92_SB0832eng SB832 Engrossed LRB9204573JMpc 1 AN ACT concerning the Department of Agriculture. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Department of Agriculture Law of the 5 Civil Administrative Code of Illinois is amended by adding 6 Section 205-445 as follows: 7 (20 ILCS 205/205-445 new) 8 Sec. 205-445. Long-term lease agreements. The 9 Department may lease any property or facility under the 10 jurisdiction of the Department for a period not to exceed 10 11 years. All such leases in excess of 5 years shall be subject 12 to written approval from the Governor. The Governor may not 13 approve leases under this Section during the period beginning 14 90 days before a gubernatorial election and ending 90 days 15 after that gubernatorial election. All leases for concessions 16 entered into after the effective date of this amendatory Act 17 of the 92nd General Assembly shall contain a provision for 18 the Department to receive a percentage of the revenue 19 generated by the concession. 20 The Department may assess appropriate and reasonable fees 21 for the lease of property or facilities under the 22 jurisdiction of the Department. The Department may regulate 23 by rules the fees to be charged. The Department shall 24 deposit the revenues collected into the appropriate fund 25 supporting the property or facility for use by the 26 Department. 27 Section 99. Effective date. This Act takes effect upon 28 becoming law.
