 1                    AMENDMENT TO HOUSE BILL 2958

 2        AMENDMENT NO.     .  Amend House Bill 2958,  AS  AMENDED,
 3    as follows:
 4    by  replacing  everything  after the enacting clause with the
 5    following:

 6        "Section 5.  The  Department  of  Transportation  Law  is
 7    amended by adding Section 2705-580 as follows:

 8        (20 ILCS 2705/2705-580 new)
 9        Sec.  2705-580.  Signs  limiting  use  of  vehicle engine
10    compression brakes.
11        (a)  The Department shall adopt  rules  establishing  the
12    installation,   content,  and  placement  of  signs  alerting
13    motorists  to  the  limitation  in  Section  11-1429  of  the
14    Illinois Vehicle Code  against  the  use  of  vehicle  engine
15    compression  brakes  in residential areas of any municipality
16    or county that has adopted an ordinance under Section 11-1429
17    of the Illinois Vehicle Code.
18        [b)  As used in this Section,  "residential  area"  means
19    any area within 300 yards of at least 3 single or multifamily
20    residential structures.

21        Section  10.  The  Illinois  Vehicle  Code  is amended by

 1    adding Section 11-1429 as follows:

 2        (625 ILCS 5/11-1429 new)
 3        Sec. 11-1429.  Use of vehicle engine  compression  brakes
 4    in residential areas.
 5        (a)  Any  municipality  or  county may adopt an ordinance
 6    under this Section restricting the use of any vehicle  engine
 7    compression  brake  in a residential area, unless the vehicle
 8    engine compression brake is applied in an  emergency  and  is
 9    necessary for the protection of persons or property.
10        (b)  As  used  in  this Section, "residential area" means
11    any area within 300 yards of at least 3 single or multifamily
12    residential structures.
13        (c)  Appropriate signs shall be placed in accordance with
14    standards prescribed by the Department under  Section  11-301
15    of  this Code in any municipality or county that by ordinance
16    has adopted the terms of this Section.
17        (d)  Any municipality or county that by ordinance  adopts
18    the  terms  of  this  Section  shall notify the Department to
19    install the necessary signs under  Section  2705-580  of  the
20    Department of Transportation Law.  The municipality or county
21    shall reimburse the Department for the cost of those signs.
22        (e)  Subsection (a) of this Section does not apply to any
23    authorized  emergency vehicle as defined in Chapter 1 of this
24    Code.".
