AMENDMENT TO SENATE BILL 2834

2    AMENDMENT NO. ______. Amend Senate Bill 2834 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Mobile Home Landlord and Tenant Rights Act
5is amended by changing Sections 15, 16, and 17 as follows:
 
6    (765 ILCS 745/15)  (from Ch. 80, par. 215)
7    Sec. 15. Statutory grounds for eviction.
8    (a) A park owner may terminate the lease and evict a tenant
9for any one or more of the following acts:
10        (1) (a) Non-payment of rent due;
11        (2) (b) Failure to comply with the park rules;
12        (3) (c) Failure to comply with local ordinances and
13    State laws regulating mobile homes.
14    (b) Non-payment of rent to a park that has not applied for
15its license or its license renewal and failed to submit all
16fees due and payable under the Mobile Home Park Act shall not

1be grounds for eviction.

4    Sec. 16. Improper grounds for eviction. The following
5conduct by a tenant shall not constitute grounds for eviction
6or termination of the lease, nor shall an eviction order be
7entered against a tenant:
8    (a) As a reprisal for the tenant's effort to secure or
9enforce any rights under the lease or the laws of the State of
10Illinois, or its governmental subdivisions of the United
11States;
12    (b) As a reprisal for the tenant's good faith complaint to
13a governmental authority of the park owner's alleged violation
14of any health or safety law, regulation, code or ordinance, or
15State law or regulation which has as its objective the
16regulation of premises used for dwelling purposes;
17    (c) As a reprisal for the tenant's being an organizer or
18member of, or involved in any activities relative to a
19homeowners' association;
20    (d) As a reprisal for or on the basis of the tenant's
21immigration or citizenship status; .
22    (e) As a reprisal for the non-payment of rent if the park
23has failed to apply for its license or renewal of its license
24and failed to submit all fees due and payable under the Mobile
25Home Park Act.

3    Sec. 17. Notice required by Law. The following notice
4shall be printed verbatim in a clear and conspicuous manner in
5each lease or rental agreement of a mobile home or lot:
6    "IMPORTANT NOTICE REQUIRED BY LAW:
7    The rules set forth below govern the terms of your lease of
8occupancy arrangement with this mobile home park. The law
9requires all of these rules and regulations to be fair and
10reasonable, and if not, such rules and regulations cannot be
11enforced against you.
12    As required by law, the park must be licensed to operate a
13mobile home park either by either the State of Illinois
14Department of Public Health or applicable home rule
15jurisdiction. Pursuant to the Mobile Home Park Act, this
16license shall expire April 30 of each year, and a new license
17shall be issued upon proper application and payment of the
18annual license fee.
19    You may continue to reside in the park as long as you pay
20your rent and abide by the rules and regulations of the park.
21You may only be evicted for non-payment of rent, violation of
22laws, or for violation of the rules and regulations of the park
23and the terms of the lease.
24    If this park requires you to deal exclusively with a
25certain fuel dealer or other merchant for goods or service in

1connection with the use or occupancy of your mobile home or on
2your mobile home lot, the price you pay for such goods or
3services may not be more than the prevailing price in this
4locality for similar goods and services.
5    You may not be evicted for reporting any violations of law
6or health and building codes to boards of health, building
7commissioners, the department of the Attorney General or any
8other appropriate government agency."
