AMENDMENT TO SENATE BILL 2597

2    AMENDMENT NO. ______. Amend Senate Bill 2597 as follows:
 
3on page 1, by replacing line 5 with "changing Sections 2, 3, 4,
4and 7 and by adding Sections 5.5 and 9.38 as"; and
 
5on page 9, immediately below line 8, by inserting the
6following:
 
7    "(110 ILCS 205/7)  (from Ch. 144, par. 187)
8    Sec. 7. The Board of Trustees of the University of
9Illinois, the Board of Trustees of Southern Illinois
10University, the Board of Trustees of Chicago State University,
11the Board of Trustees of Eastern Illinois University, the Board
12of Trustees of Governors State University, the Board of
13Trustees of Illinois State University, the Board of Trustees of
14Northeastern Illinois University, the Board of Trustees of
15Northern Illinois University, the Board of Trustees of Western

1Illinois University, the Illinois Community College Board and
2the campuses under their governance or supervision shall not
3hereafter undertake the establishment of any new unit of
4instruction, research or public service without the approval of
5the Board. The term "new unit of instruction, research or
6public service" includes the establishment of a college,
7school, division, institute, department or other unit in any
8field of instruction, research or public service not
9theretofore included in the program of the institution, and
10includes the establishment of any new branch or campus. The
11term does not include reasonable and moderate extensions of
12existing curricula, research, or public service programs which
13have a direct relationship to existing programs; and the Board
14may, under its rule making power, define the character of such
15reasonable and moderate extensions.
16    Such governing boards shall submit to the Board all
17proposals for a new unit of instruction, research, or public
18service. The Board may approve or disapprove the proposal in
19whole or in part or approve modifications thereof whenever in
20its judgment such action is consistent with the objectives of
21an existing or proposed master plan of higher education.
22    The Board of Higher Education is authorized to review
23periodically all existing programs of instruction, research
24and public service at the State universities and colleges and
25to advise the appropriate board of control if the contribution
26of each program is not educationally and economically

1justified. Each State university shall report annually to the
2Board on programs of instruction, research, or public service
3that have been terminated, dissolved, reduced, or consolidated
4by the university. Each State university shall also report to
5the Board all programs of instruction, research, and public
6service that exhibit a trend of low performance in enrollments,
7degree completions, and high expense per degree. The Board may
8require the elimination of any program of instruction,
9research, or public service at a State university that exhibits
10a trend of low performance. The Board shall compile an annual
11report that shall contain information on new programs created,
12existing programs that have been closed, eliminated, or
13consolidated, and programs that exhibit low performance or
14productivity. The report must be submitted to the General
15Assembly. The Board shall have the authority to define relevant
16terms and timelines by rule with respect to this reporting.

19    Sec. 9.38. Evaluation of programmatic expansions and new
20programs. In evaluating programmatic expansions and new
21programs at public institutions of higher education, the Board,
22prior to approving such expansions or new programs, shall make
23the following findings:
24        (1) that such an expansion or new program is meeting an
25    unmet need in that region of the State or serving an

1    unserved or underserved population;
2        (2) in cases in which subdivision (1) of this Section
3    cannot be satisfied, that a market-demand analysis has been
4    performed to rationally justify that growth opportunity in
5    the area will be forthcoming in the immediate future;
6        (3) that the institution has the ability, if so
7    approved, to offer a quality program at a price point that
8    is cheaper for students than existing options elsewhere in
9    the area; and
10        (4) that the opening of such a program does not
11    negatively impact the optimal efficiency of the existing
12    higher education infrastructure in this State.".
