1 AN ACT concerning the death penalty, amending a named
2 Act.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Code of Criminal Procedure of 1963 is
6 amended by changing Section 101-1 as follows:
7 (725 ILCS 5/101-1) (from Ch. 38, par. 101-1)
8 Sec. 101-1. General purposes.
9 The provisions of this Code shall be construed in
10 accordance with the general purposes hereof, to:
11 (a) Secure simplicity in procedure;
12 (b) Ensure fairness of administration including the
13 elimination of unjustifiable delay;
14 (c) Ensure the effective apprehension and trial of
15 persons accused of crime;
16 (d) Provide for the just determination of every criminal
17 proceeding by a fair and impartial trial and an adequate
18 review, including proceedings in which a sentence of death
19 has been or may be imposed; and
20 (e) Preserve the public welfare and secure the
21 fundamental human rights of individuals.
