SYNOPSIS AS INTRODUCED:
 
215 ILCS 5/355.6 new
215 ILCS 125/4-6.6 new

    Amends the Illinois Insurance Code. Provides that no insurer, health maintenance organization, managed care plan, health care plan, preferred provider organization, or third-party administrator, or bank or payment processing company under contract with one of those entities, shall charge a provider a fee, fine, or cost for using an electronic funds transfer process, including, but not limited to, direct deposit, virtual or digital checks, or virtual credit cards, to receive payment for health care services provided to an insured. Amends the Health Maintenance Organization Act to make a conforming change. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Insurance Code is amended by
5adding Section 355.6 as follows:
 
6    (215 ILCS 5/355.6 new)
7    Sec. 355.6. Electronic payment fees prohibited.
8    (a) No insurer, health maintenance organization, managed
9care plan, health care plan, preferred provider organization,
10or third-party administrator, or bank or payment processing
11company under contract with one of those entities, shall
12charge a provider a fee, fine, or cost for using an electronic
13funds transfer process, including, but not limited to, direct
14deposit, virtual or digital checks, or virtual credit cards,
15to receive payment for health care services provided to an
16insured.
17    (b) As used in this Section, "provider" has the meaning
18set forth in Section 370g of this Code.
 
19    Section 10. The Health Maintenance Organization Act is
20amended by adding Section 4-6.6 as follows:

1    Sec. 4-6.6. Electronic payment fees prohibition. A health
2maintenance organization is subject to Section 355.6 of the
3Illinois Insurance Code.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
