AMENDMENT TO HOUSE BILL 762

2     AMENDMENT NO. ______. Amend House Bill 762 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The School Code is amended by adding Section
5 18-4.6 as follows:
 
6     (105 ILCS 5/18-4.6 new)
7     Sec. 18-4.6. Tax equivalent grants; Illinois School for the
8 Deaf, Illinois School for the Visually Impaired, and
9 Jacksonville Developmental Center. When the Illinois School
10 for the Deaf, the Illinois School for the Visually Impaired,
11 and the Jacksonville Developmental Center are located in a
12 school district, the State Superintendent of Education shall,
13 subject to appropriation, annually direct the State
14 Comptroller to pay the amount of the tax-equivalent grant
15 provided in this Section, and the State Comptroller shall draw
16 his or her warrant upon the State Treasurer for the payment of
17 the grant. For fiscal year 2005 and each fiscal year
18 thereafter, the grant shall equal 0.5% of the equalized
19 assessed valuation of all land in the district owned by the
20 State (computing that equalized assessed valuation by
21 multiplying the average value per taxable acre of the school
22 district by the total number of acres of land owned by the
23 State). Annually on or before September 15, 2005 and July 1,
24 thereafter, the district superintendent shall certify to the

1 State Board of Education the following matters: (1) that the
2 Illinois School for the Deaf, the Illinois School for the
3 Visually Impaired, and the Jacksonville Developmental Center
4 are located within the district; (2) the total land area of the
5 district in acres; (3) the total ownership of the land of the
6 State in the district in acres; (4) the total equalized
7 assessed value of all the land in the district; (5) the rate of
8 school tax payable in the year; and (6) the computed amount of
9 the tax-equivalent grant claimed. Failure of any district
10 superintendent to certify the claim for the tax-equivalent
11 grant on or before September 15, 2005 or July 1 of a subsequent
12 year shall constitute a forfeiture by the district of its right
13 to the grant for the school year.
 
14     Section 99. Effective date. This Act takes effect upon
15 becoming law.".
