1 AMENDMENT TO SENATE BILL 2183
2 AMENDMENT NO. . Amend Senate Bill 2183 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2MM as follows:
6 (815 ILCS 505/2MM new)
7 Sec. 2MM. Representation of eminent domain authority. It
8 is an unlawful practice within the meaning of this Act for a
9 person to make a representation to another person that the
10 person making the representation has the authority to acquire
11 an estate, leasehold or other interest, or easement in the
12 other person's property by eminent domain if:
13 (1) the person making the representation does not
14 have the authority to acquire the estate, leasehold or
15 other interest, or easement in the other person's
16 property by eminent domain; and
17 (2) at any time before, during, or after the making
18 of the representation, the person making the
19 representation offers to acquire or negotiates the
20 acquisition of the estate, leasehold or other interest,
21 or easement in the other person's property.".
