1 AMENDMENT TO HOUSE BILL 1447
2 AMENDMENT NO. . Amend House Bill 1447 as follows:
3 on page 1, line 13, by replacing "service" with "facility
4 service"; and
5 on page 1, line 14, by replacing "provider" with "provider";
6 and
7 on page 1, line 15, by replacing "provider" with "facility
8 provider"; and
9 on page 1, by replacing line 16 with the following:
10 "facility service provider shall not be retained by the
11 facility service"; and
12 on page 1, line 17, by replacing "provider" with "provider";
13 and
14 on page 1, by replacing lines 19 through 31 with the
15 following:
16 "Except where a recipient has given informed consent, no
17 service provider nor any of its employees shall be made
18 representative payee for his or her social security, pension,
19 annuity, trust fund, or any other form of direct payment or
20 assistance. "Service provider" for the purpose of this
21 Section does not include State-operated mental health or

1 developmental disability facilities. A facility that has
2 become representative payee for a recipient's benefits shall
3 use the benefits in accordance with laws and regulations
4 governing the benefits. As used in this Section, "benefits"
5 includes but is not limited to social security, pension,
6 annuity, or trust fund payments or any other form of direct
7 payment or assistance."; and
8 on page 2, line 1, by replacing "service provider" with
9 "facility service provider".
