1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by changing
5Section 9-186 as follows:
 
6    (40 ILCS 5/9-186)  (from Ch. 108 1/2, par. 9-186)
7    Sec. 9-186. Board elections. In each year, the board shall
8conduct a regular election, under rules adopted by it, at least
930 days prior to the expiration of the term of each elected
10employee or annuitant member.
11    To be eligible to be a county employee member, a person
12must be an employee of the county and must have at least 5
13years of service credit in that capacity by December 1 of the
14year of election. To be eligible to be a forest preserve
15district member, a person must be an employee of the forest
16preserve district and must have at least 5 years of service
17credit in that capacity by December 1 of the year of election.
18    Only those persons who are employees of the county shall be
19eligible to vote for the 3 county employee members, only those
20persons who are employees of the forest preserve district shall
21be eligible to vote for the forest preserve district member,
22only those persons who are currently receiving retirement
23benefits under this Article shall be eligible to vote for the

1annuitant members elected under subsections (d) and (d-1) of
2Section 9-185, and only those persons who are currently
3receiving retirement benefits under Article 10 shall be
4eligible to vote for the forest preserve district annuitant
5member elected under subsection (f) of Section 9-185. The
6ballot shall be of secret character.
7    Except as otherwise provided in Section 9-187, each member
8of the board shall hold office until his successor is chosen
9and has qualified.
10    Any person elected or appointed a member of the board shall
11qualify for the office by taking an oath of office to be
12administered by the county clerk or a person designated by him.
13A copy thereof shall be kept in the office of the county clerk.
14Any appointment or notice of election shall be in writing and
15the written instrument shall be filed with the oath.
16    The board shall list on its website all board vacancies,
17the election calendar, the statutory requirements for each
18elected board position, and election rules adopted by the
19board.
