1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mobile Home Landlord and Tenant Rights Act
5is amended by changing Sections 15, 16, and 17 as follows:
 
6    (765 ILCS 745/15)  (from Ch. 80, par. 215)
7    Sec. 15. Statutory grounds for eviction.
8    (a) A park owner may terminate the lease and evict a tenant
9for any one or more of the following acts:
10        (1) (a) Non-payment of rent due;
11        (2) (b) Failure to comply with the park rules;
12        (3) (c) Failure to comply with local ordinances and
13    State laws regulating mobile homes.
14    (b) Non-payment of rent to a park that has not applied for
15its license or its license renewal and failed to submit all
16fees due and payable under the Mobile Home Park Act shall not
17be grounds for eviction.

20    Sec. 16. Improper grounds for eviction. The following
21conduct by a tenant shall not constitute grounds for eviction
22or termination of the lease, nor shall an eviction order be

1entered against a tenant:
2    (a) As a reprisal for the tenant's effort to secure or
3enforce any rights under the lease or the laws of the State of
4Illinois, or its governmental subdivisions of the United
5States;
6    (b) As a reprisal for the tenant's good faith complaint to
7a governmental authority of the park owner's alleged violation
8of any health or safety law, regulation, code or ordinance, or
9State law or regulation which has as its objective the
10regulation of premises used for dwelling purposes;
11    (c) As a reprisal for the tenant's being an organizer or
12member of, or involved in any activities relative to a
13homeowners' association;
14    (d) As a reprisal for or on the basis of the tenant's
15immigration or citizenship status; .
16    (e) As a reprisal for the non-payment of rent if the park
17has failed to apply for its license or renewal of its license
18and failed to submit all fees due and payable under the Mobile
19Home Park Act.

22    Sec. 17. Notice required by Law. The following notice
23shall be printed verbatim in a clear and conspicuous manner in
24each lease or rental agreement of a mobile home or lot:
25    "IMPORTANT NOTICE REQUIRED BY LAW:

1    The rules set forth below govern the terms of your lease of
2occupancy arrangement with this mobile home park. The law
3requires all of these rules and regulations to be fair and
4reasonable, and if not, such rules and regulations cannot be
5enforced against you.
6    As required by law, the park must be licensed to operate a
7mobile home park either by either the State of Illinois
8Department of Public Health or applicable home rule
9jurisdiction. Pursuant to the Mobile Home Park Act, this
10license shall expire April 30 of each year, and a new license
11shall be issued upon proper application and payment of the
12annual license fee.
13    You may continue to reside in the park as long as you pay
14your rent and abide by the rules and regulations of the park.
15You may only be evicted for non-payment of rent, violation of
16laws, or for violation of the rules and regulations of the park
17and the terms of the lease.
18    If this park requires you to deal exclusively with a
19certain fuel dealer or other merchant for goods or service in
20connection with the use or occupancy of your mobile home or on
21your mobile home lot, the price you pay for such goods or
22services may not be more than the prevailing price in this
23locality for similar goods and services.
24    You may not be evicted for reporting any violations of law
25or health and building codes to boards of health, building
26commissioners, the department of the Attorney General or any
