1 AN ACT in relation to criminal law.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Criminal Code of 1961 is amended by adding
5 Section 16G-21 as follows:
6 (720 ILCS 5/16G-21 new)
7 Sec. 16G-21. Unauthorized disclosure of personal
8 identifying information.
9 (a) A person who knowingly discloses personal
10 identifying information of another person without the
11 authorization of that person is guilty of a Class A
12 misdemeanor.
13 (b) A person whose personal identifying information is
14 disclosed without that person's consent has a cause of action
15 against the person who disclosed that information and may
16 recover court costs, attorney's fees, actual damages, and
17 punitive damages for damage to reputation or credit rating.
18 Section 99. Effective date. This Act takes effect upon
19 becoming law.
