 1        AN ACT concerning professional regulation.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Nursing and  Advanced  Practice  Nursing
 5    Act is amended by changing Section 20-40 as follows:

 6        (225 ILCS 65/20-40)
 7        Sec.  20-40.  Fund.   There  is hereby created within the
 8    State Treasury the Nursing Dedicated and  Professional  Fund.
 9    The monies in the Fund may be used by and at the direction of
10    the Department for the administration and enforcement of this
11    Act, including but not limited to:
12             (a)  Distribution and publication of the Nursing and
13        Advanced  Practice  Nursing Act and the rules at the time
14        of renewal to all  persons  licensed  by  the  Department
15        under this Act.
16             (b)  Employment     of     secretarial,     nursing,
17        administrative,  enforcement,  and  other  staff  for the
18        administration of this Act.
19             (c)  Conducting a survey, as prescribed by  rule  of
20        the  Department,  once  every  4 years during the license
21        renewal period.
22             (d)  Conducting of training seminars  for  licensees
23        under    this    Act   relating   to   the   obligations,
24        responsibilities, enforcement and other provisions of the
25        Act and its rules.
26             (e)  Disposition of Fees:
27                  (i)  (Blank).
28                  (ii)  All  of  the  fees  and  fines  collected
29             pursuant to this  Act  shall  be  deposited  in  the
30             Nursing Dedicated and Professional Fund.
31                  (iii)  For  the  fiscal  year beginning July 1,

 1             1988, the moneys deposited in the Nursing  Dedicated
 2             and  Professional  Fund shall be appropriated to the
 3             Department for expenses of the  Department  and  the
 4             Board  in  the  administration  of  this  Act.   All
 5             earnings  received  from investment of moneys in the
 6             Nursing Dedicated and  Professional  Fund  shall  be
 7             deposited  in the Nursing Dedicated and Professional
 8             Fund and shall be used for the same purposes as fees
 9             deposited in the Fund.
10                  (iv)  For the fiscal  year  beginning  July  1,
11             2001  1991  and  for  each  fiscal  year thereafter,
12             $750,000 either 10% of the moneys deposited  in  the
13             Nursing  Dedicated  and Professional Fund each year,
14             not including interest accumulated on  such  moneys,
15             or  any  moneys  deposited  in the Fund in each year
16             which are in excess of the  amount  appropriated  in
17             that  year  to meet ordinary and contingent expenses
18             of the Board, whichever is less, shall be set  aside
19             and  appropriated  to  the  Illinois  Department  of
20             Public   Health  for  nursing  scholarships  awarded
21             pursuant to the Nursing Education  Scholarship  Law.
22             Representatives    of the Department and the Nursing
23             Education Scholarship Program Advisory Council shall
24             review this requirement and  the scholarship  awards
25             every 2 years.
26                  (v)  Moneys  in  the Fund may be transferred to
27             the Professions Indirect  Cost  Fund  as  authorized
28             under   Section   2105-300   of  the  Department  of
29             Professional Regulation Law (20 ILCS 2105/2105-300).

32        Section  99.   Effective  date.  This Act takes effect on
33    July 1, 2001.
