1 AN ACT concerning day labor.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Day Labor Services Act is amended by
5 changing Section 45 as follows:
6 (820 ILCS 175/45)
7 Sec. 45. Registration; Department of Labor. A day labor
8 service agency shall register with the Department of Labor in
9 accordance with rules adopted by the Department for day labor
10 service agencies that operate within the State. The
11 Department may assess each agency a registration fee not
12 exceeding $250. The fee may be paid by check or money order
13 and the Department may not refuse to accept a check on the
14 basis that it is not a certified check or a cashier's check.
15 The Department may charge an additional fee to be paid by an
16 agency if the agency, or any person on the agency's behalf,
17 issues or delivers a check to the Department that is not
18 honored by the financial institution upon which it is drawn.
19 The Department shall also adopt rules for violation hearings
20 and penalties for violations of this Act or the Department's
21 rules. The Department shall cause to be posted in each
22 agency a notice which informs the public of a toll-free
23 telephone number for day laborers and the public to file wage
24 dispute complaints and other alleged violations by day labor
25 service agencies.

27 Section 99. Effective date. This Act takes effect upon
28 becoming law.
