 1        AN ACT concerning education, amending named Acts.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.   The  School  Code  is  amended  by  changing
 5    Sections  3-12,  21-0.01,  21-1a, 21-1b, 21-1c, 21-2, 21-2.1,
 6    21-3, 21-4, 21-5,  21-7.1,  21-9,  21-11.3,  21-11.4,  21-12,
 7    21-14,  21-16,  21-17,  21-21,  21-25,  and  34-83 and adding
 8    Sections 2-3.11c and 3-11.5 as follows:

 9        (105 ILCS 5/2-3.11c new)
10        Sec. 2-3.11c.  Teacher  supply  and  demand  report.   To
11    report  annually,  on  or  before  January 1, on the relative
12    supply and demand for education staff of the  public  schools
13    to the Governor, to the General Assembly, and to institutions
14    of  higher  education  that prepare teachers, administrators,
15    school service personnel, other certificated individuals, and
16    other professionals employed by  school  districts  or  joint
17    agreements.    The   report   shall   contain  the  following
18    information:
19             (1)  the relative supply and  demand  for  teachers,
20        administrators,     and     other     certificated    and
21        non-certificated personnel by field,  content  area,  and
22        levels;
23             (2)  State  and regional analyses of fields, content
24        areas, and levels with an over-supply or under-supply  of
25        educators; and
26             (3)  projections  of  likely  high  demand  and  low
27        demand  for  educators,  in a manner sufficient to advise
28        the  public,  individuals,  and  institutions   regarding
29        career opportunities in education.

 1        Sec.  3-11.5.   Regional  professional development review
 2    committee.  The  regional  superintendent  of  schools  shall
 3    constitute   a   regional   professional  development  review
 4    committee or committees, as  provided  in  paragraph  (2)  of
 5    subsection  (g)  of Section 21-14 of this Code, to advise the
 6    regional superintendent of schools, upon his or her  request,
 7    and  to  hear  appeals  relating  to  the renewal of teaching
 8    certificates, in accordance with Section 21-14 of this  Code.
 9    The  expenses  of these review committees shall be funded, in
10    part, from the fees collected pursuant to  Section  21-16  of
11    this Code and deposited into the institute fund.

12        (105 ILCS 5/3-12) (from Ch. 122, par. 3-12)
13        Sec.  3-12.  Institute fund. All certificate examination,
14    registration fees and a portion of renewal and duplicate fees
15    shall be kept by the regional superintendent as described  in
16    Section  21-16  of  this  Code, together with a record of the
17    names of the persons paying them. Such  fees  fund  shall  be
18    deposited  into  the  institute fund and shall be used by the
19    regional superintendent to defray  expenses  associated  with
20    the  work  of  the  regional  professional development review
21    committees  established  pursuant   to   paragraph   (2)   of
22    subsection  (g)  of  Section 21-14 of this Code to advise the
23    regional superintendent, upon his or her request, and to hear
24    appeals relating to the renewal of teaching certificates,  in
25    accordance  with  Section  21-14  of  this  Code;  to  defray
26    expenses  connected  with  improving the technology necessary
27    for the  efficient  processing  of  certificates;  to  defray
28    expenses  incidental  to  teachers'  institutes, workshops or
29    meetings of  a  professional  nature  that  are  designed  to
30    promote  the  professional  growth  of  teachers  or  for the
31    purpose of defraying the expense of any  general  or  special
32    meeting  of teachers or school personnel of the region, which
33    has been approved by the regional superintendent.

 1        The regional superintendent shall on or before January  1
 2    of  each  year  publish in a newspaper of general circulation
 3    published in the region or shall post in each school building
 4    under his jurisdiction an accounting of (1)  the  balance  on
 5    hand  in  the Institute fund at the beginning of the previous
 6    year; (2) all receipts within the previous year deposited  in
 7    the  fund, with the sources from which they were derived; (3)
 8    the amount distributed from the fund  and  the  purposes  for
 9    which  such  distributions  were made; and (4) the balance on
10    hand in the fund.

12        (105 ILCS 5/21-0.01)
13        Sec. 21-0.01.  Powers after January 1, 1998. Beginning on
14    January 1, 1998 and thereafter, the State Board of Education,
15    in consultation with the State Teacher  Certification  Board,
16    shall  have  the  power  and  authority  to  do  all  of  the
17    following:
18             (1)  set  standards  for  teaching,  supervising, or
19        holding  other  certificated  employment  in  the  public
20        schools, and  administer  the  certification  process  as
21        provided  in  this  Article;  provided, however, that the
22        State  Teacher  Certification  Board  shall   be   solely
23        responsible   for   the   renewal  of  Standard  Teaching
24        Certificates as provided in  Sections  Section  21-2  and
25        21-14 of this Code;
26             (2)  approve  and evaluate teacher and administrator
27        preparation programs;
28             (3)  enter  into  agreements   with   other   states
29        relative   to   reciprocal   approval   of   teacher  and
30        administrator preparation programs;
31             (4)  establish standards for  the  issuance  of  new
32        types of certificates; and
33             (5)  take   such   other   action  relating  to  the

 1        improvement of instruction in the public schools  through
 2        teacher  education  and professional development and that
 3        attracts  qualified  candidates  into  teacher   training
 4        programs as is appropriate and consistent with applicable
 5        laws.

 7        (105 ILCS 5/21-1a) (from Ch. 122, par. 21-1a)
 8        Sec. 21-1a. Tests required for certification.
 9        (a)  After  July  1,  1988,  in  addition  to  all  other
10    requirements,  early  childhood,  elementary,  special,  high
11    school,  school  service personnel, or, except as provided in
12    Section 34-6, administrative certificates shall be issued  to
13    persons who have satisfactorily passed a test of basic skills
14    and  subject matter knowledge.  The tests of basic skills and
15    subject matter knowledge shall be the tests which  from  time
16    to  time  are  designated  by the State Board of Education in
17    consultation with the State Teacher Certification  Board  and
18    may  be tests prepared by an educational testing organization
19    or  tests  designed  by  the  State  Board  of  Education  in
20    consultation with the State Teacher Certification Board.  The
21    areas to be covered by the test of basic skills shall include
22    the  basic  skills   of   reading,   writing,   grammar   and
23    mathematics.   The  test  of  subject  matter knowledge shall
24    assess content knowledge in the specific subject  field.  The
25    tests shall be designed to be racially neutral to assure that
26    no  person  in  taking  the  tests  is  thereby discriminated
27    against on the basis of race, color, national origin or other
28    factors unrelated to the person's ability  to  perform  as  a
29    certificated  employee.  The score required to pass the tests
30    of basic skills and subject matter knowledge shall  be  fixed
31    by  the  State  Board  of  Education in consultation with the
32    State Teacher Certification Board.  The tests shall  be  held
33    not  fewer  than 3 times a year at such time and place as may

 1    be designated by the State Board of Education in consultation
 2    with the State Teacher Certification Board.
 3        (b)  Except as provided in Section 34-6,  the  provisions
 4    of  subsection (a) of this Section shall apply equally in any
 5    school district subject to  Article  34,  provided  that  the
 6    State  Board  of Education shall determine which certificates
 7    issued under Sections 34-8.1 and 34-83 prior to July 1,  1988
 8    are comparable to any early childhood certificate, elementary
 9    school   certificate,   special   certificate,   high  school
10    certificate,  school   service   personnel   certificate   or
11    administrative  certificate  issued  under this Article as of
12    July 1, 1988.
13        (c)  A person who holds an early  childhood,  elementary,
14    special,  high school or school service personnel certificate
15    issued under this Article on or at any time  before  July  1,
16    1988,  including  a  person  who  has  been  issued  any such
17    certificate pursuant to Section 21-11.1 or in exchange for  a
18    comparable   certificate  theretofore  issued  under  Section
19    34-8.1 or Section 34-83, shall not be  required  to  take  or
20    pass  the  tests in order to thereafter have such certificate
21    renewed.
22        (d)  The State Board of Education  in  consultation  with
23    the  State  Teacher Certification Board shall conduct a pilot
24    administration of the tests  by  administering  the  test  to
25    students completing teacher education programs in the 1986-87
26    school  year  for  the  purpose of determining the effect and
27    impact of testing candidates for certification.
28        (e)  The rules and regulations developed to implement the
29    required test of basic skills and  subject  matter  knowledge
30    shall  include  the requirements of subsections (a), (b), and
31    (c) and shall include specific  regulations  to  govern  test
32    selection;  test  validation  and  determination of a passing
33    score;   administration   of   the   tests;   frequency    of
34    administration;  applicant  fees;  frequency  of  applicants'

 1    taking  the tests; the years for which a score is valid; and,
 2    waiving certain additional tests for additional  certificates
 3    to  individuals  who  have  satisfactorily passed the test of
 4    basic skills and subject  matter  knowledge  as  required  in
 5    subsection  (a).  The State Board of Education shall provide,
 6    by rule, specific policies  that  assure  uniformity  in  the
 7    difficulty  level  of  each form of the basic skills test and
 8    each subject matter  knowledge  test  from  test-to-test  and
 9    year-to-year.   The State Board of Education shall also set a
10    passing score for the tests.
11        (f)  The State Teacher Certification Board  may  issue  a
12    nonrenewable  temporary  certificate between July 1, 1988 and
13    August 31, 1988 to individuals who have taken  the  tests  of
14    basic  skills and subject matter knowledge prescribed by this
15    Section but have not received such test scores by August  31,
16    1988.   Such  temporary certificates shall expire on December
17    31, 1988.
18        (g)  Beginning January 1, 2000 July 1,  1999,  the  State
19    Board  of  Education,  in consultation with the State Teacher
20    Certification Board, shall implement  and  administer  a  new
21    system   of  certification  for  teachers  in  the  State  of
22    Illinois.  The State Board of Education, in consultation with
23    the State  Teacher  Certification  Board,  shall  design  and
24    implement a system of examinations and various other criteria
25    which  shall  be  required  prior  to the issuance of Initial
26    Teaching Certificates  and  Standard  Teaching  Certificates.
27    These  examinations and indicators shall be based on national
28    professional teaching standards, as determined by  the  State
29    Board  of  Education,  in consultation with the State Teacher
30    Certification Board. The State Board of Education  may  adopt
31    any and all regulations necessary to implement and administer
32    this Section.
33        (h)  The  State  Board  of  Education shall report to the
34    Illinois   General   Assembly   and   the    Governor    with

 1    recommendations  for  further changes and improvements to the
 2    teacher certification system no later than July 1,  1999  and
 3    on an annual basis until July 1, 2001.

 5        (105 ILCS 5/21-1b) (from Ch. 122, par. 21-1b)
 6        Sec.  21-1b.   Subject  endorsement on certificates.  All
 7    certificates initially issued under this Article  after  June
 8    30,  1986,  shall be specifically endorsed by the State Board
 9    of Education for each subject the holder of  the  certificate
10    is  legally  qualified to teach, such endorsements to be made
11    in accordance with standards promulgated by the  State  Board
12    of   Education   in   consultation  with  the  State  Teacher
13    Certification Board.  All certificates which are issued under
14    this Article prior to July 1, 1986 may, by application to the
15    State Board of Education, be specifically endorsed  for  each
16    subject   the   holder   is   legally   qualified  to  teach.
17    Endorsements issued under this Section  shall  not  apply  to
18    substitute  teacher's  certificates issued under Section 21-9
19    of  this  Code.   Each  application  for  endorsement  of  an
20    existing teaching certificate shall be accompanied by  a  $20
21    nonrefundable fee.
22        Commencing July 1, 1999, each application for endorsement
23    of an existing teaching certificate shall be accompanied by a
24    $30  nonrefundable  fee  January  1,  1994, an additional $10
25    shall be charged for each application for endorsement.  There
26    is hereby created a Teacher Certificate Fee Revolving Fund as
27    a special fund within the State Treasury.   The  proceeds  of
28    each  $30  the  additional  $10  fee  shall  be paid into the
29    Teacher Certificate Fee Revolving Fund;  and  the  moneys  in
30    that  Fund  shall  be  appropriated  and  used to provide the
31    technology and other resources necessary for the  timely  and
32    efficient processing of certification requests.

 1        (105 ILCS 5/21-1c) (from Ch. 122, par. 21-1c)
 2        Sec.  21-1c.   Exclusive certificate authority.  Only the
 3    State Board of  Education  and  State  Teacher  Certification
 4    Board, acting in accordance with the applicable provisions of
 5    this Act and the rules, regulations and standards promulgated
 6    thereunder,  shall have the authority to issue or endorse any
 7    certificate required for  teaching,  supervising  or  holding
 8    certificated  employment  in the public schools; and no other
 9    State agency  shall  have  any  power  or  authority  (i)  to
10    establish   or   prescribe   any   qualifications   or  other
11    requirements applicable to the issuance or endorsement of any
12    such certificate, or  (ii)  to  establish  or  prescribe  any
13    licensure  or  equivalent requirement which must be satisfied
14    in order to teach, supervise or hold certificated  employment
15    in  the  public  schools.  This Section does not prohibit the
16    State Board of Education,  in  consultation  with  the  State
17    Teacher  Certification  Board,  from  delegating  to regional
18    superintendents of schools the authority to  grant  temporary
19    employment   authorizations   to   teacher  applicants  whose
20    qualifications have been confirmed  by  the  State  Board  of
21    Education,   in   consultation   with   the   State   Teacher
22    Certification Board.

24        (105 ILCS 5/21-2) (from Ch. 122, par. 21-2)
25        Sec. 21-2.  Grades of certificates.
26        (a)  Until January 1, 2000 July 1, 1999, all certificates
27    issued  under this Article shall be State certificates valid,
28    except as limited in Section 21-1, in every  school  district
29    coming  under the provisions of this Act and shall be limited
30    in time and designated  as  follows:  Provisional  vocational
31    certificate,  temporary  provisional  vocational certificate,
32    early childhood certificate, elementary  school  certificate,
33    special  certificate, high school certificate, school service

 1    personnel    certificate,     administrative     certificate,
 2    provisional  certificate,  and  substitute  certificate.  The
 3    requirement of student teaching  under  close  and  competent
 4    supervision  for  obtaining  a  teaching  certificate  may be
 5    waived  by  the  State  Teacher  Certification   Board   upon
 6    presentation  to  the  Board  by the teacher of evidence of 5
 7    years successful teaching experience on a  valid  certificate
 8    and  graduation  from  a  recognized  institution  of  higher
 9    learning  with  a  bachelor's  degree  with not less than 120
10    semester  hours  and  a  minimum  of  16  semester  hours  in
11    professional education.
12        (b)  Initial Teaching Certificate.  Beginning January  1,
13    2000 July 1, 1999, persons who (1) have completed an approved
14    teacher  preparation  program,  (2)  are  recommended  by  an
15    approved  teacher  preparation program, (3) have successfully
16    completed the  Initial  Teaching  Certification  examinations
17    required  by  the  State Board of Education, and (4) have met
18    all  other  criteria  established  by  the  State  Board   of
19    Education    in   consultation   with   the   State   Teacher
20    Certification Board, shall  be  issued  an  Initial  Teaching
21    Certificate  valid  for  4  years  of teaching, as defined in
22    Section 21-14 of this Code.   Initial  Teaching  Certificates
23    shall   be  issued  for  categories  corresponding  to  Early
24    Childhood, Elementary,  Secondary,  and  Special  K-12,  with
25    special  certification  designations  for  Special Education,
26    Bilingual Education, fundamental  learning  areas  (including
27    Language Arts, Reading, Mathematics, Science, Social Science,
28    Physical  Development  and  Health,  Fine  Arts,  and Foreign
29    Language), and other areas designated by the State  Board  of
30    Education,   in   consultation   with   the   State   Teacher
31    Certification Board.
32        (c)  Standard  Certificate.   Beginning  January  1, 2000
33    July 1, 1999, persons who  (1)  have  completed  4  years  of
34    teaching,  as  defined in Section 21-14 of this Code, with an

 1    Initial Certificate, have successfully completed the Standard
 2    Teaching Certificate examinations, and  have  met  all  other
 3    criteria  established  by  the  State  Board  of Education in
 4    consultation with the State Teacher Certification  Board,  or
 5    (2)  have completed 4 years of teaching on a valid equivalent
 6    certificate in another  State  or  territory  of  the  United
 7    States,  or have completed 4 years of teaching in a nonpublic
 8    Illinois elementary  or  secondary  school  with  an  Initial
 9    Certificate,  and  have met all other criteria established by
10    the State Board of Education, in consultation with the  State
11    Teacher  Certification  Board,  or  (3)  were issued teaching
12    certificates prior to January 1, 2000 July 1,  1999  and  are
13    renewing  those  certificates  after  January 1, 2000 July 1,
14    1999, shall be issued a  Standard  Certificate  valid  for  5
15    years,  which  may be renewed thereafter every 5 years by the
16    State  Teacher  Certification  Board  based   on   proof   of
17    continuing  education  or professional development. Beginning
18    July 1, 2003, persons who have completed 4 years of teaching,
19    as described in clauses (1) and (2) of this  subsection  (c),
20    have successfully completed the Standard Teaching Certificate
21    Examinations,  and have met all other criteria established by
22    the State Board of Education, in consultation with the  State
23    Teacher   Certification   Board,  shall  be  issued  Standard
24    Certificates.  Standard  Certificates  shall  be  issued  for
25    categories  corresponding  to  Early  Childhood,  Elementary,
26    Secondary,  and  Special  K-12,  with  special  certification
27    designations  for  Special  Education,  Bilingual  Education,
28    fundamental learning areas (including Language Arts, Reading,
29    Mathematics,  Science,  Social  Science, Physical Development
30    and Health, Fine Arts, and Foreign Language), and other areas
31    designated by the State Board of Education,  in  consultation
32    with the State Teacher Certification Board.
33        (d)  Master  Certificate.  Beginning January 1, 2000 July
34    1, 1999, persons  who  have  successfully  achieved  National

 1    Board   certification   through   the   National   Board  for
 2    Professional Teaching Standards  shall  be  issued  a  Master
 3    Certificate,  valid  for  10 7 years and renewable thereafter
 4    every 10 7 years through  compliance  with  requirements  set
 5    forth  by  the State Board of Education, in consultation with
 6    the State Teacher Certification Board.

 9        (105 ILCS 5/21-2.1) (from Ch. 122, par. 21-2.1)
10        Sec. 21-2.1.  Early childhood certificate.
11        (a)  An  early childhood certificate shall be valid for 4
12    years for teaching children up to 6 years of  age,  exclusive
13    of  children enrolled in kindergarten, in facilities approved
14    by the State Superintendent of Education.  Beginning July  1,
15    1988,  such  certificate  shall  be  valid  for  4  years for
16    Teaching children through grade 3 in facilities  approved  by
17    the  State  Superintendent  of  Education.   Subject  to  the
18    provisions  of  Section  21-1a, it shall be issued to persons
19    who have graduated from a recognized  institution  of  higher
20    learning with a bachelor's degree and with not fewer than 120
21    semester  hours  including  professional  education  or human
22    development or, until July 1, 1992, to persons who have early
23    childhood  education  instruction  and  practical  experience
24    involving supervised work with children under 6 years of  age
25    or  with  children  through  grade  3.  Such persons shall be
26    recommended  for  the  early  childhood  certificate   by   a
27    recognized   institution  as  having  completed  an  approved
28    program of preparation which includes the requisite hours and
29    academic and professional courses  and  practical  experience
30    approved   by   the  State  Superintendent  of  Education  in
31    consultation with the State Teacher Certification Board.
32        (b)  Beginning January 1, 2000 July 1, 1999, Initial  and
33    Standard  Early  Childhood  Education  Certificates  shall be

 1    issued to persons who meet the criteria  established  by  the
 2    State Board of Education.

 4        (105 ILCS 5/21-3) (from Ch. 122, par. 21-3)
 5        Sec. 21-3.  Elementary certificate.
 6        (a)  An  elementary school certificate shall be valid for
 7    4 years for teaching in the kindergarten and lower  9  grades
 8    of  the common schools.  Subject to the provisions of Section
 9    21-1a, it shall be issued to persons who have graduated  from
10    a recognized institution of higher learning with a bachelor's
11    degree  and with not fewer than 120 semester hours and with a
12    minimum of  16  semester  hours  in  professional  education,
13    including   5   semester  hours  in  student  teaching  under
14    competent  and  close  supervision.  Such  persons  shall  be
15    recommended for the elementary certificate  by  a  recognized
16    institution  as  having  completed  an  approved  program  of
17    preparation  which  includes intensive preservice training in
18    the  humanities,  natural  sciences,  mathematics   and   the
19    academic  and  professional  courses  approved  by  the State
20    Superintendent of Education in consultation  with  the  State
21    Teacher Certification Board.
22        (b)  Beginning  January 1, 2000 July 1, 1999, Initial and
23    Standard Elementary Certificates shall be issued  to  persons
24    who  meet  all of the criteria established by the State Board
25    of Education for elementary education.

27        (105 ILCS 5/21-4) (from Ch. 122, par. 21-4)
28        Sec. 21-4.  Special certificate.
29        (a)  A special certificate shall be valid for 4 years for
30    teaching the special subjects named therein in all grades  of
31    the  common  schools.  Subject  to  the provisions of Section
32    21-1a, it shall be issued to persons who have graduated  from

 1    a recognized institution of higher learning with a bachelor's
 2    degree and with not fewer than 120 semester hours including a
 3    minimum  of 16 semester hours in professional education, 5 of
 4    which shall be in student teaching under competent and  close
 5    supervision. When the holder of such certificate has earned a
 6    master's  degree,  including eight semester hours of graduate
 7    professional  education  from  a  recognized  institution  of
 8    higher learning and with two years' teaching  experience,  it
 9    may be endorsed for supervision.
10        Such   persons  shall  be  recommended  for  the  special
11    certificate by a recognized institution as  having  completed
12    an  approved  program  of preparation which includes academic
13    and professional courses approved by the State Superintendent
14    of  Education  in  consultation  with   the   State   Teacher
15    Certification Board.
16        (b)  Those   persons   holding  special  certificates  on
17    January 1, 2000 July 1, 1999 shall be eligible for one of the
18    following:
19             (1)  The  issuance  of   Standard   Elementary   and
20        Standard  Secondary Certificates with appropriate special
21        certification designations as  determined  by  the  State
22        Board  of  Education,  in  consultation  with  the  State
23        Teacher  Certification  Board,  and consistent with rules
24        adopted  by  the  State  Board   of   Education.    These
25        certificates  shall  be renewed as provided in subsection
26        (c) of Section 21-2.
27             (2)  The   issuance   of   Standard   Special   K-12
28        Certificates  with  appropriate   special   certification
29        designations,  which  shall  be  renewed  as  provided in
30        subsection (c) of Section 21-2.  These certificates shall
31        not be eligible for additional certification designations

33        consultation with the State Teacher Certification Board.

13        Sec. 21-5.  High school certificate.
14        (a)  A high school certificate shall be valid for 4 years
15    for  teaching  in  grades  6  to  12  inclusive of the common
16    schools. Subject to the provisions of Section 21-1a, it shall
17    be issued to persons who have  graduated  from  a  recognized
18    institution  of  higher learning with a bachelor's degree and
19    with not fewer than 120 semester hours including 16  semester
20    hours  in  professional  education,  5  of  which shall be in
21    student teaching under competent and  close  supervision  and
22    with  one  or  more  teaching  fields.  Such persons shall be
23    recommended for the high school certificate by  a  recognized
24    institution  as  having  completed  an  approved  program  of
25    preparation  which  includes  the  academic  and professional
26    courses approved by the State Superintendent of Education  in
27    consultation with the State Teacher Certification Board.
28        (b)  Beginning  January 1, 2000 July 1, 1999, Initial and
29    Standard Secondary Certificates shall be  issued  to  persons
30    who  meet  all of the criteria established by the State Board
31    of Education for secondary education.

 2        Sec. 21-7.1.  Administrative certificate.
 3        (a)  After   July   1,   1999   January   1,   1986,   an
 4    administrative certificate valid for 5 years  of  supervising
 5    and  administering in the public common schools may be issued
 6    to persons who have graduated from  a  regionally  accredited
 7    recognized  institution  of  higher  learning with a master's
 8    degree  and  who  have  been  recommended  certified   by   a
 9    recognized  institution these institutions of higher learning
10    as having completed a program of preparation for one or  more
11    of   these   endorsements.  Such  programs  of  academic  and
12    professional preparation required for  endorsement  shall  be
13    administered  by the institution in accordance with standards
14    set  forth  by  the  State  Superintendent  of  Education  in
15    consultation with the State Teacher Certification Board.
16        (b)  No administrative certificate shall  be  issued  for
17    the  first  time  after  June  30,  1987  and  no endorsement
18    provided for by this Section shall be made or affixed  to  an
19    administrative  certificate for the first time after June 30,
20    1987  unless  the  person   to   whom   such   administrative
21    certificate  is  to  be  issued  or  to  whose administrative
22    certificate such  endorsement  is  to  be  affixed  has  been
23    required to demonstrate as a part of a program of academic or
24    professional    preparation   for   such   certification   or
25    endorsement: (i) an understanding of the knowledge called for
26    in establishing productive parent-school relationships and of
27    the  procedures  fostering   the   involvement   which   such
28    relationships  demand;  and  (ii)  an  understanding  of  the
29    knowledge  required  for  establishing  a high quality school
30    climate  and  promoting  good  classroom   organization   and
31    management,  including  rules  of  conduct  and instructional
32    procedures  appropriate  to  accomplishing   the   tasks   of
33    schooling;  and  (iii)  a  demonstration of the knowledge and
34    skills called for in providing instructional leadership.  The

 1    standards  for  demonstrating  an   understanding   of   such
 2    knowledge  shall be set forth by the State Board of Education
 3    in consultation with the State Teacher  Certification  Board,
 4    and  shall  be administered by the recognized institutions of
 5    higher learning as part  of  the  programs  of  academic  and
 6    professional   preparation  required  for  certification  and
 7    endorsement under this Section.  As used in this  subsection:
 8    "establishing  productive  parent-school relationships" means
 9    the  ability  to  maintain  effective  communication  between
10    parents  and  school   personnel,   to   encourage   parental
11    involvement in schooling, and to motivate school personnel to
12    engage  parents in encouraging student achievement, including
13    the development of  programs  and  policies  which  serve  to
14    accomplish  this  purpose;  and  "establishing a high quality
15    school  climate"  means  the  ability  to  promote   academic
16    achievement,  to  maintain discipline, to recognize substance
17    abuse problems among students  and  utilize  appropriate  law
18    enforcement  and  other  community resources to address these
19    problems, to support teachers and students in their education
20    endeavors, to establish learning objectives  and  to  provide
21    instructional   leadership,   including  the  development  of
22    policies and programs which serve to accomplish this purpose;
23    and "providing instructional leadership" means the ability to
24    effectively evaluate school  personnel,  to  possess  general
25    communication  and interpersonal skills, and to establish and
26    maintain appropriate classroom  learning  environments.   The
27    provisions  of  this  subsection shall not apply to or affect
28    the initial issuance or making on or before June 30, 1987  of
29    any  administrative  certificate  or endorsement provided for
30    under this Section, nor shall such  provisions  apply  to  or
31    affect   the   renewal  after  June  30,  1987  of  any  such
32    certificate or endorsement initially issued  or  made  on  or
33    before June 30, 1987.
34        (c)  Administrative  certificates  shall be renewed every

 1    five years with the first renewal being five years  following
 2    the initial receipt of an administrative certificate. Renewal
 3    requirements   for  administrators  whose  positions  require
 4    certification shall be  based  upon  evidence  of  continuing
 5    professional  education  which  promotes the following goals:
 6    (1)  Improving  administrators'  knowledge  of  instructional
 7    practices and administrative procedures; (2) Maintaining  the
 8    basic level of competence required for initial certification;
 9    and  (3)  Improving  the  mastery  of  skills  and  knowledge
10    regarding the improvement of teaching performance in clinical
11    settings  and assessment of the levels of student performance
12    in  their  schools.    Evidence  of  continuing  professional
13    education must include verification of biennial attendance in
14    a program developed by the Illinois  Administrators'  Academy
15    and verification of annual participation in a school district
16    approved    activity    which   contributes   to   continuing
17    professional education.  The State  Board  of  Education,  in
18    consultation  with  the  State  Teacher  Certification Board,
19    shall develop procedures for implementing  this  Section  and
20    shall  administer the renewal of administrative certificates.
21    Failure  to  submit  satisfactory  evidence   of   continuing
22    professional  education  which  contributes  to promoting the
23    goals  of  this  Section  shall   result   in   a   loss   of
24    administrative certification.
25        (d)  Any  limited  or life supervisory certificate issued
26    prior to July 1, 1968 shall continue  to  be  valid  for  all
27    administrative   and  supervisory  positions  in  the  public
28    schools for which it is valid as of that date as long as  its
29    holder  meets the requirements for registration or renewal as
30    set forth in the statutes or until revoked according to law.
31        (e)  The  administrative  or  supervisory  positions  for
32    which the certificate shall be valid shall be  determined  by
33    one  or  more of 3 endorsements: general supervisory, general
34    administrative and superintendent.

 1        Subject to the provisions of Section 21-1a,  endorsements
 2    shall  be  made  under  conditions set forth in this Section.
 3    The State Board of Education shall, in consultation with  the
 4    State  Teacher  Certification  Board, adopt rules pursuant to
 5    the  Illinois  Administrative  Procedure  Act,   establishing
 6    requirements  for obtaining administrative certificates where
 7    the  minimum  administrative  or   supervisory   requirements
 8    surpass those set forth in this Section.
 9        The State Teacher Certification Board shall file with the
10    State  Board  of  Education  a  written  recommendation  when
11    considering    additional   administrative   or   supervisory
12    requirements.  All additional  requirements  shall  be  based
13    upon the requisite knowledge necessary to perform those tasks
14    required  by  the  certificate.  The State Board of Education
15    shall in consultation with the  State  Teacher  Certification
16    Board,  establish  standards  within  its  rules  which shall
17    include the academic and professional requirements  necessary
18    for  certification.   These  standards  shall  at  a  minimum
19    contain, but not be limited to, those used by the State Board
20    of Education in determining whether additional knowledge will
21    be  required.   Additionally,  the  State  Board of Education
22    shall in consultation with the  State  Teacher  Certification
23    Board,  establish  provisions  within  its  rules whereby any
24    member of the educational community or the public may file  a
25    formal    written   recommendation   or   inquiry   regarding
26    requirements.
27             (1)  Until July 1,  2003,  the  general  supervisory
28        endorsement   shall  be  affixed  to  the  administrative
29        certificate of any holder who has at  least  16  semester
30        hours   of  graduate  credit  in  professional  education
31        including  8  semester  hours  of  graduate   credit   in
32        curriculum  and  research and who has at least 2 years of
33        full-time teaching experience or school service personnel
34        experience  in  public   schools,   schools   under   the

 1        supervision  of  the  Department  of Corrections, schools
 2        under   the   administration   of   the   Department   of
 3        Rehabilitation Services, or nonpublic schools meeting the
 4        standards established  by  the  State  Superintendent  of
 5        Education    or   comparable   out-of-state   recognition
 6        standards  approved  by  the  State   Superintendent   of
 7        Education.
 8             Such  endorsement shall be required for supervisors,
 9        curriculum directors and for  such  similar  and  related
10        positions  as  determined  by the State Superintendent of
11        Education  in  consultation  with   the   State   Teacher
12        Certification Board.
13             (2)  The general administrative endorsement shall be
14        affixed  to  the administrative certificate of any holder
15        who has at least 20 semester hours of graduate credit  in
16        educational administration and supervision and who has at
17        least  2 years of full-time teaching experience or school
18        service personnel experience in public  schools,  schools
19        under  the  supervision of the Department of Corrections,
20        schools under the administration  of  the  Department  of
21        Rehabilitation Services, or nonpublic schools meeting the
22        standards  established  by  the  State  Superintendent of
23        Education   or   comparable   out-of-state    recognition
24        standards   approved   by  the  State  Superintendent  of
25        Education.
26             Such endorsement shall be  required  for  principal,
27        assistant     principal,     assistant    or    associate
28        superintendent, junior college dean and  for  related  or
29        similar    positions   as   determined   by   the   State
30        Superintendent of  Education  in  consultation  with  the
31        State Teacher Certification Board.
32             Notwithstanding  any  other  provisions of this Act,
33        after January 1, 1990 and  until  January  1,  1991,  any
34        teacher  employed  by  a  district  subject to Article 34

 1        shall  be   entitled   to   receive   an   administrative
 2        certificate  with  a  general  administrative endorsement
 3        affixed thereto if he or she: (i) had at least 3 years of
 4        experience as a certified teacher for such district prior
 5        to August 1, 1985; (ii) obtained a Master's degree  prior
 6        to  August  1, 1985; (iii) completed at least 20 hours of
 7        graduate credit in education courses (including at  least
 8        12  hours  in educational administration and supervision)
 9        prior to September 1,  1987;  and  (iv)  has  received  a
10        rating of superior for at least each of the last 5 years.
11        Any person who obtains an administrative certificate with
12        a  general  administrative  endorsement  affixed  thereto
13        under  this  paragraph shall not be qualified to serve in
14        any administrative position except assistant principal.
15             (3)  The chief school business official  endorsement
16        shall be affixed to the administrative certificate of any
17        holder  who  qualifies  by  having a Master's degree, two
18        years of administrative  experience  in  school  business
19        management,  and  a  minimum  of  20  semester  hours  of
20        graduate  credit  in  a  program established by the State
21        Superintendent of  Education  in  consultation  with  the
22        State  Teacher Certification Board for the preparation of
23        school business administrators.  Such  endorsement  shall
24        also  be affixed to the administrative certificate of any
25        holder who qualifies  by  having  a  Master's  Degree  in
26        Business  Administration,  Finance  or  Accounting from a
27        regionally accredited institution of higher education.
28             After June  30,  1977,  such  endorsement  shall  be
29        required  for  any  individual  first employed as a chief
30        school business official.
31        (4)  The superintendent endorsement shall be  affixed  to
32    the   administrative   certificate  of  any  holder  who  has
33    completed 30 semester hours of  graduate  credit  beyond  the
34    master's   degree   in  a  program  for  the  preparation  of

 1    superintendents of schools including  16  semester  hours  of
 2    graduate  credit  in  professional  education  and who has at
 3    least 2 years experience as an administrator or supervisor in
 4    the public schools  or  the  State  Board  of  Education   or
 5    education service regions or in nonpublic schools meeting the
 6    standards   established   by   the  State  Superintendent  of
 7    Education or comparable  out-of-state  recognition  standards
 8    approved  by  the State Superintendent of Education and holds
 9    general supervisory or general administrative endorsement, or
10    who has  had  2  years  of  experience  as  a  supervisor  or
11    administrator   while   holding   an   all-grade  supervisory
12    certificate or  a  certificate  comparable  in  validity  and
13    educational and experience requirements.
14        After  June  30, 1968, such endorsement shall be required
15    for a superintendent of schools, except as  provided  in  the
16    second paragraph of this Section and in Section 34-6.
17        Any  person  appointed  to the position of superintendent
18    between the effective date of this Act and June 30, 1993 in a
19    school district organized pursuant  to  Article  32  with  an
20    enrollment of at least 20,000 pupils shall be exempt from the
21    provisions of this Subsection (4) until June 30, 1996.
22        (f)  All  official  interpretations or acts of issuing or
23    denying administrative certificates or  endorsements  by  the
24    State Teacher's Certification Board, State Board of Education
25    or the State Superintendent of Education, from the passage of
26    P.A.  81-1208  on November 8, 1979 through September 24, 1981
27    are hereby declared valid and legal acts in all respects  and
28    further  that  the purported repeal of the provisions of this
29    Section by P.A. 81-1208 and P.A. 81-1509 is declared null and
30    void.

33        Sec.  21-9.   Substitute  certificates   and   substitute

 1    teaching.
 2        (a)  A substitute teacher's certificate may be issued for
 3    teaching   in   all  grades  of  the  common  schools.   Such
 4    certificate may be  issued  upon  request  of  the   regional
 5    superintendent of schools of any  region in which the teacher
 6    is to teach.  A substitute teacher's certificate is valid for
 7    teaching   in   the  public  schools  of  any  county.   Such
 8    certificate may be issued to persons who either  (a)  hold  a
 9    certificate    valid  for  teaching  in the common schools as
10    shown on the face of the certificate, (b) hold a bachelor  of
11    arts degree from an institution of higher learning accredited
12    by the North Central Association or other comparable regional
13    accrediting   association  or  have  been  graduated  from  a
14    recognized institution of higher learning with  a  bachelor's
15    degree,  or  (c)  have had 2 years of teaching experience and
16    meet such other rules and regulations as may  be  adopted  by
17    the  State  Board of Education in consultation with the State
18    Teacher Certification Board.  Such certificate  shall  expire
19    on June 30 in the fourth year from date of issue.  Substitute
20    teacher's  certificates  are  not  subject  to endorsement as
21    described in Section 21-1b of this Code.
22        (b)  A teacher holding a substitute teacher's certificate
23    may teach only in the place of a  certified  teacher  who  is
24    under  contract  with  the employing board and may teach only
25    when no appropriate fully certified teacher is  available  to
26    teach  in  a substitute capacity.  A teacher holding an early
27    childhood certificate,  an  elementary  certificate,  a  high
28    school   certificate,  or  a  special  certificate  may  also
29    substitute teach in grades K-12 but only in the  place  of  a
30    certified  teacher  who  is under contract with the employing
31    board.  A substitute teacher may teach only for a period  not
32    to exceed 90 paid school days or 450 paid school hours in any
33    one  school  district  in  any  one  school term.  Where such
34    teaching is partly on a daily and partly on an hourly  basis,

 1    a  school  day  shall  be considered as 5 hours. The teaching
 2    limitations imposed by this subsection upon teachers  holding
 3    substitute   certificates  shall  not  apply  in  any  school
 4    district operating under Article 34.

 7        Sec. 21-11.3.  Resident teacher certificate.  A  resident
 8    teacher certificate shall be valid for 2 years for employment
 9    as a resident teacher in a public school.  It shall be issued
10    only   to  persons  who  have  graduated  from  a  regionally
11    accredited recognized institution of higher education with  a
12    bachelor's   degree,   who  are  enrolled  in  a  program  of
13    preparation approved by the State Superintendent of Education
14    in consultation with the State Teacher  Certification  Board,
15    and  who  have  passed  the  appropriate tests as required in
16    Section 21-1a  and  as  determined  by  the  State  Board  of
17    Education.   A resident teacher certificate may be issued for
18    teaching children through grade 3 or for grades K-9, 6-12, or
19    K-12 in a special subject area and  may  not  be  renewed.  A
20    resident teacher may teach only in conjunction with and under
21    the  direction  of a certified teacher and shall not teach in
22    place of a certified teacher.

24        (105 ILCS 5/21-11.4)
25        Sec. 21-11.4.  Illinois Teacher Corps.
26        (a)  The General Assembly finds and determines  that  (i)
27    it   is   important  to  encourage  the  entry  of  qualified
28    professionals into elementary and  secondary  teaching  as  a
29    second career; and (ii) there are a number of individuals who
30    have bachelors' degrees, experience in the work force, and an
31    interest  in serving youth that creates a special talent pool
32    with great potential for  enriching  the  lives  of  Illinois

 1    children  as  teachers.  To provide this talent pool with the
 2    opportunity to serve children as teachers, school  districts,
 3    colleges,  and  universities  are  encouraged, as part of the
 4    public policy of this  State,  to  enter  into  collaborative
 5    programs   to   educate   and  induct  these  non-traditional
 6    candidates into the teaching profession.  To  facilitate  the
 7    certification   of   such  candidates,  the  State  Board  of
 8    Education,   in   consultation   with   the   State   Teacher
 9    Certification Board,  shall  assist  institutions  of  higher
10    education and school districts with the implementation of the
11    Illinois Teacher Corps.
12        (b)  Individuals  who  wish  to become candidates for the
13    Illinois Teacher Corps program must earn a  resident  teacher
14    certificate as defined in Section 21-11.3, including:
15             (1)  graduation   from   a   regionally   accredited
16        recognized   institution   of  higher  education  with  a
17        bachelor's degree and at least a 3.00 out of a 4.00 grade
18        point average;
19             (2)  a minimum of 5 years of professional experience
20        in the area the candidate wishes to teach;
21             (3)  passing the examinations required by the  State
22        Board of Education;
23             (4)  enrollment  in  a  Masters  of Education Degree
24        program approved by the State Superintendent of Education
25        in consultation  with  the  State  Teacher  Certification
26        Board; and
27             (5)  completion of a 6 week summer intensive teacher
28        preparation  course  which  is the first component of the
29        Masters Degree program.
30        (c)  School districts may hire an Illinois Teacher  Corps
31    candidate  after  the  candidate  has  received  his  or  her
32    resident  teacher  certificate.   The school district has the
33    responsibility of ensuring that the  candidates  receive  the
34    supports   necessary   to  become  qualified,  competent  and

 1    productive teachers.  To be eligible to  participate  in  the
 2    Illinois Teacher Corps program, school districts must provide
 3    a minimum of the following supports to the candidates:
 4             (1)  a  salary  and  benefits  package as negotiated
 5        through the teacher contracts;
 6             (2)  a mentor certified  teacher  who  will  provide
 7        guidance  to  one  or  more  candidates  under  a program
 8        developed collaboratively  by  the  school  district  and
 9        university;
10             (3)  at  least  quarterly  evaluations  performed of
11        each candidate jointly by  the  mentor  teacher  and  the
12        principal of the school or the principal's designee; and
13             (4)  a  written  and signed document from the school
14        district outlining the support the  district  intends  to
15        provide  to  the  candidates,  for  approval by the State
16        Teacher Certification Board.
17        (d)  Illinois institutions of higher education shall work
18    collaboratively with school districts and the  State  Teacher
19    Certification  Board  to  academically prepare the candidates
20    for the teaching profession.  To be eligible to  participate,
21    the  College  or  School  of  Education  of  a  participating
22    Illinois  institution  of  higher  education  must  develop a
23    curriculum that provides, upon completion, a  Masters  Degree
24    in  Education for the candidates.  The Masters Degree program
25    must:
26             (1)  receive  approval  from   the   State   Teacher
27        Certification Board; and
28             (2)  take  no  longer  than 3 summers and 2 academic
29        years  to  complete,  and  balance  the  needs  and  time
30        constraints of the candidates.
31        (e)  Upon successful completion  of  the  Masters  Degree
32    program,   the   candidate    receives  an  Initial  Teaching
33    Certificate in the State of Illinois.
34        (f)  If an individual wishes to become a candidate in the

 1    Illinois Teacher Corps program, but does not possess 5  years
 2    of  professional  experience,  the individual may qualify for
 3    the  program  by  participating  in  a  one  year  internship
 4    teacher preparation program with a school district.  The  one
 5    year  internship  shall  be  developed collaboratively by the
 6    school  district  and  the  Illinois  institution  of  higher
 7    education,  and  shall  be  approved  by  the  State  Teacher
 8    Certification Board.
 9        (g)  The State Board of Education is authorized to  award
10    grants  to  school  districts that seek to prepare candidates
11    for the teaching profession who have bachelors'  degrees  and
12    professional work experience in subjects relevant to teaching
13    fields,  but who do not have formal preparation for teaching.
14    Grants may be made to school districts for up to  $3,000  per
15    candidate  when  the  school  district, in cooperation with a
16    public  or  private  university  and  the  school  district's
17    teacher  bargaining  unit,  develop  a  program  designed  to
18    prepare teachers  pursuant  to  the  Illinois  Teacher  Corps
19    program under this Section.

22        Sec.  21-12.  Printing;  of Seal; Signature; Credentials.
23    All certificates shall be printed by and bear the seal of the
24    State Teacher Certification Board and the signatures  of  the
25    chairman   and   of   the  secretary  of  the  State  Teacher
26    Certification Board board.  Each certificate shall  show  the
27    integrally  printed  seal  of the State Teacher Certification
28    Board.  All college credentials offered as  the  basis  of  a
29    certificate  shall be presented to the secretary of the State
30    Teacher Certification  Board  for  inspection  and  approval.
31    After  January 1, 1964, each application for a certificate or
32    evaluation  of  credentials  shall  be  accompanied   by   an
33    evaluation fee of $20 which is not refundable.

 1        Commencing   July   1,   1999,  each  application  for  a
 2    certificate or evaluation of credentials shall be accompanied
 3    by  an  evaluation  fee  of  $30   payable   to   the   State
 4    Superintendent  of  Education, January 1, 1994, an additional
 5    $10 shall be charged for each application for  a  certificate
 6    or  evaluation of credentials which is not refundable, except
 7    that no application or evaluation fee shall be required for a
 8    Master Certificate  issued  pursuant  to  subsection  (d)  of
 9    Section 21-2 of this Code.  There is hereby created a Teacher
10    Certificate  Fee  Revolving Fund as a special fund within the
11    State Treasury.  The proceeds of each $30 the additional  $10
12    fee  shall be paid into the Teacher Certificate Fee Revolving
13    Fund, created under Section  21-1b  of  this  Code;  and  the
14    moneys in that Fund shall be appropriated and used to provide
15    the  technology  and other resources necessary for the timely
16    and efficient processing of certification requests.
17        When evaluation verifies the  requirements  for  a  valid
18    certificate,  the  applicant  shall  be issued an entitlement
19    card that may be presented to a  regional  superintendent  of
20    schools  together  with a fee of one dollar for issuance of a
21    certificate.
22        The applicant shall be notified of any deficiencies.

25        Sec. 21-14. Registration and renewal of certificates.
26        (a)  A limited four-year  certificate  or  a  certificate
27    issued  after  July  1,  1955,  shall  be  renewable  at  its
28    expiration  or  within  60  days  thereafter  by  the  county
29    superintendent of schools having supervision and control over
30    the  school  where  the  teacher  is  teaching upon certified
31    evidence of meeting the requirements for renewal as  required
32    by this Act and prescribed by the State Board of Education in
33    consultation  with the State Teacher Certification Board.  An

 1    elementary supervisory certificate shall not  be  renewed  at
 2    the  end  of  the  first  four-year  period  covered  by  the
 3    certificate  unless  the  holder  thereof has filed certified
 4    evidence with the State Teacher Certification Board  that  he
 5    has  a master's degree or that he has earned 8 semester hours
 6    of credit in the  field  of  educational  administration  and
 7    supervision  in  a recognized institution of higher learning.
 8    The holder shall continue to earn 8 semester hours of  credit
 9    each  four-year  period  until  such  time as he has earned a
10    master's degree.
11        All certificates not  renewed  or  registered  as  herein
12    provided  shall  lapse  after  a period of 5 4 years from the
13    expiration  of  the  last   year   of   registration.    Such
14    certificates  may  be  reinstated  for a one year period upon
15    payment  of  all   accumulated   registration   fees.    Such
16    reinstated certificates shall only be renewed: (1) by earning
17    5  semester  hours  of  credit in a recognized institution of
18    higher learning in the field of professional education or  in
19    courses  related to the holder's contractual teaching duties;
20    or (2) by presenting evidence  of  holding  a  valid  regular
21    certificate  of  some  other  type.   Any  certificate may be
22    voluntarily  surrendered  by  the  certificate   holder.    A
23    voluntarily  surrendered  certificate  shall  be treated as a
24    revoked certificate.
25        (b)  When  those  teaching  certificates  issued   before
26    January  1,  2000 July 1, 1999 are renewed for the first time
27    after January  1,  2000  July  1,  1999,  all  such  teaching
28    certificates   shall   be  exchanged  for  Standard  Teaching
29    Certificates as provided in subsection (c) of  Section  21-2.
30    All  Initial  and  Standard  Teaching Certificates, including
31    those  issued  to  persons  who  previously   held   teaching
32    certificates  issued  before  January  1,  2000 July 1, 1999,
33    shall be renewable under the conditions  set  forth  in  this
34    subsection (b).

 1        Initial  Teaching  Certificates  are nonrenewable and are
 2    valid  for  4  years  of   teaching.      Standard   Teaching
 3    Certificates  are  renewable  every  5  years  as provided in
 4    subsection (c) of Section 21-2 and  subsection  (c)  of  this
 5    Section.  For purposes of this Section, "teaching" is defined
 6    as  employment  and  performance  of  services in an Illinois
 7    public or State-operated elementary school, secondary school,
 8    or cooperative or joint agreement with a  governing  body  or
 9    board  of  control, in a certificated teaching position, or a
10    charter school  operating  in  compliance  with  the  Charter
11    Schools Law.
12        (c)  In compliance with subsection (c) of Section 21-2 of
13    this   Code,   which   provides   that  a  Standard  Teaching
14    Certificate may be renewed by the State Teacher Certification
15    Board   based   upon   proof   of   continuing   professional
16    development, the State  Board  of  Education  and  the  State
17    Teacher Certification Board shall jointly:
18             (1)  establish  a  procedure  for  renewing Standard
19        Teaching Certificates, which shall  include  but  not  be
20        limited  to  annual timelines for the renewal process and
21        the components set forth in subsections (d)  through  (k)
22        of this Section;
23             (2)  establish   the   standards   for   certificate
24        renewal;
25             (3)  approve    the    providers    of    continuing
26        professional development activities;
27             (4)  determine  the maximum credit for each category
28        of continuing professional development activities;
29             (5)  designate the type and amount of  documentation
30        required to show that continuing professional development
31        activities have been completed; and
32             (6)  provide,  on  a  timely  basis  to all Illinois
33        teachers, certificate holders,  regional  superintendents
34        of schools, school districts, and others with an interest

 1        in continuing professional development, information about
 2        the  standards  and  requirements established pursuant to
 3        this subsection (c).
 4        (d)  Any  Standard  Teaching  Certificate  held   by   an
 5    individual  employed  and  performing services in an Illinois
 6    public or State-operated elementary school, secondary school,
 7    or cooperative or joint agreement with a  governing  body  or
 8    board  of  control  in  a certificated teaching position or a
 9    charter school in compliance with  the  Charter  Schools  Law
10    must  be  maintained  Valid  and  Active  through certificate
11    renewal  activities  specified  in  the  certificate  renewal
12    procedure established pursuant  to  subsection  (c)  of  this
13    Section,  provided  that  a  holder  of  a  Valid  and Active
14    certificate who is only employed on either a part-time  basis
15    or  day-to-day  basis  as a substitute teacher shall pay only
16    the required registration fee to renew his or her certificate
17    and keep it valid.  All other Standard Teaching  Certificates
18    held  may  be  maintained  as  Valid but Inactive through the
19    registration process provided for in the certificate  renewal
20    procedure  established  pursuant  to  subsection  (c) of this
21    Section.   A  Valid  but   Inactive   certificate   must   be
22    immediately  activated,  through procedures developed jointly
23    by the  State  Board  of  Education  and  the  State  Teacher
24    Certification  Board,  upon  the  certificate holder becoming
25    employed and performing services in  an  Illinois  public  or
26    State-operated   elementary   school,  secondary  school,  or
27    cooperative or joint agreement with a governing body or board
28    of control in a certificated teaching position or  a  charter
29    school  operating in compliance with the Charter Schools Law.
30    A holder of a Valid but Inactive certificate may activate his
31    or her certificate through procedures  provided  for  in  the
32    certificate   renewal   procedure   established  pursuant  to
33    subsection (c) of this Section.
34        (e)(1)  A Standard Teaching  Certificate  that  has  been

 1    maintained  as  Valid  and  Active  for  the  5  years of the
 2    certificate's validity shall be renewed as Valid  and  Active
 3    upon  the  certificate  holder:  (i)  completing  at  least 8
 4    semester hours of coursework as described in subdivision  (A)
 5    of  paragraph  (3)  of  this  subsection (e); (ii) earning at
 6    least  24  continuing  education  units   as   described   in
 7    subdivision  (B)  of  paragraph  (3)  of this subsection (e);
 8    (iii) completing the National Board for Professional Teaching
 9    Standards  process  as  described  in  subdivision   (C)   of
10    paragraph  (3)  of  this  subsection (e); or (iv) earning 120
11    continuing  professional  development   units   ("CPDU")   as
12    described  in  subdivision  (D)  of  paragraph  (3)  of  this
13    subsection   (e).    The   maximum   continuing  professional
14    development   units   for   each   continuing    professional
15    development  activity  identified in subdivisions (E) through
16    (I) of paragraph (3) of this subsection (e) shall be  jointly
17    determined  by  the  State  Board  of Education and the State
18    Teacher Certification Board.  If,  however,  the  certificate
19    holder  has  maintained the certificate as Valid but Inactive
20    for a portion of the 5-year period of validity, the number of
21    continuing professional development units needed to renew the
22    certificate as Valid  and  Active  shall  be  proportionately
23    reduced  by  the amount of time the certificate was Valid but
24    Inactive. Furthermore, if a certificate  holder  is  employed
25    and  performs  teaching services on a part-time basis for all
26    or a portion of the certificate's 5-year period of  validity,
27    the  number  of  continuing  professional  development  units
28    needed  to renew the certificate as Valid and Active shall be
29    reduced by 50% for the amount of time the certificate  holder
30    has  been  employed  and  performed  teaching  services  on a
31    part-time basis.  Part-time shall be defined as less than 50%
32    of the school day or school term.
33        (2)  Each Valid and Active Standard Teaching  Certificate
34    holder   shall   develop   a  certificate  renewal  plan  for

 1    satisfying   the    continuing    professional    development
 2    requirement provided for in subsection (c) of Section 21-2 of
 3    this  Code.    Certificate holders with multiple certificates
 4    shall develop a certificate renewal plan that addresses  only
 5    that  certificate  or those certificates that are required of
 6    his or her certificated teaching position, if the certificate
 7    holder is employed and performing  services  in  an  Illinois
 8    public or State-operated elementary school, secondary school,
 9    or  cooperative  or  joint agreement with a governing body or
10    board of control, or that certificate or  those  certificates
11    most  closely related to his or her teaching position, if the
12    certificate holder is employed in a charter  school.   Except
13    as  otherwise  provided in this subsection (e), a certificate
14    renewal  plan  shall  include  a  minimum  of  3   individual
15    improvement  goals  developed  by  the certificate holder and
16    shall reflect purposes (A), (B),  and  (C)  and  may  reflect
17    purpose   (D)   of   the  following  continuing  professional
18    development purposes:
19             (A)  Advance both the certificate holder's knowledge
20        and skills as a teacher (including pedagogy and classroom
21        management)  in  the  certificate   holder's   areas   of
22        certification, endorsement, or teaching assignment.
23             (B)  Develop  the certificate holder's knowledge and
24        skills  in  areas  determined  to  be  critical  for  all
25        Illinois teachers, as  defined  by  the  State  Board  of
26        Education, known as "State priorities".
27             (C)  Address the knowledge, skills, and goals of the
28        certificate  holder's  local  school improvement plan, if
29        the  teacher  is  employed  in  an  Illinois  public   or
30        State-operated  elementary  school,  secondary school, or
31        cooperative or joint agreement with a governing  body  or
32        board of control.
33             (D)  Expand  knowledge  and  skills in an additional
34        teaching field  or  toward  the  acquisition  of  another

 1        teaching  certificate, endorsement, or relevant education
 2        degree.
 3    A certificate renewal plan must include a description of  how
 4    these goals are to be achieved and an explanation of selected
 5    continuing   professional   development   activities   to  be
 6    completed, each of  which  must  meet  one  or  more  of  the
 7    continuing  professional  development  purposes  specified in
 8    this  paragraph  (2).   The  plan  shall  identify  potential
 9    activities  and  include  projected   timelines   for   those
10    activities that will assure completion of the plan before the
11    expiration  of  the  5-year validity of the Standard Teaching
12    Certificate.  Except as otherwise provided in this subsection
13    (e), at least  50%  of  continuing  professional  development
14    units  must  relate to purposes (A) and (B) set forth in this
15    paragraph (2): the  advancement  of  a  certificate  holder's
16    knowledge  and  skills  as  a teacher (including pedagogy and
17    classroom management) in the certificate  holder's  areas  of
18    certification,  endorsement,  or  teaching assignment and the
19    development of a certificate holder's knowledge and skills in
20    the State priorities that exist at the time  the  certificate
21    renewal plan is developed.
22        (3)  Continuing   professional   development   activities
23    included  in  a certificate renewal plan may include, but are
24    not limited to, the following activities:
25             (A)  at least 8 semester hours of coursework  in  an
26        approved education-related program, of which at least 20%
27        of  these  hours  relate  to  the continuing professional
28        development purpose set forth in purpose (A) of paragraph
29        (2) of this subsection (e), provided  that  such  a  plan
30        need   not  include  any  other  continuing  professional
31        development activities nor reflect or contain  activities
32        related  to the other continuing professional development
33        purposes set forth in paragraph (2)  of  this  subsection
34        (e);

 1             (B)  continuing  education  units  that  satisfy the
 2        continuing professional development purposes set forth in
 3        paragraph (2) of this  subsection  (e),  with  each  unit
 4        equal  to  5  clock  hours,  provided  that  a  plan that
 5        includes at least 24 continuing education units  (or  120
 6        clock/contact   hours)   need   not   include  any  other
 7        continuing professional development activities;
 8             (C)  completion   of   the   National    Board    of
 9        Professional   Teaching   Standards   ("NBPTS")  process,
10        provided that a plan  that  includes  completion  of  the
11        NBPTS  process  need  not  include  any  other continuing
12        professional  development  activities  nor   reflect   or
13        contain activities related to the continuing professional
14        development  purposes  set  forth  in  paragraph  (2)  of
15        subsection (e) of this Section;
16             (D)  completion   of   120  continuing  professional
17        development   units   that   satisfy    the    continuing
18        professional  development purposes set forth in paragraph
19        (2) of  this  subsection  (e)  and  may  include  without
20        limitation  the activities identified in subdivisions (E)
21        through (I) of this paragraph (3);
22             (E)  collaboration   and   partnership    activities
23        related  to  improving the teacher's knowledge and skills
24        as a teacher, including the following:
25                  (i)  participating  on  collaborative  planning
26             and professional improvement teams and committees;
27                  (ii)  peer coaching;
28                  (iii)  peer reviewing;
29                  (iv)  mentoring in a formal mentoring  program,
30             including    service   as   a   consulting   teacher
31             participating in a  remediation  process  formulated
32             under Section 24A-5 of this Code;
33                  (v)  participating  in site-based management or
34             decision making teams, relevant committees,  boards,

 1             or   task   forces   directly   related   to  school
 2             improvement plans;
 3                  (vi)  coordinating   community   resources   in
 4             schools, if the project is a specific  goal  of  the
 5             school improvement plan;
 6                  (vii)  facilitating  parent  education programs
 7             for a school, school district, or regional office of
 8             education directly related to student achievement or
 9             school improvement plans;
10                  (viii)  participating in business,  school,  or
11             community  partnerships  directly related to student
12             achievement or school improvement plans;
13                  (ix)  supervising a student teacher or  teacher
14             education   candidate   in   clinical   supervision,
15             provided  that  the  supervision may only be counted
16             once during the course of 5 years;
17             (F)  college or  university  coursework  related  to
18        improving the teacher's knowledge and skills as a teacher
19        as follows:
20                  (i)  completing   undergraduate   or   graduate
21             credit   earned   from   a   regionally   accredited
22             institution    in   coursework   relevant   to   the
23             certificate  area  being   renewed,   provided   the
24             coursework  meets  Illinois  Teaching  Standards and
25             supports the essential  characteristics  of  quality
26             professional development; or
27                  (ii)  teaching college or university courses in
28             areas   relevant   to  the  certificate  area  being
29             renewed, provided that  the  teaching  may  only  be
30             counted once during the course of 5 years;
31             (G)  conferences,  workshops,  institutes, seminars,
32        and  symposiums  related  to  improving   the   teacher's
33        knowledge   and   skills  as  a  teacher,  including  the
34        following:

 1                  (i)  completing non-university credit  directly
 2             related  to  student achievement, school improvement
 3             plans, or State priorities;
 4                  (ii)  participating   in   or   presenting   at
 5             workshops, seminars,  conferences,  institutes,  and
 6             symposiums;
 7                  (iii)  presenting   at   workshops,   seminars,
 8             conferences, institutes, and symposiums;
 9                  (iv)  training   as   external   reviewers  for
10             Quality Assurance;
11                  (v)  training  as   reviewers   of   university
12             teacher preparation programs;
13             (H)  other   educational   experiences   related  to
14        improving  the  teacher's  knowledge  and  skills  as   a
15        teacher, including the following:
16                  (i)  participating   in   action  research  and
17             inquiry projects;
18                  (ii)  observing   programs   or   teaching   in
19             schools, related businesses,  or  industry  that  is
20             systematic,  purposeful, and relevant to certificate
21             renewal;
22                  (iii)  traveling  related  to   ones   teaching
23             assignment,  directly related to student achievement
24             or school improvement plans and approved at least 30
25             days prior to the travel experience,  provided  that
26             the traveling shall not include time spent commuting
27             to  destinations  where the learning experience will
28             occur;
29                  (iv)  participating in study groups related  to
30             student achievement or school improvement plans;
31                  (v)  serving  on  a statewide education-related
32             committee, including but not limited  to  the  State
33             Teacher   Certification   Board,   State   Board  of
34             Education  strategic  agenda  teams,  or  the  State

 1             Advisory  Council  on  Education  of  Children  with
 2             Disabilities;
 3                  (vi)  participating in work/learn  programs  or
 4             internships; or
 5             (I)  professional  leadership experiences related to
 6        improving  the  teacher's  knowledge  and  skills  as   a
 7        teacher, including the following:
 8                  (i)  participating in curriculum development or
 9             assessment   activities   at   the   school,  school
10             district, regional office of  education,  State,  or
11             national level;
12                  (ii)  participating   in   team  or  department
13             leadership in a school or school district;
14                  (iii)  participating on  external  or  internal
15             school or school district review teams;
16                  (iv)  publishing educational articles, columns,
17             or  books  relevant  to  the  certificate area being
18             renewed; or
19                  (v)  participating   in   non-strike    related
20             professional   association   or  labor  organization
21             service or activities, including leadership.
22        (4)  A  certificate  renewal  plan  must   initially   be
23    approved  by  the  certificate  holder's  local  professional
24    development  committee,  as provided for in subsection (f) of
25    this  Section.   If  the   local   professional   development
26    committee  does not approve the certificate renewal plan, the
27    certificate holder  may  appeal  that  determination  to  the
28    regional   professional   development  review  committee,  as
29    provided for in paragraph  (2)  of  subsection  (g)  of  this
30    Section.   If  the  regional  professional development review
31    committee disagrees with the local  professional  development
32    committee's determination, the certificate renewal plan shall
33    be  deemed  approved  and  the  certificate  holder may begin
34    satisfying the continuing professional development activities

 1    set  forth  in  the  plan.   If  the  regional   professional
 2    development   review   committee   agrees   with   the  local
 3    professional  development  committee's   determination,   the
 4    certificate  renewal  plan  shall  be  deemed disapproved and
 5    shall be returned to the  certificate  holder  to  develop  a
 6    revised certificate renewal plan.  In all cases, the regional
 7    professional  development  review committee shall immediately
 8    notify both the local professional development committee  and
 9    the certificate holder of its determination.
10        (5)  A  certificate  holder  who  wishes  to  modify  the
11    continuing  professional  development  activities or goals in
12    his or her certificate renewal plan must submit the  proposed
13    modifications  to  his  or her local professional development
14    committee for approval prior  to  engaging  in  the  proposed
15    activities.   If the local professional development committee
16    does not approve the proposed modification,  the  certificate
17    holder   may   appeal  that  determination  to  the  regional
18    professional development review committee, as  set  forth  in
19    paragraph (4) of this subsection (e).
20        (6)  When  a  certificate  holder  changes assignments or
21    school  districts  during  the   course   of   completing   a
22    certificate  renewal  plan,  the professional development and
23    continuing education credit earned pursuant to the plan shall
24    transfer to the new assignment or school district  and  count
25    toward the total requirements.  This certificate renewal plan
26    must  be  reviewed  by  the  appropriate  local  professional
27    development  committee  and  may  be  modified to reflect the
28    certificate  holder's  new  work  assignment  or  the  school
29    improvement  plan  of  the  new  school  district  or  school
30    building.
31        (f)  Notwithstanding any other provisions of  this  Code,
32    each  school  district,  charter  school,  and cooperative or
33    joint agreement with a governing body  or  board  of  control
34    that   employs   certificated   staff,  shall  establish  and

 1    implement, in conjunction with its exclusive  representative,
 2    if   any,   one   or   more  local  professional  development
 3    committees, as set forth in this subsection (f), which  shall
 4    perform the following functions:
 5             (1)  review  and  approve  certificate renewal plans
 6        and any modifications  made  to  these  plans,  including
 7        transferred plans;
 8             (2)  maintain a file of approved certificate renewal
 9        plans;
10             (3)  monitor   certificate   holders'   progress  in
11        completing approved certificate renewal plans;
12             (4)  assist  in  the  development  of   professional
13        development   plans   based   upon  needs  identified  in
14        certificate renewal plans;
15             (5)  determine whether certificate holders have  met
16        the  requirements  of their certificate renewal plans and
17        notify certificate holders of its determination;
18             (6)  provide   a   certificate   holder   with   the
19        opportunity  to  address  the  committee  when   it   has
20        determined  that  the  certificate holder has not met the
21        requirements of his or her certificate renewal plan;
22             (7)  issue and forward recommendations  for  renewal
23        or  nonrenewal  of certificate holders' Standard Teaching
24        Certificates to the appropriate  regional  superintendent
25        of  schools,  based upon whether certificate holders have
26        met  the  requirements  of  their  approved   certificate
27        renewal   plans,   with  30-day  written  notice  of  its
28        recommendation provided to the certificate  holder  prior
29        to   forwarding   the   recommendation  to  the  regional
30        superintendent of schools, provided  that  if  the  local
31        professional  development  committee's  recommendation is
32        for certificate nonrenewal, the written  notice  provided
33        to the certificate holder shall include a return receipt;
34        and

 1             (8)  reconsider  its  recommendation  of certificate
 2        nonrenewal, upon request of the certificate holder within
 3        30 days of receipt of written notification that the local
 4        professional  development  committee  will  make  such  a
 5        recommendation,   and    forward    to    the    regional
 6        superintendent  of  schools  its recommendation within 30
 7        days of receipt of the certificate holder's request.
 8        Each  local  professional  development  committee   shall
 9    consist of at least 3 classroom teachers; one at-large member
10    who  may  be  an  administrator, a parent, or a member of the
11    business  community;   and   one   other   non-administrative
12    certificated  educational  employee.  If mutually agreed upon
13    by the school district, charter school, or governing body  or
14    board  of control of a cooperative or joint agreement and its
15    exclusive representative, if any, additional members  may  be
16    added to a local professional development committee, provided
17    that  a  majority  of  members  are  classroom teachers.  The
18    school district, charter school, or governing body  or  board
19    of  control  of  a  cooperative  or  joint  agreement and its
20    exclusive representative, if any, shall determine the term of
21    service of the members of a  local  professional  development
22    committee.   All  individuals  selected  to  serve  on  local
23    professional   development   committees   must  be  known  to
24    demonstrate  the  best  practices  in   teaching   or   their
25    respective field of practice.
26        The  exclusive  representative,  if any, shall select the
27    classroom teachers and other non-administrative  certificated
28    employee   members   of   a  local  professional  development
29    committee.  If no exclusive representative exists,  then  the
30    classroom teacher members of a local professional development
31    committee  shall  be  selected by the classroom teachers that
32    come within the local  professional  development  committee's
33    authority,   and the non-administrative certificated employee
34    members of the local professional development committee shall

 1    be selected by the non-administrative certificated  employees
 2    that   come   within   the   local  professional  development
 3    committee's authority.   The school district, charter school,
 4    or governing body or board of control  of  a  cooperative  or
 5    joint  agreement shall select the administrative members of a
 6    local  professional  development  committee.   Vacancies   in
 7    positions on a local professional development committee shall
 8    be filled in the same manner as the original selections.  The
 9    members  of  a local professional development committee shall
10    select  a  chairperson.    Local   professional   development
11    committee  meetings shall be scheduled so as not to interfere
12    with committee members' regularly scheduled teaching  duties,
13    except  when otherwise permitted by the policies of or agreed
14    to or approved by the school  district,  charter  school,  or
15    governing  body or board of control of a cooperative or joint
16    agreement, or its designee.
17        The board of education or governing board  shall  convene
18    the  first  meeting  of  the  local  professional development
19    committee.
20        The State  Board  of  Education  and  the  State  Teacher
21    Certification  Board shall jointly provide local professional
22    development committee members with a training manual, and the
23    members shall certify that they have received  and  read  the
24    manual.
25        Notwithstanding  any  other provisions of this subsection
26    (f), for a teacher employed  and  performing  services  in  a
27    nonpublic  or  State-operated elementary or secondary school,
28    all references to a local professional development  committee
29    shall  mean  the  regional  superintendent  of schools of the
30    regional office of education for the  geographic  area  where
31    the teaching is done.
32        (g)(1)  Each  regional  superintendent  of  schools shall
33    review and concur or nonconcur with each  recommendation  for
34    renewal  or  nonrenewal of a Standard Teaching Certificate he

 1    or  she  receives  from  a  local  professional   development
 2    committee   or,   if   a   certificate   holder  appeals  the
 3    recommendation  to  the  regional  professional   development
 4    review   committee,   the   recommendation   for  renewal  or
 5    nonrenewal he or she receives from  a  regional  professional
 6    development  review  committee and, within 14 days of receipt
 7    of  the  recommendation,  shall  provide  the  State  Teacher
 8    Certification Board with verification of  the  following,  if
 9    applicable:
10             (A)  a   certificate  renewal  plan  was  filed  and
11        approved   by   the   appropriate   local    professional
12        development committee;
13             (B)  the  professional  development  and  continuing
14        education   activities   set   forth   in   the  approved
15        certificate  renewal  plan   have   been   satisfactorily
16        completed;
17             (C)  the  local  professional  development committee
18        has recommended the renewal of the  certificate  holder's
19        Standard   Teaching   Certificate   and   forwarded   the
20        recommendation,  along  with all supporting documentation
21        as jointly required by the State Board of  Education  and
22        the  State  Teacher  Certification Board, to the regional
23        superintendent of schools;
24             (D)  the certificate holder has appealed his or  her
25        local professional development committee's recommendation
26        of  nonrenewal  to  the regional professional development
27        review committee and the result of that appeal;
28             (E)  the  regional  superintendent  of  schools  has
29        concurred or nonconcurred  with  the  local  professional
30        development    committee's   or   regional   professional
31        development review committee's recommendation to renew or
32        nonrenew  the  certificate  holder's  Standard   Teaching
33        Certificate and made a recommendation to that effect; and
34             (F)  the   established   registration  fee  for  the

 1        Standard Teaching Certificate has been paid.
 2    At the same  time  the  regional  superintendent  of  schools
 3    provides  the  State  Teacher  Certification  Board  with the
 4    notice required by this subsection (g), he or she shall  also
 5    notify the certificate holder in writing that this notice has
 6    been  provided  to  the  State  Teacher  Certification Board,
 7    provided  that  if  the  notice  provided  by  the   regional
 8    superintendent  of schools to the State Teacher Certification
 9    Board includes a recommendation  of  certificate  nonrenewal,
10    the  written  notice provided to the certificate holder shall
11    be by certified mail, return receipt requested.
12        (2)  Each certificate holder  shall  have  the  right  to
13    appeal  his or her local professional development committee's
14    recommendation of nonrenewal  to  the  regional  professional
15    development  review  committee,  within 14 days of receipt of
16    notice that the recommendation has been sent to the  regional
17    superintendent  of  schools.  Each regional superintendent of
18    schools shall establish a regional  professional  development
19    review  committee  or  committees for the purpose of advising
20    the regional superintendent of  schools,  upon  request,  and
21    handling  certificate  holder  appeals.  This committee shall
22    consist of at least 2 administrators, at  least  4  teachers,
23    and  one  other  non-administrative  certificated educational
24    employee selected by their exclusive representative, if  any.
25    A  regional  superintendent may add additional members to the
26    committee, provided that the same proportion of  teachers  to
27    administrators   on   the   committee   is  maintained.   Any
28    additional  teacher   and   non-administrative   certificated
29    educational  employee  members  shall  be  selected  by their
30    exclusive representative, if any.  All  individuals  selected
31    to   serve   on   regional  professional  development  review
32    committees must be known to demonstrate the best practices in
33    teaching or their respective field  of  practice.   Committee
34    members  shall  serve  staggered 3-year terms.  The committee

 1    may require information in addition to that received  from  a
 2    certificate holder's local professional development committee
 3    or  request  that  the  certificate  holder appear before it,
 4    shall either concur or nonconcur with  a  local  professional
 5    development  committee's  recommendation  of  nonrenewal, and
 6    shall forward to the regional superintendent of  schools  its
 7    recommendation  of  renewal or nonrenewal.  All actions taken
 8    by the regional  professional  development  review  committee
 9    shall  require  a quorum and be by a simple majority of those
10    present  and  voting.    A  record  of  all  votes  shall  be
11    maintained.  The committee shall have 45 days from receipt of
12    a certificate holder's appeal to make its  recommendation  to
13    the regional superintendent of schools.
14        The  State  Board  of  Education  and  the  State Teacher
15    Certification   Board   shall   jointly   provide    regional
16    professional  development  review  committee  members  with a
17    training manual, and the members shall be required to  attend
18    one  training seminar sponsored jointly by the State Board of
19    Education and the State Teacher Certification Board.
20        (h)(1)  The  State  Teacher  Certification  Board   shall
21    review    the    regional    superintendent    of    schools'
22    recommendations   to  renew  or  nonrenew  Standard  Teaching
23    Certificates  and  notify  certificate  holders  in   writing
24    whether  their  certificates  have been renewed or nonrenewed
25    within 90 days of receipt of the  recommendations,  unless  a
26    certificate  holder has appealed a regional superintendent of
27    schools'  recommendation  of  nonrenewal,  as   provided   in
28    paragraph  (2)  of  this  subsection  (h).  The State Teacher
29    Certification Board shall verify that the certificate  holder
30    has  met  the  renewal criteria set forth in paragraph (1) of
31    subsection (g) of this Section.
32        (2)  Each certificate holder  shall  have  the  right  to
33    appeal  a  regional superintendent of school's recommendation
34    to nonrenew his or her Standard Teaching Certificate  to  the

 1    State  Teacher Certification Board, within 14 days of receipt
 2    of notice that the  decision  has  been  sent  to  the  State
 3    Teacher  Certification  Board,  which  shall  hold  an appeal
 4    hearing within 60 days of receipt of the appeal.   When  such
 5    an   appeal  is  taken,  the  certificate  holder's  Standard
 6    Teaching Certificate shall continue to  be  valid  until  the
 7    appeal    is   finally   determined.    The   State   Teacher
 8    Certification Board shall review the regional  superintendent
 9    of   school's   recommendation,   the  regional  professional
10    development review committee's recommendation,  if  any,  and
11    the local professional development committee's recommendation
12    and   all   relevant  documentation  to  verify  whether  the
13    certificate holder has met the renewal criteria set forth  in
14    paragraph  (1)  of subsection (g) of this Section.  The State
15    Teacher Certification Board may request that the  certificate
16    holder  appear  before  it.   All  actions taken by the State
17    Teacher Certification Board shall require a quorum and be  by
18    a  simple  majority of those present and voting.  A record of
19    all  votes  shall   be   maintained.    The   State   Teacher
20    Certification  Board  shall  notify the certificate holder in
21    writing, within 7 days of completing the review, whether  his
22    or  her  Standard  Teaching  Certificate  has been renewed or
23    nonrenewed, provided that if the State Teacher  Certification
24    Board  determines  to  nonrenew  a  certificate,  the written
25    notice  provided  to  the  certificate  holder  shall  be  by
26    certified mail, return receipt requested.    All  certificate
27    renewal   or   nonrenewal  decisions  of  the  State  Teacher
28    Certification Board are final and subject  to  administrative
29    review, as set forth in Section 21-24 of this Code.
30        (i)  Holders  of  Master Teaching Certificates shall meet
31    the same requirements  and  follow  the  same  procedures  as
32    holders  of Standard Teaching Certificates, except that their
33    renewal cycle shall be as set  forth  in  subsection  (d)  of
34    Section 21-2 of this Code.

 1        (j)  Holders  of  Valid  but Inactive Standard and Master
 2    Teaching Certificates who are  not  employed  and  performing
 3    services  in  an Illinois public or State-operated elementary
 4    school, secondary school, or cooperative or  joint  agreement
 5    with  a governing body or board of control, in a certificated
 6    teaching   position,   may   voluntarily    activate    their
 7    certificates  by  developing  and  submitting  a  certificate
 8    renewal plan to the regional superintendent of schools of the
 9    regional  office  of  education for the geographic area where
10    their teaching is done, who, or whose designee, shall approve
11    the  plan  and  serve  as  the  certificate  holder's   local
12    professional   development   committee.    These  certificate
13    holders shall follow the same renewal criteria and procedures
14    as  all  other  Standard  and  Master  Teaching   Certificate
15    holders,    except   that   their   continuing   professional
16    development plans shall not be required to reflect or address
17    the  knowledge,  skills,  and  goals  of   a   local   school
18    improvement plan.
19        (k)  Each school district, charter school, or cooperative
20    or  joint  agreement shall be paid $1,000 per school year for
21    administrative costs associated with conducting the  meetings
22    of the local professional development committee.
23        (l)  The  State  Board of Education and the State Teacher
24    Certification  Board   shall   jointly   contract   with   an
25    independent  party  to  conduct a comprehensive evaluation of
26    the certificate renewal system pursuant to this Section.  The
27    first report of this evaluation shall  be  presented  to  the
28    General Assembly on January 1, 2005 and on January 1 of every
29    third year thereafter.

33        Sec. 21-16. Fees - Requirement for registration.

 1        (a)  Until January 1, 2000, every applicant when issued a
 2    certificate shall  pay  to  the  regional  superintendent  of
 3    schools  a  fee of $1, which shall be paid into the institute
 4    fund. Every certificate issued under the provisions  of  this
 5    Act  shall  be  registered  annually or, at the option of the
 6    holder of the certificate, once every 3 years.  The  regional
 7    superintendent of schools having supervision and control over
 8    the  school  where  the  teaching  is done shall register the
 9    certificate before the holder begins to teach,  otherwise  it
10    shall  be  registered in any county in the State of Illinois;
11    and one fee of $4 per year for registration or renewal of one
12    or more certificates which  have  been  issued  to  the  same
13    holder shall be paid into the institute fund.
14        Until  January  1, 2000, requirements for registration of
15    any certificate limited in time  shall  include  evidence  of
16    professional growth defined as successful teaching experience
17    since   last   registration  of  certificate,  attendance  at
18    professional    meetings,    membership    in    professional
19    organizations,  additional  credits  earned   in   recognized
20    teacher-training   institutions,   travel   specifically  for
21    educational experience, reading  of  professional  books  and
22    periodicals,  filing  all reports as required by the regional
23    superintendent of schools and  the  State  Superintendent  of
24    Education   or   such   other   professional   experience  or
25    combination of experiences as are presented  by  the  teacher
26    and  are approved by the State Superintendent of Education in
27    consultation with the State Teacher  Certification  Board.  A
28    duplicate  certificate may be issued to the holder of a valid
29    life certificate or valid certificate limited in time by  the
30    State  Superintendent of Education; however, it shall only be
31    issued upon request of a regional superintendent  of  schools
32    and  upon  payment  to the regional superintendent of schools
33    who requests such duplicate a fee of $4.
34        (b)  Beginning January  1,  2000,  all  persons  who  are

 1    issued  Standard Teaching Certificates pursuant clause (2) of
 2    subsection (c) of Section 21-2  and  all  persons  who  renew
 3    Standard  Teaching  Certificates  shall  pay  a  $25  fee for
 4    registration of all certificates held.  All persons  who  are
 5    issued  Standard  Teaching  Certificates  under clause (1) of
 6    subsection (c) of Section 21-2 and all other  applicants  for
 7    Standard   Teaching   Certificates   shall  pay  an  original
 8    application fee, pursuant to Section 21-12, and a $25 fee for
 9    registration of all certificates  held.   These  certificates
10    shall  be registered and the registration fee paid once every
11    5  years.   Standard  Teaching  Certificate  applicants   and
12    holders  shall  not be required to pay any other registration
13    fees for issuance or renewal of their certificates, except as
14    provided in Section 21-17 of this Code.  Beginning January 1,
15    2000,  Master  Teaching  Certificates  shall  be  issued  and
16    renewed upon payment by the applicant or  certificate  holder
17    of  a  $50  fee  for  registration  of all certificates held.
18    These certificates shall be registered and the fee paid  once
19    every  10  years.  Master Teaching Certificate applicants and
20    holders shall not be required to pay any other application or
21    registration  fees  for  issuance   or   renewal   of   their
22    certificates,  except  as  provided  in Section 21-17 of this
23    Code.  All other certificates issued under the provisions  of
24    this  Code shall be registered for the validity period of the
25    certificate at the rate of $5 per year for the  total  number
26    of  years for which the certificate is valid for registration
27    of all certificates held, or for a maximum  of  5  years  for
28    life  certificates.   The  regional superintendent of schools
29    having supervision and control  over  the  school  where  the
30    teaching  is  done  shall register the certificate before the
31    holder begins to teach, otherwise it shall be  registered  in
32    any  county  in  the State of Illinois. Each holder shall pay
33    the   appropriate   registration   fee   to   the    regional
34    superintendent  of  schools.   The regional superintendent of

 1    schools  shall  deposit  the  registration  fees   into   the
 2    institute  fund.   Any certificate holder who teaches in more
 3    than  one  educational  service  region  shall  register  the
 4    certificate or certificates in all regions where the teaching
 5    is done, but shall be required to pay  one  registration  fee
 6    for  all  certificates held, provided holders of certificates
 7    issued pursuant  to  Section  21-9  of  this  Code  shall  be
 8    required  to  pay  one  registration fee, in each educational
 9    service  region  in  which  his   or   her   certificate   or
10    certificates are registered, for all certificates held.
11        A  duplicate certificate may be issued to the holder of a
12    valid life certificate or valid certificate limited  in  time
13    by  the  State Superintendent of Education; however, it shall
14    only be issued upon request of a regional  superintendent  of
15    schools  and  upon  payment to the regional superintendent of
16    schools who requests the duplicate a fee of $4,  which  shall
17    be deposited into the institute fund.

20        Sec.  21-17.  Fee for original and duplicate certificate.
21    A  duplicate  certificate  shall  be  issued  by  the   State
22    Superintendent  of  Education  when requested by the regional
23    superintendent of schools as provided in Section  21-16.  The
24    request for a duplicate certificate shall be accompanied by a
25    fee  of  $4,  which  shall  be  deposited  into  the  Teacher
26    Certificate Fee Revolving Fund.

29        Sec.   21-21.    Definitions;  granting  of  recognition;
30    regional accreditation).
31        (a)  "Recognized", as used in this Article in  connection
32    with  the  word "school" or "institution", means such school,

 1    college, university, private junior college, public community
 2    college or special or technical  school  as  maintains  a  an
 3    equipment,  course  of  study,  a standard of scholarship and
 4    other requirements set by the State  Board  of  Education  in
 5    consultation  with  the  State  Teacher  Certification Board.
 6    Application for recognition of such school or institution  as
 7    a teacher education training institution shall be made to the
 8    State  Board  of  Education.  The State Board of Education in
 9    consultation with the State Teacher Certification Board shall
10    set the criteria by which the school or institution shall  be
11    judged  and  through the Secretary of the Board shall arrange
12    for an official inspection and  shall  grant  recognition  of
13    such   school   or  institution  as  may  meet  the  required
14    standards.   If  such  standards  include  requirements  with
15    regard  to  education  in  acquiring  skills  in working with
16    culturally distinctive students,  as  defined  by  the  State
17    Board  of  Education,  then  the  rules of the State Board of
18    Education  shall  include  the  criteria  used  to   evaluate
19    compliance  with  this  requirement. No school or institution
20    shall make assignments of student teachers  or  teachers  for
21    practice  teaching  so as to promote segregation on the basis
22    of race, creed, color, religion, sex or national origin.
23        All recommendations for initial or standard certification
24    shall be made All courses listed or credentials  required  as
25    the  basis of any certificate or for its renewal shall be the
26    equivalent  of  courses  offered  by  a  recognized   teacher
27    training  institution  operating a program of preparation for
28    the certificate  approved  by  the  State  Superintendent  of
29    Education    in   consultation   with   the   State   Teacher
30    Certification  Board.  The  State  Board  of   Education   in
31    consultation with the State Teacher Certification Board shall
32    have  the  power  to  define  a major or minor when used as a
33    basis for recognition and certification purposes.
34        (b)  "Regionally accredited" or "accredited" as  used  in

 1    this  Article  in connection with a university or institution
 2    shall mean an institution of higher education  accredited  by
 3    the  North  Central  Association or other comparable regional
 4    accrediting association.

 7        Sec.  21-25.   School  service   personnel   certificate.
 8    Subject  to the provisions of Section 21-1a, a school service
 9    personnel certificate shall be issued to those applicants  of
10    good  character,  good health, a citizen of the United States
11    and at least 19 years of age who  have  a  Bachelor's  degree
12    with  not  fewer  than  120  semester hours from a regionally
13    accredited recognized institution of higher learning and  who
14    meets    the    requirements   established   by   the   State
15    Superintendent of Education in consultation  with  the  State
16    Teacher  Certification  Board.   A  school  service personnel
17    certificate with a school nurse endorsement may be issued  to
18    a  person  who  holds  a  bachelor  of science degree from an
19    institution  of  higher  learning  accredited  by  the  North
20    Central Association or other comparable regional  accrediting
21    association.    Persons  seeking any other endorsement on the
22    school service personnel certificate shall be recommended for
23    the endorsement by a recognized teacher education institution
24    as having completed a program of preparation approved by  the
25    State  Superintendent  of  Education in consultation with the
26    State Teacher Certification Board.
27        Such certificate shall  be  endorsed  with  the  area  of
28    Service   as   determined  by  the  State  Superintendent  of
29    Education   in   consultation   with   the   State    Teacher
30    Certification Board.
31        The  holder  of such certificate shall be entitled to all
32    of the rights and  privileges  granted  holders  of  a  valid
33    teaching    certificate,    including    teacher    benefits,

 1    compensation and working conditions.
 2        When the holder of such certificate has earned a master's
 3    degree,  including  8 semester hours of graduate professional
 4    education from a recognized institution of  higher  learning,
 5    and  has  at  least  2  years of successful school experience
 6    while  holding  such  certificate,  the  certificate  may  be
 7    endorsed for supervision.

 9        (105 ILCS 5/34-83) (from Ch. 122, par. 34-83)
10        Sec.  34-83.   Board  of  examiners  -   Certificates   -
11    Examinations.  A  board  of  3  examiners  shall  examine all
12    applicants required to hold certificates  to  teach  and  the
13    board of education shall issue gratuitously to those who pass
14    a   required  test  of  character,  scholarship  and  general
15    fitness,  such  certificates  to  teach  as  they  are  found
16    entitled to receive. No person may be granted or continue  to
17    hold  a  teaching  certificate  who  has knowingly altered or
18    misrepresented his or her teaching qualifications in order to
19    acquire the certificate.  Any other certificate held by  such
20    person may be suspended or revoked by the board of examiners,
21    depending   upon   the   severity   of   the   alteration  or
22    misrepresentation. The board of examiners  shall  consist  of
23    the  general superintendent of schools and 2 persons approved
24    and appointed by the board of education upon  the  nomination
25    of  the  general  superintendent  of  schools.  The  board of
26    examiners shall  hold  such  examinations  as  the  board  of
27    education  may  prescribe,  upon  the  recommendation  of the
28    general superintendent  of  schools  and  shall  prepare  all
29    necessary  eligible  lists, which shall be kept in the office
30    of the general superintendent  of  schools  and  be  open  to
31    public  inspection.  Members  of the board of examiners shall
32    hold office for a term of 2 years.
33        The  board  of  examiners  created  herein  is  abolished

 1    effective July 1, 1988.  Commencing July  1,  1988,  all  new
 2    teachers   employed   by   the   board  shall  hold  teaching
 3    certificates issued by the State Teacher Certification  Board
 4    under   Article   21.    The  State  Board  of  Education  in
 5    consultation with  the  board  of  examiners  and  the  State
 6    Teacher  Certification Board shall develop procedures whereby
 7    teachers currently holding valid certificates issued  by  the
 8    board  of  examiners,  and all teachers employed by the board
 9    after August 1, 1985 and prior to  July  1,  1988,  shall  no
10    later  than  July 1, 1988 exchange certificates issued by the
11    board of examiners for comparable certificates issued by  the
12    State  Teacher  Certification  Board.   On  the exchange of a
13    certificate on or before July  1,  1988,  the  State  Teacher
14    Certification   Board   shall   not  require  any  additional
15    qualifications   for   the   issuance   of   the   comparable
16    certificate. If prior to July 1, 1988 the board of  examiners
17    has  issued  types  of  teaching  certificates  which are not
18    comparable to the types of certificates issued by  the  State
19    Teacher Certification Board, such certificates shall continue
20    to  be  valid  for  and  shall  be  renewable  by the holders
21    thereof, and no additional qualifications shall  be  required
22    by the State Teacher Certification Board for any such renewal
23    ;  however, no individual who received a letter of continuing
24    eligibility shall be issued an Initial or  Standard  Teaching
25    Certificate, as provided in Section 21-2 of this Code, unless
26    that  individual  also  holds  such  a  valid  and  renewable
27    certificate.
28        The  State  Board  of  Education  shall report by July 1,
29    1986, to the Illinois General Assembly on the procedures  for
30    exchange  it  has developed in consultation with the board of
31    examiners  and  the  State  Teacher  Certification  Board  as
32    required in this Section.

 7        Sec. 8.23. Exempt mandate.   Notwithstanding  Sections  6
 8    and  8  of  this  Act  and except for the payment provided in
 9    subsection (k) of  Section  21-14  of  the  School  Code,  no
10    reimbursement by the State is required for the implementation
11    of  any  mandate  created  by this amendatory Act of the 91st
12    General Assembly.

13        Section 99.  Effective date.  This Act takes effect  July
14    1, 1999.
