1 AMENDMENT TO HOUSE BILL 5934
2 AMENDMENT NO. . Amend House Bill 5934 as follows:
3 by replacing everything after the enacting clause with the
4 following:
5 "Section 5. The Criminal Code of 1961 is amended by
6 adding Section 16G-21 as follows:
7 (720 ILCS 5/16G-21 new)
8 Sec. 16G-21. Civil remedies. A person who is convicted
9 of financial identity theft or aggravated financial identity
10 theft is liable in a civil action to the person who suffered
11 damages as a result of the violation. The person suffering
12 damages may recover court costs, attorney's fees, lost wages,
13 and actual damages.
14 Section 99. Effective date. This Act takes effect upon
15 becoming law.".
