Amend House Bill 1670 on page 3, by 3 inserting between lines 27 and 28 the following: 4 "(c-15) No person, when soliciting financial 5 contributions or selling or delivering or offering to sell or 6 deliver any merchandise, goods, or services, may knowingly 7 claim or represent that he or she is representing or acting 8 on behalf of any nongovernmental organization by any name 9 which includes, but is not limited to, the term "fireman", or 10 "fire fighter" which would reasonably be understood to imply 11 that the organization is composed of fire fighter personnel 12 unless the person is actually representing or acting on 13 behalf of the nongovernmental organization and either of the 14 following conditions is met: 15 (i) The nongovernmental organization represents a 16 group or association of active duty fire fighters, 17 retired fire fighters, or injured fire fighters (for 18 purposes of this Section, "fire fighter" has the meaning 19 ascribed to that term in Section 2 of the Illinois Fire 20 Protection Training Act) and the majority of the net 21 proceeds of the contributions, sales, or deliveries are 22 devoted to the purposes of the organization; or 23 (ii) Before commencing the solicitations or the 24 sales or deliveries of or the offers to sell or deliver -2- LRB9004760RCksam 1 any merchandise, goods, or services, the nongovernmental 2 organization enters into a written contract with a chief 3 of a fire department, a fire department, or, a unit of 4 local government, or a group or association of active 5 duty fire fighters, retired fire fighters, or injured 6 fire fighters (for purposes of this Section, "fire 7 fighter" has the meaning ascribed to that term in Section 8 2 of the Illinois Fire Protection Training Act) and the 9 contract contains a requirement that the majority of the 10 net proceeds of the contributions, sales, or deliveries 11 shall be devoted to the purposes or benefit of the fire 12 department, unit of local government, or group or 13 association of active duty fire fighters. 14 (c-20) Nothing in this Section shall be construed to 15 limit law enforcement officers or fire department personnel 16 from soliciting financial contributions for charitable 17 purposes not related to public safety."; and 18 on page 4, line 3, by changing "or (c-10)" to ", (c-10), or 19 (c-15)".
