AMENDMENT TO HOUSE BILL 4251

AMENDMENT NO. ______. Amend House Bill 4251 by replacing everything after the enacting clause with the following:

"Section 5. The School Code is amended by adding Sections 10-20.40 and 34-18.33 as follows:

(105 ILCS 5/10-20.40 new)

Sec. 10-20.40. Multiple-birth children; classroom placement.

(a) For purposes of this Section, "higher-order multiples" means triplets, quadruplets, quintuplets, or more.

(b) The school board shall allow a parent or guardian of twins or higher-order multiples to request that the children be placed in the same classroom or in separate classrooms if the children are in the same grade level at the same school. The school may recommend classroom placement to the parent or guardian and provide professional educational advice to the parent or guardian to assist him or her in making the best decision for the children's education. A school must provide the placement requested by the parent or guardian, unless the school board makes a classroom placement determination following a principal's request under subsection (d) this Section.

(c) The parent or guardian must request classroom placement under this Section no later than 14 days after the first day of each school year or 14 days after the first day of attendance of the children during a school year if the children are enrolled in the school after the school year commences.

(d) At the end of the initial grading period, if the school's principal, in consultation with the children's classroom teacher, determines that the classroom placement requested by the parent or guardian is disruptive to the school, then the principal may request that the school board determine the children's classroom placement.

(e) Notwithstanding any other provision of this Section, the classroom placement of children with disabilities, as defined in Article 14 of this Code, must be determined by each child's individualized education program.
