 1                    AMENDMENT TO HOUSE BILL 2958

 2        AMENDMENT NO.     .  Amend House Bill 2958 as follows:
 3    by replacing everything after the enacting  clause  with  the
 4    following:

 5        "Section  5.  The  Department  of  Transportation  Law is
 6    amended by adding Section 2705-580 as follows:

 7        (20 ILCS 2705/2705-580 new)
 8        Sec. 2705-580.  Signs  limiting  use  of  vehicle  engine
 9    compression brakes.
10        (a)  The  Department  shall  adopt rules establishing the
11    required content and placement of signs alerting motorists to
12    the limitation in Section 11-1429  of  the  Illinois  Vehicle
13    Code  against the use of vehicle engine compression brakes in
14    residential areas of any  municipality  or  county  that  has
15    adopted  an  ordinance  under Section 11-1429 of the Illinois
16    Vehicle Code.
17        (b)  The Department shall install the necessary signs  at
18    the  request  of  any municipality or county that has adopted
19    the ordinance noted in subsection (a).
20        [c)  As used in this Section,  "residential  area"  means
21    any area within 300 yards of at least 3 single or multifamily
22    residential structures.

 1        Section  10.  The  Illinois  Vehicle  Code  is amended by
 2    adding Section 11-1429 as follows:

 3        (625 ILCS 5/11-1429 new)
 4        Sec. 11-1429.  Use of vehicle engine  compression  brakes
 5    in residential areas.
 6        (a)  No  driver  shall  use or operate any vehicle engine
 7    compression brake in a residential area of  any  municipality
 8    or  county  that has adopted an ordinance under this Section,
 9    unless the vehicle engine compression brake is applied in  an
10    emergency  and  is necessary for the protection of persons or
11    property.
12        (b)  As used in this Section,  "residential  area"  means
13    any area within 300 yards of at least 3 single or multifamily
14    residential structures.
15        (c)  Appropriate signs shall be placed in accordance with
16    standards  prescribed  by the Department under Section 11-301
17    of this Code in any municipality or county that by  ordinance
18    has adopted the terms of this Section.
19        (d)  Any  municipality or county that by ordinance adopts
20    the terms of this Section  shall  notify  the  Department  to
21    install  the  necessary  signs  under Section 2705-580 of the
22    Department of Transportation Law.  The municipality or county
23    shall reimburse the Department for the cost of those signs.
24        (e)  Subsection (a) of this Section does not apply to any
25    authorized emergency vehicle as defined in Chapter 1 of  this
26    Code.".
