 1                    AMENDMENT TO SENATE BILL 751

 2        AMENDMENT NO.     .  Amend Senate Bill 751  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section   5.   The Nursing and Advanced Practice Nursing
 5    Act is amended by changing Section 20-40 as follows:

 6        (225 ILCS 65/20-40)
 7        Sec. 20-40. Fund.  There is  hereby  created  within  the
 8    State  Treasury  the Nursing Dedicated and Professional Fund.
 9    The monies in the Fund may be used by and at the direction of
10    the Department for the administration and enforcement of this
11    Act, including but not limited to:
12             (a)  Distribution and publication of the Nursing and
13        Advanced Practice Nursing Act and the rules at  the  time
14        of  renewal  to  all  persons  licensed by the Department
15        under this Act.
16             (b)  Employment     of     secretarial,     nursing,
17        administrative, enforcement,  and  other  staff  for  the
18        administration of this Act.
19             (c)  Conducting  a  survey, as prescribed by rule of
20        the Department, once every 4  years  during  the  license
21        renewal period.
22             (d)  Conducting  of  training seminars for licensees

 1        under   this   Act   relating   to    the    obligations,
 2        responsibilities, enforcement and other provisions of the
 3        Act and its rules.
 4             (e)  Disposition of Fees:
 5                  (i)  (Blank).
 6                  (ii)  All  of  the  fees  and  fines  collected
 7             pursuant  to  this  Act  shall  be  deposited in the
 8             Nursing Dedicated and Professional Fund.
 9                  (iii)  For the fiscal year  beginning  July  1,
10             1988,  the moneys deposited in the Nursing Dedicated
11             and Professional Fund shall be appropriated  to  the
12             Department  for  expenses  of the Department and the
13             Board  in  the  administration  of  this  Act.   All
14             earnings received from investment of moneys  in  the
15             Nursing  Dedicated  and  Professional  Fund shall be
16             deposited in the Nursing Dedicated and  Professional
17             Fund and shall be used for the same purposes as fees
18             deposited in the Fund.
19                  (iv)  For  the  fiscal  year  beginning July 1,
20             2001 1991  and  for  each  fiscal  year  thereafter,
21             $750,000  either  10% of the moneys deposited in the
22             Nursing Dedicated and Professional Fund  each  year,
23             not  including  interest accumulated on such moneys,
24             or any moneys deposited in the  Fund  in  each  year
25             which  are  in  excess of the amount appropriated in
26             that year to meet ordinary and  contingent  expenses
27             of  the Board, whichever is less, shall be set aside
28             and  appropriated  to  the  Illinois  Department  of
29             Public  Health  for  nursing  scholarships   awarded
30             pursuant  to  the Nursing Education Scholarship Law.
31             Representatives  of the Department and  the  Nursing
32             Education Scholarship Program Advisory Council shall
33             review  this requirement and  the scholarship awards
34             every 2 years.

 1                  (v)  Moneys in the Fund may be  transferred  to
 2             the  Professions  Indirect  Cost  Fund as authorized
 3             under  Section  2105-300  of   the   Department   of
 4             Professional Regulation Law (20 ILCS 2105/2105-300).

 7        Section 99.  Effective date.  This Act  takes  effect  on
 8    July 1, 2001.".
