 1        AN ACT concerning vehicle brake usage.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Department  of  Transportation  Law  is
 5    amended by adding Section 2705-580 as follows:

 6        (20 ILCS 2705/2705-580 new)
 7        Sec.  2705-580.  Signs  prohibiting  use  of jake brakes.
 8    The Department shall adopt rules  establishing  the  required
 9    content  and  placement  of  signs  alerting motorists to the
10    prohibition in Section 11-1429 of the Illinois  Vehicle  Code
11    against   the  use  of  vehicle  engine  compression  brakes,
12    commonly known as jake brakes, in a residential area of  Lake
13    County.   As  used  in this Section, "residential area" means
14    any area within 300 yards of at least 3 single or multifamily
15    residential structures.

16        Section 10.  The Illinois  Vehicle  Code  is  amended  by
17    adding Section 11-1429 as follows:

18        (625 ILCS 5/11-1429 new)
19        Sec. 11-1429.  Use of jake brakes in residential areas.
20        (a)  No driver shall use or operate in a residential area
21    any  vehicle  engine  compression  brake, commonly known as a
22    jake brake.
23        (b)  As used in this Section,  "residential  area"  means
24    any area within 300 yards of at least 3 single or multifamily
25    residential structures.
26        (c)  This Section applies only in Lake County.
27        (d)  The  provisions  of  this Section constitute minimum
28    requirements for home rule units.   Any  home  rule  unit  to
29    which this Section applies may enact an ordinance prescribing

 1    more stringent restrictions on the use of jake brakes.   This
 2    Section  is a limitation under subsection (i) of Section 6 of
 3    Article VII of the Illinois Constitution  on  the  concurrent
 4    exercise by home rule units of powers and functions exercised
 5    by the State.

 6        Section  15.  The State Mandates Act is amended by adding
 7    Section 8.24 as follows:

 8        (30 ILCS 805/8.24 new)
 9        Sec. 8.24. Exempt mandate.   Notwithstanding  Sections  6
10    and  8 of this Act, no reimbursement by the State is required
11    for  the  implementation  of  any  mandate  created  by  this
12    amendatory Act of the 91st General Assembly.
