 1                    AMENDMENT TO HOUSE BILL 2098

 2        AMENDMENT NO.     .  Amend House Bill 2098  by  replacing
 3    the title with the following:
 4        "AN ACT in relation to courts."; and

 5    by  replacing  everything  after the enacting clause with the
 6    following:

 7        "Section 5.  The Clerks  of  Courts  Act  is  amended  by
 8    changing Section 15 as follows:

 9        (705 ILCS 105/15) (from Ch. 25, par. 15)
10        Sec.  15.   Any  clerk  who  fails to enter of record any
11    order or judgment of his or her court within  45  days  after
12    the same is made or rendered, or any clerk having the duty to
13    forward  to the Department of Public Health the record of any
14    judgment  of  dissolution  of  marriage  or  declaration   of
15    invalidity of marriage, who wilfully fails to do so within 45
16    days  after  the close of the month in which the same is made
17    or rendered, shall be guilty of a petty offense and shall  be
18    fined by the court not exceeding $100, and for any subsequent
19    offense  he or she may be fined in a like amount or proceeded
20    against as for a Class A misdemeanor in  office  and  removed
21    from  office.   In  any county of less than 3,000,000 500,000

 1    inhabitants, when it appears to the  majority  of  judges  of
 2    such  court  that there are an insufficient number of persons
 3    employed in the office of the clerk of the court to  properly
 4    make  the  entries  in  accordance  with  this  Section,  the
 5    majority  of  judges  of such court shall thereupon determine
 6    and fix the number of deputies  they  find  necessary  to  so
 7    properly   maintain   the   records,   and  their  reasonable
 8    compensation shall be paid out of the earnings of the office.

10        Section 99.  Effective date.  This Act takes effect  upon
11    becoming law.".
