in the
17    Illinois Teacher Corps program, but does not possess 5  years
18    of  professional  experience,  the individual may qualify for
19    the  program  by  participating  in  a  one  year  internship
20    teacher preparation program with a school district.  The  one
21    year  internship  shall  be  developed collaboratively by the
22    school  district  and  the  Illinois  institution  of  higher
23    education,  and  shall  be  approved  by  the  State  Teacher
24    Certification Board.
25        (g)  The State Board of Education is authorized to  award
26    grants  to  school  districts that seek to prepare candidates
27    for the teaching profession who have bachelors'  degrees  and
28    professional work experience in subjects relevant to teaching
29    fields,  but who do not have formal preparation for teaching.
30    Grants may be made to school districts for up to  $3,000  per
31    candidate  when  the  school  district, in cooperation with a
32    public  or  private  university  and  the  school  district's
33    teacher  bargaining  unit,  develop  a  program  designed  to
34    prepare teachers  pursuant  to  the  Illinois  Teacher  Corps

 1    program under this Section.

 3        (105 ILCS 5/21-12) (from Ch. 122, par. 21-12)
 4        Sec.  21-12.  Printing;  of Seal; Signature; Credentials.
 5    All certificates shall be printed by and bear the seal of the
 6    State Teacher Certification Board and the signatures  of  the
 7    chairman   and   of   the  secretary  of  the  State  Teacher
 8    Certification Board board.  Each certificate shall  show  the
 9    integrally  printed  seal  of the State Teacher Certification
10    Board.  All college credentials offered as  the  basis  of  a
11    certificate  shall be presented to the secretary of the State
12    Teacher Certification  Board  for  inspection  and  approval.
13    After  January 1, 1964, each application for a certificate or
14    evaluation  of  credentials  shall  be  accompanied   by   an
15    evaluation fee of $20 which is not refundable.
16        Commencing   July   1,   1999,  each  application  for  a
17    certificate or evaluation of credentials shall be accompanied
18    by  an  evaluation  fee  of  $30   payable   to   the   State
19    Superintendent  of  Education, January 1, 1994, an additional
20    $10 shall be charged for each application for  a  certificate
21    or  evaluation of credentials which is not refundable, except
22    that no application or evaluation fee shall be required for a
23    Master Certificate  issued  pursuant  to  subsection  (d)  of
24    Section 21-2 of this Code.  There is hereby created a Teacher
25    Certificate  Fee  Revolving Fund as a special fund within the
26    State Treasury.  The proceeds of each $30 the additional  $10
27    fee  shall be paid into the Teacher Certificate Fee Revolving
28    Fund, created under Section  21-1b  of  this  Code;  and  the
29    moneys in that Fund shall be appropriated and used to provide
30    the  technology  and other resources necessary for the timely
31    and efficient processing of certification requests.
32        When evaluation verifies the  requirements  for  a  valid
33    certificate,  the  applicant  shall  be issued an entitlement

 1    card that may be presented to a  regional  superintendent  of
 2    schools  together  with a fee of one dollar for issuance of a
 3    certificate.
 4        The applicant shall be notified of any deficiencies.

 6        (105 ILCS 5/21-14) (from Ch. 122, par. 21-14)
 7        Sec. 21-14. Registration and renewal of certificates.
 8        (a)  A limited four-year  certificate  or  a  certificate
 9    issued  after  July  1,  1955,  shall  be  renewable  at  its
10    expiration  or  within  60  days  thereafter  by  the  county
11    superintendent of schools having supervision and control over
12    the  school  where  the  teacher  is  teaching upon certified
13    evidence of meeting the requirements for renewal as  required
14    by this Act and prescribed by the State Board of Education in
15    consultation  with the State Teacher Certification Board.  An
16    elementary supervisory certificate shall not  be  renewed  at
17    the  end  of  the  first  four-year  period  covered  by  the
18    certificate  unless  the  holder  thereof has filed certified
19    evidence with the State Teacher Certification Board  that  he
20    has  a master's degree or that he has earned 8 semester hours
21    of credit in the  field  of  educational  administration  and
22    supervision  in  a recognized institution of higher learning.
23    The holder shall continue to earn 8 semester hours of  credit
24    each  four-year  period  until  such  time as he has earned a
25    master's degree.
26        All certificates not  renewed  or  registered  as  herein
27    provided  shall  lapse  after  a period of 5 4 years from the
28    expiration  of  the  last   year   of   registration.    Such
29    certificates  may  be  reinstated  for a one year period upon
30    payment  of  all   accumulated   registration   fees.    Such
31    reinstated certificates shall only be renewed: (1) by earning
32    5  semester  hours  of  credit in a recognized institution of
33    higher learning in the field of professional education or  in

 1    courses  related to the holder's contractual teaching duties;
 2    or (2) by presenting evidence  of  holding  a  valid  regular
 3    certificate  of  some  other  type.   Any  certificate may be
 4    voluntarily  surrendered  by  the  certificate   holder.    A
 5    voluntarily  surrendered  certificate  shall  be treated as a
 6    revoked certificate.
 7        (b)  When  those  teaching  certificates  issued   before
 8    February 15, 2000 July 1, 1999 are renewed for the first time
 9    after  February  15,  2000  July  1,  1999, all such teaching
10    certificates  shall  be  exchanged  for   Standard   Teaching
11    Certificates  as  provided in subsection (c) of Section 21-2.
12    All Initial and  Standard  Teaching  Certificates,  including
13    those   issued   to  persons  who  previously  held  teaching
14    certificates issued before February 15, 2000  July  1,  1999,
15    shall  be  renewable  under  the conditions set forth in this
16    subsection (b).
17        Initial Teaching Certificates are  nonrenewable  and  are
18    valid   for   4   years   of  teaching.    Standard  Teaching
19    Certificates are renewable  every  5  years  as  provided  in
20    subsection  (c)  of  Section  21-2 and subsection (c) of this
21    Section.  For purposes of this Section, "teaching" is defined
22    as employment and performance  of  services  in  an  Illinois
23    public or State-operated elementary school, secondary school,
24    or  cooperative  or  joint agreement with a governing body or
25    board of control, in a certificated teaching position,  or  a
26    charter  school  operating  in  compliance  with  the Charter
27    Schools Law.
28        (c)  In compliance with subsection (c) of Section 21-2 of
29    this  Code,  which  provides   that   a   Standard   Teaching
30    Certificate may be renewed by the State Teacher Certification
31    Board   based   upon   proof   of   continuing   professional
32    development,  the  State  Board  of  Education  and the State
33    Teacher Certification Board shall jointly:
34             (1)  establish a  procedure  for  renewing  Standard

 1        Teaching  Certificates,  which  shall  include but not be
 2        limited to annual timelines for the renewal  process  and
 3        the  components  set forth in subsections (d) through (k)
 4        of this Section;
 5             (2)  establish   the   standards   for   certificate
 6        renewal;
 7             (3)  approve    the    providers    of    continuing
 8        professional development activities;
 9             (4)  determine the maximum credit for each  category
10        of  continuing professional development activities, based
11        upon   recommendations   submitted   by   a    continuing
12        professional development activity task force, which shall
13        consist  of  6  staff  members  from  the  State Board of
14        Education,  appointed  by  the  State  Superintendent  of
15        Education, and 6 teacher representatives, 3 of  whom  are
16        selected  by  the Illinois Education Association and 3 of
17        whom are selected by the Illinois Federation of Teachers;
18             (5)  designate the type and amount of  documentation
19        required to show that continuing professional development
20        activities have been completed; and
21             (6)  provide,  on  a  timely  basis  to all Illinois
22        teachers, certificate holders,  regional  superintendents
23        of schools, school districts, and others with an interest
24        in continuing professional development, information about
25        the  standards  and  requirements established pursuant to
26        this subsection (c).
27        (d)  Any  Standard  Teaching  Certificate  held   by   an
28    individual  employed  and  performing services in an Illinois
29    public or State-operated elementary school, secondary school,
30    or cooperative or joint agreement with a  governing  body  or
31    board  of  control  in  a certificated teaching position or a
32    charter school in compliance with  the  Charter  Schools  Law
33    must  be  maintained  Valid  and  Active  through certificate
34    renewal  activities  specified  in  the  certificate  renewal

 1    procedure established pursuant  to  subsection  (c)  of  this
 2    Section,  provided  that  a  holder  of  a  Valid  and Active
 3    certificate who is only employed on either a part-time  basis
 4    or  day-to-day  basis  as a substitute teacher shall pay only
 5    the required registration fee to renew his or her certificate
 6    and maintain it as Valid  and  Active.   All  other  Standard
 7    Teaching  Certificates  held  may  be maintained as Valid and
 8    Exempt through the registration process provided for  in  the
 9    certificate   renewal   procedure   established  pursuant  to
10    subsection  (c)  of  this  Section.   A  Valid   and   Exempt
11    certificate must be immediately activated, through procedures
12    developed  jointly  by  the  State Board of Education and the
13    State  Teacher  Certification  Board,  upon  the  certificate
14    holder  becoming  employed  and  performing  services  in  an
15    Illinois  public   or   State-operated   elementary   school,
16    secondary  school,  or  cooperative or joint agreement with a
17    governing body or board of control in a certificated teaching
18    position or a charter school operating in compliance with the
19    Charter  Schools  Law.   A  holder  of  a  Valid  and  Exempt
20    certificate may  activate  his  or  her  certificate  through
21    procedures  provided for in the certificate renewal procedure
22    established pursuant to subsection (c) of this Section.
23        (e)(1)  A Standard Teaching  Certificate  that  has  been
24    maintained  as  Valid  and  Active  for  the  5  years of the
25    certificate's validity shall be renewed as Valid  and  Active
26    upon  the  certificate  holder:  (i)  completing  at  least 8
27    semester hours of coursework as described in subdivision  (A)
28    of  paragraph  (3)  of  this  subsection (e); (ii) earning at
29    least  24  continuing  education  units   as   described   in
30    subdivision  (B)  of  paragraph  (3)  of this subsection (e);
31    (iii) completing the National Board for Professional Teaching
32    Standards  process  as  described  in  subdivision   (C)   of
33    paragraph  (3)  of  this  subsection (e); or (iv) earning 120
34    continuing  professional  development   units   ("CPDU")   as

 1    described  in  subdivision  (D)  of  paragraph  (3)  of  this
 2    subsection   (e).    The   maximum   continuing  professional
 3    development   units   for   each   continuing    professional
 4    development  activity  identified in subdivisions (E) through
 5    (I) of paragraph (3) of this subsection (e) shall be  jointly
 6    determined  by  the  State  Board  of Education and the State
 7    Teacher Certification Board.  If,  however,  the  certificate
 8    holder has maintained the certificate as Valid and Exempt for
 9    a  portion  of  the  5-year period of validity, the number of
10    continuing professional development units needed to renew the
11    certificate as Valid  and  Active  shall  be  proportionately
12    reduced  by  the amount of time the certificate was Valid and
13    Exempt. Furthermore, if a certificate holder is employed  and
14    performs  teaching services on a part-time basis for all or a
15    portion of the certificate's 5-year period of  validity,  the
16    number of continuing professional development units needed to
17    renew the certificate as Valid and Active shall be reduced by
18    50%  for  the  amount of time the certificate holder has been
19    employed and  performed  teaching  services  on  a  part-time
20    basis.   Part-time  shall  be defined as less than 50% of the
21    school day or school term.
22        (2)  Each Valid and Active Standard Teaching  Certificate
23    holder   shall   develop   a  certificate  renewal  plan  for
24    satisfying   the    continuing    professional    development
25    requirement provided for in subsection (c) of Section 21-2 of
26    this  Code.    Certificate holders with multiple certificates
27    shall develop a certificate renewal plan that addresses  only
28    that  certificate  or those certificates that are required of
29    his or her certificated teaching position, if the certificate
30    holder is employed and performing  services  in  an  Illinois
31    public or State-operated elementary school, secondary school,
32    or  cooperative  or  joint agreement with a governing body or
33    board of control, or that certificate or  those  certificates
34    most  closely related to his or her teaching position, if the

 1    certificate holder is employed in a charter  school.   Except
 2    as  otherwise  provided in this subsection (e), a certificate
 3    renewal  plan  shall  include  a  minimum  of  3   individual
 4    improvement  goals  developed  by  the certificate holder and
 5    shall reflect purposes (A), (B),  and  (C)  and  may  reflect
 6    purpose   (D)   of   the  following  continuing  professional
 7    development purposes:
 8             (A)  Advance both the certificate holder's knowledge
 9        and skills as a  teacher  consistent  with  the  Illinois
10        Professional  Teaching Standards and the Illinois Content
11        Area Standards  in  the  certificate  holder's  areas  of
12        certification,  endorsement,  or  teaching  assignment in
13        order to keep the certificate  holder  current  in  those
14        areas.
15             (B)  Develop  the certificate holder's knowledge and
16        skills  in  areas  determined  to  be  critical  for  all
17        Illinois teachers, as  defined  by  the  State  Board  of
18        Education, known as "State priorities".
19             (C)  Address the knowledge, skills, and goals of the
20        certificate  holder's  local  school improvement plan, if
21        the  teacher  is  employed  in  an  Illinois  public   or
22        State-operated  elementary  school,  secondary school, or
23        cooperative or joint agreement with a governing  body  or
24        board of control.
25             (D)  Expand  knowledge  and  skills in an additional
26        teaching field  or  toward  the  acquisition  of  another
27        teaching  certificate, endorsement, or relevant education
28        degree.
29    A certificate renewal plan must include a description of  how
30    these goals are to be achieved and an explanation of selected
31    continuing   professional   development   activities   to  be
32    completed, each of  which  must  meet  one  or  more  of  the
33    continuing  professional  development  purposes  specified in
34    this  paragraph  (2).   The  plan  shall  identify  potential

 1    activities  and  include  projected   timelines   for   those
 2    activities that will assure completion of the plan before the
 3    expiration  of  the  5-year validity of the Standard Teaching
 4    Certificate.  Except as otherwise provided in this subsection
 5    (e), at least  50%  of  continuing  professional  development
 6    units  must  relate to purposes (A) and (B) set forth in this
 7    paragraph (2): the  advancement  of  a  certificate  holder's
 8    knowledge  and  skills  as  a  teacher  consistent  with  the
 9    Illinois  Professional  Teaching  Standards  and the Illinois
10    Content Area Standards in the certificate holder's  areas  of
11    certification,  endorsement,  or teaching assignment in order
12    to keep the certificate holder current in those areas and the
13    development of a certificate holder's knowledge and skills in
14    the State priorities that exist at the time  the  certificate
15    renewal plan is developed.
16        (3)  Continuing   professional   development   activities
17    included  in  a certificate renewal plan may include, but are
18    not limited to, the following activities:
19             (A)  at least 8 semester hours of coursework  in  an
20        approved  education-related  program, of which at least 2
21        semester hours  relate  to  the  continuing  professional
22        development purpose set forth in purpose (A) of paragraph
23        (2)  of  this  subsection  (e), provided that such a plan
24        need  not  include  any  other  continuing   professional
25        development  activities nor reflect or contain activities
26        related to the other continuing professional  development
27        purposes  set  forth  in paragraph (2) of this subsection
28        (e);
29             (B)  continuing education  units  that  satisfy  the
30        continuing professional development purposes set forth in
31        paragraph   (2)   of   this  subsection  (e),  with  each
32        continuing  education  unit  equal  to  5  clock   hours,
33        provided that a plan that includes at least 24 continuing
34        education  units  (or  120  clock/contact hours) need not

 1        include any  other  continuing  professional  development
 2        activities;
 3             (C)  completion    of    the   National   Board   of
 4        Professional  Teaching   Standards   ("NBPTS")   process,
 5        provided  that  a  plan  that  includes completion of the
 6        NBPTS process  need  not  include  any  other  continuing
 7        professional   development   activities  nor  reflect  or
 8        contain activities related to the continuing professional
 9        development  purposes  set  forth  in  paragraph  (2)  of
10        subsection (e) of this Section;
11             (D)  completion  of  120   continuing   professional
12        development    units    that   satisfy   the   continuing
13        professional development purposes set forth in  paragraph
14        (2)  of  this  subsection  (e)  and  may  include without
15        limitation the activities identified in subdivisions  (E)
16        through (I) of this paragraph (3);
17             (E)  collaboration    and   partnership   activities
18        related to improving the teacher's knowledge  and  skills
19        as a teacher, including the following:
20                  (i)  participating  on  collaborative  planning
21             and professional improvement teams and committees;
22                  (ii)  peer review and coaching;
23                  (iii)  mentoring in a formal mentoring program,
24             including    service   as   a   consulting   teacher
25             participating in a  remediation  process  formulated
26             under Section 24A-5 of this Code;
27                  (iv)  participating in site-based management or
28             decision  making teams, relevant committees, boards,
29             or  task   forces   directly   related   to   school
30             improvement plans;
31                  (v)  coordinating    community   resources   in
32             schools, if the project is a specific  goal  of  the
33             school improvement plan;
34                  (vi)  facilitating  parent  education  programs

 1             for a school, school district, or regional office of
 2             education directly related to student achievement or
 3             school improvement plans;
 4                  (vii)  participating  in  business,  school, or
 5             community partnerships directly related  to  student
 6             achievement or school improvement plans;
 7                  (viii)  supervising   a   student   teacher  or
 8             teacher education candidate in clinical supervision,
 9             provided that the supervision may  only  be  counted
10             once during the course of 5 years;
11             (F)  college  or  university  coursework  related to
12        improving the teacher's knowledge and skills as a teacher
13        as follows:
14                  (i)  completing   undergraduate   or   graduate
15             credit   earned   from   a   regionally   accredited
16             institution   in   coursework   relevant   to    the
17             certificate   area   being   renewed,  provided  the
18             coursework  meets  Illinois  Professional   Teaching
19             Standards  or  Illinois  Content  Area Standards and
20             supports the essential  characteristics  of  quality
21             professional development; or
22                  (ii)  teaching college or university courses in
23             areas   relevant   to  the  certificate  area  being
24             renewed, provided that  the  teaching  may  only  be
25             counted once during the course of 5 years;
26             (G)  conferences,  workshops,  institutes, seminars,
27        and  symposiums  related  to  improving   the   teacher's
28        knowledge   and   skills  as  a  teacher,  including  the
29        following:
30                  (i)  completing non-university credit  directly
31             related  to  student achievement, school improvement
32             plans, or State priorities;
33                  (ii)  participating   in   or   presenting   at
34             workshops, seminars,  conferences,  institutes,  and

 1             symposiums;
 2                  (iii)  training   as   external  reviewers  for
 3             Quality Assurance;
 4                  (iv)  training  as  reviewers   of   university
 5             teacher preparation programs;
 6             (H)  other   educational   experiences   related  to
 7        improving  the  teacher's  knowledge  and  skills  as   a
 8        teacher, including the following:
 9                  (i)  participating   in   action  research  and
10             inquiry projects;
11                  (ii)  observing   programs   or   teaching   in
12             schools, related businesses,  or  industry  that  is
13             systematic,  purposeful, and relevant to certificate
14             renewal;
15                  (iii)  traveling  related  to   ones   teaching
16             assignment,  directly related to student achievement
17             or school improvement plans and approved at least 30
18             days prior to the travel experience,  provided  that
19             the traveling shall not include time spent commuting
20             to  destinations  where the learning experience will
21             occur;
22                  (iv)  participating in study groups related  to
23             student achievement or school improvement plans;
24                  (v)  serving  on  a statewide education-related
25             committee, including but not limited  to  the  State
26             Teacher   Certification   Board,   State   Board  of
27             Education  strategic  agenda  teams,  or  the  State
28             Advisory  Council  on  Education  of  Children  with
29             Disabilities;
30                  (vi)  participating in work/learn  programs  or
31             internships; or
32             (I)  professional  leadership experiences related to
33        improving  the  teacher's  knowledge  and  skills  as   a
34        teacher, including the following:

 1                  (i)  participating in curriculum development or
 2             assessment   activities   at   the   school,  school
 3             district, regional office of  education,  State,  or
 4             national level;
 5                  (ii)  participating   in   team  or  department
 6             leadership in a school or school district;
 7                  (iii)  participating on  external  or  internal
 8             school or school district review teams;
 9                  (iv)  publishing educational articles, columns,
10             or  books  relevant  to  the  certificate area being
11             renewed; or
12                  (v)  participating   in   non-strike    related
13             professional   association   or  labor  organization
14             service  or  activities  related   to   professional
15             development.
16        (4)  A   certificate   renewal  plan  must  initially  be
17    approved  by  the  certificate  holder's  local  professional
18    development committee, as provided for in subsection  (f)  of
19    this   Section.    If   the  local  professional  development
20    committee does not approve the certificate renewal plan,  the
21    certificate  holder  may  appeal  that  determination  to the
22    regional  professional  development  review   committee,   as
23    provided  for  in  paragraph  (2)  of  subsection (g) of this
24    Section.  If the  regional  professional  development  review
25    committee  disagrees  with the local professional development
26    committee's determination, the certificate renewal plan shall
27    be deemed approved  and  the  certificate  holder  may  begin
28    satisfying the continuing professional development activities
29    set   forth  in  the  plan.   If  the  regional  professional
30    development  review   committee   agrees   with   the   local
31    professional   development   committee's  determination,  the
32    certificate renewal plan  shall  be  deemed  disapproved  and
33    shall  be  returned  to  the  certificate holder to develop a
34    revised certificate renewal plan.  In all cases, the regional

 1    professional development review committee  shall  immediately
 2    notify  both the local professional development committee and
 3    the certificate holder of its determination.
 4        (5)  A  certificate  holder  who  wishes  to  modify  the
 5    continuing professional development activities  or  goals  in
 6    his  or her certificate renewal plan must submit the proposed
 7    modifications to his or her  local  professional  development
 8    committee  for  approval  prior  to  engaging in the proposed
 9    activities.  If the local professional development  committee
10    does  not  approve the proposed modification, the certificate
11    holder  may  appeal  that  determination  to   the   regional
12    professional  development  review  committee, as set forth in
13    paragraph (4) of this subsection (e).
14        (6)  When a certificate  holder  changes  assignments  or
15    school   districts   during   the   course  of  completing  a
16    certificate renewal plan, the  professional  development  and
17    continuing education credit earned pursuant to the plan shall
18    transfer  to  the new assignment or school district and count
19    toward the total requirements.  This certificate renewal plan
20    must  be  reviewed  by  the  appropriate  local  professional
21    development committee and may  be  modified  to  reflect  the
22    certificate  holder's  new  work  assignment  or  the  school
23    improvement  plan  of  the  new  school  district  or  school
24    building.
25        (f)  Notwithstanding  any  other provisions of this Code,
26    each school district,  charter  school,  and  cooperative  or
27    joint  agreement  with  a  governing body or board of control
28    that  employs  certificated  staff,   shall   establish   and
29    implement,  in conjunction with its exclusive representative,
30    if  any,  one  or   more   local   professional   development
31    committees,  as set forth in this subsection (f), which shall
32    perform the following functions:
33             (1)  review and approve  certificate  renewal  plans
34        and  any  modifications  made  to  these plans, including

 1        transferred plans;
 2             (2)  maintain a file of approved certificate renewal
 3        plans;
 4             (3)  monitor  certificate   holders'   progress   in
 5        completing approved certificate renewal plans;
 6             (4)  assist   in  the  development  of  professional
 7        development  plans  based  upon   needs   identified   in
 8        certificate renewal plans;
 9             (5)  determine  whether certificate holders have met
10        the requirements of their certificate renewal  plans  and
11        notify certificate holders of its determination;
12             (6)  provide   a   certificate   holder   with   the
13        opportunity   to   address  the  committee  when  it  has
14        determined that the certificate holder has  not  met  the
15        requirements of his or her certificate renewal plan;
16             (7)  issue  and  forward recommendations for renewal
17        or nonrenewal of certificate holders'  Standard  Teaching
18        Certificates  to  the appropriate regional superintendent
19        of schools, based upon whether certificate  holders  have
20        met   the  requirements  of  their  approved  certificate
21        renewal  plans,  with  30-day  written  notice   of   its
22        recommendation  provided  to the certificate holder prior
23        to  forwarding  the  recommendation   to   the   regional
24        superintendent  of  schools,  provided  that if the local
25        professional development  committee's  recommendation  is
26        for  certificate  nonrenewal, the written notice provided
27        to the certificate holder shall include a return receipt;
28        and
29             (8)  reconsider its  recommendation  of  certificate
30        nonrenewal, upon request of the certificate holder within
31        30 days of receipt of written notification that the local
32        professional  development  committee  will  make  such  a
33        recommendation,    and    forward    to    the   regional
34        superintendent of schools its  recommendation  within  30

 1        days of receipt of the certificate holder's request.
 2        Each   local  professional  development  committee  shall
 3    consist of at least 3 classroom teachers; one  superintendent
 4    or  chief  administrator  of  the  school  district,  charter
 5    school,  or  cooperative  or  joint  agreement  or his or her
 6    designee; and one at-large member who shall be either  (i)  a
 7    parent,  (ii)  a  member  of  the business community, (iii) a
 8    community member, or (iv) an administrator,  with  preference
 9    given to an individual chosen from among those persons listed
10    in   items   (i),   (ii),   and  (iii)  in  order  to  secure
11    representation of an interest not already represented on  the
12    committee.   If  mutually agreed upon by the school district,
13    charter school, or governing body or board of  control  of  a
14    cooperative    or   joint   agreement   and   its   exclusive
15    representative, if any, additional members may be added to  a
16    local  professional  development  committee,  provided that a
17    majority of  members  are  classroom  teachers.   The  school
18    district,  charter  school,  or  governing  body  or board of
19    control of a cooperative or joint agreement and its exclusive
20    representative, if any, shall determine the term  of  service
21    of the members of a local professional development committee.
22    All  individuals  selected  to  serve  on  local professional
23    development committees must be known to demonstrate the  best
24    practices in teaching or their respective field of practice.
25        The  exclusive  representative,  if any, shall select the
26    classroom  teacher  members   of   the   local   professional
27    development   committee.    If  no  exclusive  representative
28    exists,  then  the  classroom  teacher  members  of  a  local
29    professional development committee shall be selected  by  the
30    classroom  teachers  that  come within the local professional
31    development  committee's  authority.   The  school  district,
32    charter school, or governing body or board of  control  of  a
33    cooperative   or   joint   agreement   shall   select  the  2
34    non-classroom teacher members (the  superintendent  or  chief

 1    administrator  of  the  school  district,  charter school, or
 2    cooperative or joint agreement or his or her designee and the
 3    at-large  member)  of  a   local   professional   development
 4    committee.   Vacancies  in  positions on a local professional
 5    development committee shall be filled in the same  manner  as
 6    the original selections.  The members of a local professional
 7    development  committee  shall  select  a  chairperson.  Local
 8    professional  development   committee   meetings   shall   be
 9    scheduled  so  as  not  to  interfere with committee members'
10    regularly scheduled teaching duties,  except  when  otherwise
11    permitted  by the policies of or agreed to or approved by the
12    school district, charter school, or governing body  or  board
13    of  control  of  a  cooperative  or  joint  agreement, or its
14    designee.
15        The board of education or governing board  shall  convene
16    the  first  meeting  of  the  local  professional development
17    committee.  All  actions  taken  by  the  local  professional
18    development  committee  shall  require  that  a  majority  of
19    committee  members be present, and no committee action may be
20    taken unless  50%  or  more  of  those  present  are  teacher
21    members.
22        The  State  Board  of  Education  and  the  State Teacher
23    Certification Board shall jointly provide local  professional
24    development committee members with a training manual, and the
25    members  shall  certify  that they have received and read the
26    manual.
27        Notwithstanding any other provisions of  this  subsection
28    (f),  for  a  teacher  employed  and performing services in a
29    nonpublic or State-operated elementary or  secondary  school,
30    all  references to a local professional development committee
31    shall mean the regional  superintendent  of  schools  of  the
32    regional  office  of  education for the geographic area where
33    the teaching is done.
34        (g)(1)  Each regional  superintendent  of  schools  shall

 1    review  and  concur or nonconcur with each recommendation for
 2    renewal or nonrenewal of a Standard Teaching  Certificate  he
 3    or   she  receives  from  a  local  professional  development
 4    committee  or,  if   a   certificate   holder   appeals   the
 5    recommendation   to  the  regional  professional  development
 6    review  committee,  the   recommendation   for   renewal   or
 7    nonrenewal  he  or  she receives from a regional professional
 8    development review committee and, within 14 days  of  receipt
 9    of  the  recommendation,  shall  provide  the  State  Teacher
10    Certification  Board  with  verification of the following, if
11    applicable:
12             (A)  a  certificate  renewal  plan  was  filed   and
13        approved    by   the   appropriate   local   professional
14        development committee;
15             (B)  the  professional  development  and  continuing
16        education  activities   set   forth   in   the   approved
17        certificate   renewal   plan   have  been  satisfactorily
18        completed;
19             (C)  the local  professional  development  committee
20        has  recommended  the renewal of the certificate holder's
21        Standard   Teaching   Certificate   and   forwarded   the
22        recommendation, along with all  supporting  documentation
23        as  jointly  required by the State Board of Education and
24        the State Teacher Certification Board,  to  the  regional
25        superintendent of schools;
26             (D)  the  certificate holder has appealed his or her
27        local professional development committee's recommendation
28        of nonrenewal to the  regional  professional  development
29        review committee and the result of that appeal;
30             (E)  the  regional  superintendent  of  schools  has
31        concurred  or  nonconcurred  with  the local professional
32        development   committee's   or   regional    professional
33        development review committee's recommendation to renew or
34        nonrenew   the  certificate  holder's  Standard  Teaching

 1        Certificate and made a recommendation to that effect; and
 2             (F)  the  established  registration  fee   for   the
 3        Standard Teaching Certificate has been paid.
 4    At  the  same  time  the  regional  superintendent of schools
 5    provides the  State  Teacher  Certification  Board  with  the
 6    notice  required by this subsection (g), he or she shall also
 7    notify the certificate holder in writing that this notice has
 8    been provided  to  the  State  Teacher  Certification  Board,
 9    provided   that  if  the  notice  provided  by  the  regional
10    superintendent of schools to the State Teacher  Certification
11    Board  includes  a  recommendation of certificate nonrenewal,
12    the written notice provided to the certificate  holder  shall
13    be by certified mail, return receipt requested.
14        (2)  Each  certificate  holder  shall  have  the right to
15    appeal his or her local professional development  committee's
16    recommendation  of  nonrenewal  to  the regional professional
17    development review committee, within 14 days  of  receipt  of
18    notice  that the recommendation has been sent to the regional
19    superintendent of schools.  Each regional  superintendent  of
20    schools  shall  establish a regional professional development
21    review committee or committees for the  purpose  of  advising
22    the  regional  superintendent  of  schools, upon request, and
23    handling certificate holder appeals.   This  committee  shall
24    consist    of    at   least   4   classroom   teachers,   one
25    non-administrative  certificated  educational   employee,   2
26    administrators,  and  one at-large member who shall be either
27    (i) a parent, (ii) a member of the business community,  (iii)
28    a community member, or (iv) an administrator, with preference
29    given to an individual chosen from among those persons listed
30    in   items   (i),   (ii),   and  (iii)  in  order  to  secure
31    representation of an interest not already represented on  the
32    committee.   The  teacher and non-administrative certificated
33    educational employee members of the review committee shall be
34    selected by their exclusive representative, if any,  and  the

 1    administrators  and  at-large member shall be selected by the
 2    regional   superintendent    of    schools.     A    regional
 3    superintendent  of  schools may add additional members to the
 4    committee, provided that the same proportion of  teachers  to
 5    administrators  and  at-large  members  on  the  committee is
 6    maintained.  Any additional  teacher  and  non-administrative
 7    certificated  educational  employee members shall be selected
 8    by their exclusive  representative,  if  any.   Vacancies  in
 9    positions  on  a  regional  professional  development  review
10    committee  shall be filled in the same manner as the original
11    selections.  Committee members shall serve  staggered  3-year
12    terms.    All  individuals  selected  to  serve  on  regional
13    professional development review committees must be  known  to
14    demonstrate   the   best   practices  in  teaching  or  their
15    respective field of practice.
16        The exclusive representative responsible for choosing the
17    individuals that serve on a regional professional development
18    review committee shall notify each school  district,  charter
19    school,   or   governing  body  or  board  of  control  of  a
20    cooperative or  joint  agreement  employing  the  individuals
21    chosen  to  serve  and provide their names to the appropriate
22    regional superintendent of  schools.   Regional  professional
23    development  review  committee meetings shall be scheduled so
24    as not to interfere with  the  committee  members'  regularly
25    scheduled teaching duties, except when otherwise permitted by
26    the  policies  of  or  agreed  to  or  approved by the school
27    district, charter school,  or  governing  body  or  board  of
28    control of a cooperative or joint agreement, or its designee,
29    provided   that  the  school  district,  charter  school,  or
30    governing body or board of  control  shall  not  unreasonably
31    withhold permission for a committee member to attend regional
32    professional development review committee meetings.
33        In a city having a population exceeding 500,000 that does
34    not have a regional office of education, one or more separate

 1    regional  professional development review committees shall be
 2    established as mutually agreed upon by the board of education
 3    of the school district organized under  Article  34  of  this
 4    Code  and  the  exclusive representative.  The composition of
 5    each  committee  shall  be  the  same  as  for   a   regional
 6    professional   development   review  committee,  except  that
 7    members of the committee shall be jointly  appointed  by  the
 8    board  of  education  and  the  exclusive representative. All
 9    other  provisions  of  this   Section   concerning   regional
10    professional  development  review  committees  shall apply to
11    these committees.
12        The regional professional  development  review  committee
13    may  require  information in addition to that received from a
14    certificate holder's local professional development committee
15    or request that the  certificate  holder  appear  before  it,
16    shall  either  concur  or nonconcur with a local professional
17    development committee's  recommendation  of  nonrenewal,  and
18    shall  forward  to the regional superintendent of schools its
19    recommendation of renewal or nonrenewal.  All  actions  taken
20    by  the  regional  professional  development review committee
21    shall require a quorum and be by a simple majority  of  those
22    present  and  voting.    A  record  of  all  votes  shall  be
23    maintained.  The committee shall have 45 days from receipt of
24    a  certificate  holder's appeal to make its recommendation to
25    the regional superintendent of schools.
26        The State  Board  of  Education  and  the  State  Teacher
27    Certification    Board   shall   jointly   provide   regional
28    professional development  review  committee  members  with  a
29    training  manual, and the members shall be required to attend
30    one training seminar sponsored jointly by the State Board  of
31    Education and the State Teacher Certification Board.
32        (h)(1)  The   State  Teacher  Certification  Board  shall
33    review    the    regional    superintendent    of    schools'
34    recommendations  to  renew  or  nonrenew  Standard   Teaching

 1    Certificates   and  notify  certificate  holders  in  writing
 2    whether their certificates have been  renewed  or  nonrenewed
 3    within  90  days  of receipt of the recommendations, unless a
 4    certificate holder has appealed a regional superintendent  of
 5    schools'   recommendation   of  nonrenewal,  as  provided  in
 6    paragraph (2) of this  subsection  (h).   The  State  Teacher
 7    Certification  Board shall verify that the certificate holder
 8    has met the renewal criteria set forth in  paragraph  (1)  of
 9    subsection (g) of this Section.
10        (2)  Each  certificate  holder  shall  have  the right to
11    appeal a regional superintendent of  school's  recommendation
12    to  nonrenew  his or her Standard Teaching Certificate to the
13    State Teacher Certification Board, within 14 days of  receipt
14    of  notice  that  the  decision  has  been  sent to the State
15    Teacher Certification  Board,  which  shall  hold  an  appeal
16    hearing  within  60 days of receipt of the appeal.  When such
17    an  appeal  is  taken,  the  certificate  holder's   Standard
18    Teaching  Certificate  shall  continue  to be valid until the
19    appeal   is   finally   determined.    The   State    Teacher
20    Certification  Board shall review the regional superintendent
21    of  school's  recommendation,   the   regional   professional
22    development  review  committee's  recommendation, if any, and
23    the local professional development committee's recommendation
24    and  all  relevant  documentation  to  verify   whether   the
25    certificate  holder has met the renewal criteria set forth in
26    paragraph (1) of subsection (g) of this Section.   The  State
27    Teacher  Certification Board may request that the certificate
28    holder appear before it.  All  actions  taken  by  the  State
29    Teacher  Certification Board shall require a quorum and be by
30    a simple majority of those present and voting.  A  record  of
31    all   votes   shall   be   maintained.    The  State  Teacher
32    Certification Board shall notify the  certificate  holder  in
33    writing,  within 7 days of completing the review, whether his
34    or her Standard Teaching  Certificate  has  been  renewed  or

 1    nonrenewed,  provided that if the State Teacher Certification
 2    Board determines  to  nonrenew  a  certificate,  the  written
 3    notice  provided  to  the  certificate  holder  shall  be  by
 4    certified  mail,  return  receipt requested.  All certificate
 5    renewal  or  nonrenewal  decisions  of  the   State   Teacher
 6    Certification  Board  are final and subject to administrative
 7    review, as set forth in Section 21-24 of this Code.
 8        (i)  Holders of Master Teaching Certificates  shall  meet
 9    the  same  requirements  and  follow  the  same procedures as
10    holders of Standard Teaching Certificates, except that  their
11    renewal  cycle  shall  be  as  set forth in subsection (d) of
12    Section 21-2 of this Code.
13        (j)  Holders of Valid  and  Exempt  Standard  and  Master
14    Teaching  Certificates  who  are  not employed and performing
15    services in an Illinois public or  State-operated  elementary
16    school,  secondary  school, or cooperative or joint agreement
17    with a governing body or board of control, in a  certificated
18    teaching    position,    may   voluntarily   activate   their
19    certificates  by  developing  and  submitting  a  certificate
20    renewal plan to the regional superintendent of schools of the
21    regional office of education for the  geographic  area  where
22    their teaching is done, who, or whose designee, shall approve
23    the   plan  and  serve  as  the  certificate  holder's  local
24    professional  development   committee.    These   certificate
25    holders shall follow the same renewal criteria and procedures
26    as   all  other  Standard  and  Master  Teaching  Certificate
27    holders,   except   that   their   continuing    professional
28    development plans shall not be required to reflect or address
29    the   knowledge,   skills,   and  goals  of  a  local  school
30    improvement plan.
31        (k)  Each school district, charter school, or cooperative
32    or joint agreement shall be paid an annual amount of not less
33    than $1,000, as determined by a formula based on  the  number
34    of Standard Teaching and Master Teaching Certificate holders,

 1    subject  to  renewal  and  established by rule, not to exceed
 2    $1,000,000  annually  for  all  school   districts,   charter
 3    schools,   and   cooperatives   or   joint   agreements,  for
 4    administrative costs associated with conducting the  meetings
 5    of   the  local  professional  development  committee.   Each
 6    regional office of education shall receive $2,000 annually to
 7    pay school districts, charter  schools,  or  cooperatives  or
 8    joint  agreements  for costs, as defined by rule, incurred in
 9    staff attendance at regional professional development  review
10    committee  meetings  and  the training seminar required under
11    paragraph (2) of subsection (g) of this Section.
12        (l)  The State Board of Education and the  State  Teacher
13    Certification   Board   shall   jointly   contract   with  an
14    independent party to conduct a  comprehensive  evaluation  of
15    the certificate renewal system pursuant to this Section.  The
16    first  report  of  this  evaluation shall be presented to the
17    General Assembly on January 1, 2005 and on January 1 of every
18    third year thereafter.

22        Sec. 21-16. Fees - Requirement for registration.
23        (a)  Until February 15, 2000, every applicant when issued
24    a  certificate  shall  pay  to the regional superintendent of
25    schools a fee of $1, which shall be paid into  the  institute
26    fund.  Every  certificate issued under the provisions of this
27    Act shall be registered annually or, at  the  option  of  the
28    holder  of  the certificate, once every 3 years. The regional
29    superintendent of schools having supervision and control over
30    the school where the teaching  is  done  shall  register  the
31    certificate  before  the holder begins to teach, otherwise it
32    shall be registered in any county in the State  of  Illinois;
33    and one fee of $4 per year for registration or renewal of one

 1    or  more  certificates  which  have  been  issued to the same
 2    holder shall be paid into the institute fund.
 3        Until February 15, 2000, requirements for registration of
 4    any certificate limited in time  shall  include  evidence  of
 5    professional growth defined as successful teaching experience
 6    since   last   registration  of  certificate,  attendance  at
 7    professional    meetings,    membership    in    professional
 8    organizations,  additional  credits  earned   in   recognized
 9    teacher-training   institutions,   travel   specifically  for
10    educational experience, reading  of  professional  books  and
11    periodicals,  filing  all reports as required by the regional
12    superintendent of schools and  the  State  Superintendent  of
13    Education   or   such   other   professional   experience  or
14    combination of experiences as are presented  by  the  teacher
15    and  are approved by the State Superintendent of Education in
16    consultation with the State Teacher  Certification  Board.  A
17    duplicate  certificate may be issued to the holder of a valid
18    life certificate or valid certificate limited in time by  the
19    State  Superintendent of Education; however, it shall only be
20    issued upon request of a regional superintendent  of  schools
21    and  upon  payment  to the regional superintendent of schools
22    who requests such duplicate a fee of $4.
23        (b)  Beginning February 15, 2000,  all  persons  who  are
24    issued  Standard Teaching Certificates pursuant clause (2) of
25    subsection (c) of Section 21-2  and  all  persons  who  renew
26    Standard  Teaching  Certificates  shall  pay  a  $25  fee for
27    registration of all certificates held.  All persons  who  are
28    issued  Standard  Teaching  Certificates  under clause (1) of
29    subsection (c) of Section 21-2 and all other  applicants  for
30    Standard   Teaching   Certificates   shall  pay  an  original
31    application fee, pursuant to Section 21-12, and a $25 fee for
32    registration of all certificates  held.   These  certificates
33    shall  be registered and the registration fee paid once every
34    5  years.   Standard  Teaching  Certificate  applicants   and

 1    holders  shall  not be required to pay any other registration
 2    fees for issuance or renewal of their certificates, except as
 3    provided in Section 21-17 of this Code.   Beginning  February
 4    15,  2000,  Master  Teaching Certificates shall be issued and
 5    renewed upon payment by the applicant or  certificate  holder
 6    of  a  $50  fee  for  registration  of all certificates held.
 7    These certificates shall be registered and the fee paid  once
 8    every  10  years.  Master Teaching Certificate applicants and
 9    holders shall not be required to pay any other application or
10    registration  fees  for  issuance   or   renewal   of   their
11    certificates,  except  as  provided  in Section 21-17 of this
12    Code.  All other certificates issued under the provisions  of
13    this  Code shall be registered for the validity period of the
14    certificate at the rate of $5 per year for the  total  number
15    of  years for which the certificate is valid for registration
16    of all certificates held, or for a maximum  of  5  years  for
17    life  certificates.   The  regional superintendent of schools
18    having supervision and control  over  the  school  where  the
19    teaching  is  done  shall register the certificate before the
20    holder begins to teach, otherwise it shall be  registered  in
21    any  county  in  the State of Illinois. Each holder shall pay
22    the   appropriate   registration   fee   to   the    regional
23    superintendent  of  schools.   The regional superintendent of
24    schools  shall  deposit  the  registration  fees   into   the
25    institute  fund.   Any certificate holder who teaches in more
26    than  one  educational  service  region  shall  register  the
27    certificate or certificates in all regions where the teaching
28    is done, but shall be required to pay  one  registration  fee
29    for  all  certificates held, provided holders of certificates
30    issued pursuant  to  Section  21-9  of  this  Code  shall  be
31    required  to  pay  one  registration fee, in each educational
32    service  region  in  which  his   or   her   certificate   or
33    certificates are registered, for all certificates held.
34        A  duplicate certificate may be issued to the holder of a

 1    valid life certificate or valid certificate limited  in  time
 2    by  the  State Superintendent of Education; however, it shall
 3    only be issued upon request of a regional  superintendent  of
 4    schools  and  upon  payment to the regional superintendent of
 5    schools who requests the duplicate a fee of $4,  which  shall
 6    be deposited into the institute fund.

 9        Sec.  21-17.  Fee for original and duplicate certificate.
10    A  duplicate  certificate  shall  be  issued  by  the   State
11    Superintendent  of  Education  when requested by the regional
12    superintendent of schools as provided in Section  21-16.  The
13    request for a duplicate certificate shall be accompanied by a
14    fee  of  $4,  which  shall  be  deposited  into  the  Teacher
15    Certificate Fee Revolving Fund.

18        Sec.   21-21.    Definitions;  granting  of  recognition;
19    regional accreditation).
20        (a)  "Recognized", as used in this Article in  connection
21    with  the  word "school" or "institution", means such school,
22    college, university, private junior college, public community
23    college or special or technical  school  as  maintains  a  an
24    equipment,  course  of  study,  a standard of scholarship and
25    other requirements set by the State  Board  of  Education  in
26    consultation  with  the  State  Teacher  Certification Board.
27    Application for recognition of such school or institution  as
28    a teacher education training institution shall be made to the
29    State  Board  of  Education.  The State Board of Education in
30    consultation with the State Teacher Certification Board shall
31    set the criteria by which the school or institution shall  be
32    judged  and  through the Secretary of the Board shall arrange

 1    for an official inspection and  shall  grant  recognition  of
 2    such   school   or  institution  as  may  meet  the  required
 3    standards.   If  such  standards  include  requirements  with
 4    regard  to  education  in  acquiring  skills  in working with
 5    culturally distinctive students,  as  defined  by  the  State
 6    Board  of  Education,  then  the  rules of the State Board of
 7    Education  shall  include  the  criteria  used  to   evaluate
 8    compliance  with  this  requirement. No school or institution
 9    shall make assignments of student teachers  or  teachers  for
10    practice  teaching  so as to promote segregation on the basis
11    of race, creed, color, religion, sex or national origin.
12        All recommendations for initial or standard certification
13    shall be made All courses listed or credentials  required  as
14    the  basis of any certificate or for its renewal shall be the
15    equivalent  of  courses  offered  by  a  recognized   teacher
16    training  institution  operating a program of preparation for
17    the certificate  approved  by  the  State  Superintendent  of
18    Education    in   consultation   with   the   State   Teacher
19    Certification  Board.  The  State  Board  of   Education   in
20    consultation with the State Teacher Certification Board shall
21    have  the  power  to  define  a major or minor when used as a
22    basis for recognition and certification purposes.
23        (b)  "Regionally accredited" or "accredited" as  used  in
24    this  Article  in connection with a university or institution
25    shall mean an institution of higher education  accredited  by
26    the  North  Central  Association or other comparable regional
27    accrediting association.

30        Sec.  21-25.   School  service   personnel   certificate.
31    Subject  to the provisions of Section 21-1a, a school service
32    personnel certificate shall be issued to those applicants  of
33    good  character,  good health, a citizen of the United States

 1    and at least 19 years of age who  have  a  Bachelor's  degree
 2    with  not  fewer  than  120  semester hours from a regionally
 3    accredited recognized institution of higher learning and  who
 4    meets    the    requirements   established   by   the   State
 5    Superintendent of Education in consultation  with  the  State
 6    Teacher  Certification  Board.   A  school  service personnel
 7    certificate with a school nurse endorsement may be issued  to
 8    a  person  who  holds  a  bachelor  of science degree from an
 9    institution  of  higher  learning  accredited  by  the  North
10    Central Association or other comparable regional  accrediting
11    association.    Persons  seeking any other endorsement on the
12    school service personnel certificate shall be recommended for
13    the endorsement by a recognized teacher education institution
14    as having completed a program of preparation approved by  the
15    State  Superintendent  of  Education in consultation with the
16    State Teacher Certification Board.
17        Such certificate shall  be  endorsed  with  the  area  of
18    Service   as   determined  by  the  State  Superintendent  of
19    Education   in   consultation   with   the   State    Teacher
20    Certification Board.
21        The  holder  of such certificate shall be entitled to all
22    of the rights and  privileges  granted  holders  of  a  valid
23    teaching    certificate,    including    teacher    benefits,
24    compensation and working conditions.
25        When the holder of such certificate has earned a master's
26    degree,  including  8 semester hours of graduate professional
27    education from a recognized institution of  higher  learning,
28    and  has  at  least  2  years of successful school experience
29    while  holding  such  certificate,  the  certificate  may  be
30    endorsed for supervision.

33        Sec.  34-83.   Board  of  examiners  -   Certificates   -

 1    Examinations.  A  board  of  3  examiners  shall  examine all
 2    applicants required to hold certificates  to  teach  and  the
 3    board of education shall issue gratuitously to those who pass
 4    a   required  test  of  character,  scholarship  and  general
 5    fitness,  such  certificates  to  teach  as  they  are  found
 6    entitled to receive. No person may be granted or continue  to
 7    hold  a  teaching  certificate  who  has knowingly altered or
 8    misrepresented his or her teaching qualifications in order to
 9    acquire the certificate.  Any other certificate held by  such
10    person may be suspended or revoked by the board of examiners,
11    depending   upon   the   severity   of   the   alteration  or
12    misrepresentation. The board of examiners  shall  consist  of
13    the  general superintendent of schools and 2 persons approved
14    and appointed by the board of education upon  the  nomination
15    of  the  general  superintendent  of  schools.  The  board of
16    examiners shall  hold  such  examinations  as  the  board  of
17    education  may  prescribe,  upon  the  recommendation  of the
18    general superintendent  of  schools  and  shall  prepare  all
19    necessary  eligible  lists, which shall be kept in the office
20    of the general superintendent  of  schools  and  be  open  to
21    public  inspection.  Members  of the board of examiners shall
22    hold office for a term of 2 years.
23        The  board  of  examiners  created  herein  is  abolished
24    effective July 1, 1988.  Commencing July  1,  1988,  all  new
25    teachers   employed   by   the   board  shall  hold  teaching
26    certificates issued by the State Teacher Certification  Board
27    under   Article   21.    The  State  Board  of  Education  in
28    consultation with  the  board  of  examiners  and  the  State
29    Teacher  Certification Board shall develop procedures whereby
30    teachers currently holding valid certificates issued  by  the
31    board  of  examiners,  and all teachers employed by the board
32    after August 1, 1985 and prior to  July  1,  1988,  shall  no
33    later  than  July 1, 1988 exchange certificates issued by the
34    board of examiners for comparable certificates issued by  the

 1    State  Teacher  Certification  Board.   On  the exchange of a
 2    certificate on or before July  1,  1988,  the  State  Teacher
 3    Certification   Board   shall   not  require  any  additional
 4    qualifications   for   the   issuance   of   the   comparable
 5    certificate. If prior to July 1, 1988 the board of  examiners
 6    has  issued  types  of  teaching  certificates  which are not
 7    comparable to the types of certificates issued by  the  State
 8    Teacher Certification Board, such certificates shall continue
 9    to  be  valid  for  and  shall  be  renewable  by the holders
10    thereof, and no additional qualifications shall  be  required
11    by the State Teacher Certification Board for any such renewal
12    ;  however, no individual who received a letter of continuing
13    eligibility shall be issued an Initial or  Standard  Teaching
14    Certificate, as provided in Section 21-2 of this Code, unless
15    that  individual  also  holds  such  a  valid  and  renewable
16    certificate.
17        The  State  Board  of  Education  shall report by July 1,
18    1986, to the Illinois General Assembly on the procedures  for
19    exchange  it  has developed in consultation with the board of
20    examiners  and  the  State  Teacher  Certification  Board  as
21    required in this Section.

24        Section 10.  The School  Code  is  amended  by  repealing
25    Section 21-11.

26        Section  90.  The State Mandates Act is amended by adding
27    Section 8.23 as follows:

29        Sec. 8.23. Exempt mandate.   Notwithstanding  Sections  6
30    and  8  of  this  Act  and except for the payment provided in
31    subsection (k) of  Section  21-14  of  the  School  Code,  no

 1    reimbursement by the State is required for the implementation
 2    of  any  mandate  created  by this amendatory Act of the 91st
 3    General Assembly.

 4        Section 99.  Effective date.  This Act takes effect  July
 5    1, 1999.
