 1                    AMENDMENT TO SENATE BILL 802

 2        AMENDMENT NO.     .  Amend Senate Bill 802,  AS  AMENDED,
 3    with  reference  to  page and line numbers of House Amendment
 4    No. 1, on page 5, immediately above line 22, by inserting the
 5    following:

 6        "Section 45.  South suburban airport; Peotone, Illinois.
 7        (a)  The  Governor  and  the  State  of   Illinois   must
 8    immediately,  expeditiously, and continuously take all action
 9    necessary for the  construction  and  operation  of  a  south
10    suburban   airport   located  in  the  vicinity  of  Peotone,
11    Illinois.  This includes, without  limitation,  expeditiously
12    negotiating  and  settling,  if possible, with land owners to
13    acquire property for the airport in order to avoid  hardships
14    on  the  landowners.   The  Governor must direct the Illinois
15    Department of Transportation and all other  executive  branch
16    agencies  under  the  Governor's  control to comply with this
17    Section.
18        (b)  The  Governor  and  the   Illinois   Department   of
19    Transportation  shall  expeditiously  seek  approval  of  the
20    Federal  Aviation Administration for an airport runway layout
21    plan, including an inaugural runway of a  minimum  of  10,000
22    feet,  for the south suburban airport located in the vicinity
23    of Peotone, Illinois.  The State shall not enact  or  enforce

 1    any  law  respecting aeronautics that interferes with, or has
 2    the effect of interfering with, that runway design."; and

 3    on page 14,  line  1,  by  changing  "Section  7-103.149"  to
 4    "Sections 7-103.149 and 7-103.150"; and

 5    on  page  15,  immediately  below  line  25, by inserting the
 6    following:

 7        "(735 ILCS 5/7-103.150 new)
 8        Sec.  7-103.150.  Quick-take;  Peotone  airport.  Eminent
 9    domain proceedings, including  quick-take  proceedings  under
10    Section   7-103,   may   be   used   by   the  Department  of
11    Transportation for the purpose of acquiring property for  the
12    construction  of  an  airport  in  the  vicinity  of Peotone,
13    Illinois.".
