AMENDMENT TO SENATE BILL 1427

2    AMENDMENT NO. ______. Amend Senate Bill 1427 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Section 5.786 as follows:
 
6    (30 ILCS 105/5.786 new)
7    Sec. 5.786. The Illinois Equine Foundation Fund.
 
8    Section 10. The Illinois Vehicle Code is amended by adding
9Section 3-696 as follows:
 
10    (625 ILCS 5/3-696 new)
11    Sec. 3-696. Illinois Equine Foundation license plates.
12    (a) The Secretary, upon receipt of all applicable fees and
13applications made in the form prescribed by the Secretary, may
14issue special registration plates designated as Illinois

1Equine Foundation license plates. The special plates issued
2under this Section shall be affixed only to passenger vehicles
3of the first division or motor vehicles of the second division
4weighing not more than 8,000 pounds. Plates issued under this
5Section shall expire according to the multi-year procedure
6established by Section 3-414.1 of this Code.
7    (b) The Illinois Equine Foundation may design the special
8license plates. The design for the special license plates shall
9conform to such standards as may be established by the
10Secretary and shall be subject to the Secretary's approval.
11Appropriate documentation, as determined by the Secretary,
12shall accompany each application. The Secretary may allow the
13plates to be issued as vanity plates or personalized plates
14under Section 3-405.1 of this Code. The Secretary shall
15prescribe stickers or decals as provided under Section 3-412 of
16this Code.
17    (c) An applicant for the special plate shall be charged a
18$40 fee for original issuance in addition to the appropriate
19registration fee. Of this fee, $25 shall be deposited into the
20Illinois Equine Foundation Fund and $15 shall be deposited into
21the Secretary of State Special License Plate Fund, to be used
22by the Secretary to help defray the administrative processing
23costs.
24    For each registration renewal period, a $27 fee, in
25addition to the appropriate registration fee, shall be charged.
26Of this fee, $25 shall be deposited into the Illinois Equine

1Foundation Fund and $2 shall be deposited into the Secretary of
2State Special License Plate Fund.
3    (d) The Illinois Equine Foundation Fund is created as a
4special fund in the State treasury. All moneys in the Illinois
5Equine Foundation Fund shall be paid, subject to appropriation
6by the General Assembly and approval by the Secretary, as
7grants to fund equine protection efforts, research projects in
8the State of Illinois, education and outreach for Illinois
9universities, volunteers, horse owners, and the general public
10regarding horses and the equine industry in the State of
11Illinois, and to cover the reasonable cost for Illinois Equine
12Foundation special plate advertising and the administration of
13equine projects and educational programs. All interest earned
14on moneys in the Fund shall be deposited into the Fund. The
15Fund shall not be subject to administrative charges or
16chargebacks, such as but not limited to those authorized under
17Section 8h of the State Finance Act.".
