AMENDMENT TO HOUSE BILL 2859

2     AMENDMENT NO. ______. Amend House Bill 2859 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Criminal Code of 1961 is amended by
5 changing Section 19-2 as follows:
 
6     (720 ILCS 5/19-2)  (from Ch. 38, par. 19-2)
7     Sec. 19-2. Possession of burglary tools.
8     (a) A person commits the offense of possession of burglary
9 tools when he possesses any key, tool, instrument, device, or
10 any explosive, suitable for use in breaking into a building,
11 housetrailer, watercraft, aircraft, motor vehicle as defined
12 in The Illinois Vehicle Code, railroad car, or any depository
13 designed for the safekeeping of property, or any part thereof,
14 with intent to enter any such place and with intent to commit
15 therein a felony or theft. The possession of a key designed for
16 lock bumping demonstrates intent to commit a felony or theft.

1 For the purposes of this Section, "lock bumping" means a lock
2 picking technique for opening a pin tumbler lock using a
3 specially-crafted bumpkey.
4     (b) Sentence.
5     Possession of burglary tools in violation of this Section
6 is a Class 4 felony.
