      New Act
          Creates the Truss Construction Fire Safety Act.  Provides
      that the Office of the  State  Fire  Marshall  shall  require
      identifying  emblems  on  buildings that have a roof or floor
      with  truss  construction.    Provides  that  the  county  in
      unincorporated areas and  the  municipality  in  incorporated
      areas  shall  enforce  the  Act  and authorizes the county or
      municipality to charge  a  reasonable  registration  fee  for
      buildings requiring the emblem.  Effective immediately.

 1        AN ACT concerning fire safety.
 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:
 4        Section 1.  Short title.  This Act may be  cited  as  the
 5    Truss Construction Fire Safety Act.
 6        Section 5.  Definitions.  For the purposes of this Act:
 7        "Truss" means a framed structural unit made up of a group
 8    of triangles arranged in a single plane in such a manner that
 9    if  loads  are  applied  at the points of intersection of the
10    truss  members,  only  compressive  or  tensile  (nonbending)
11    forces will result in the members.
12        "Truss construction" means a structure in which the  roof
13    or floor is supported by trusses.
14        Section 10.  Display requirement.
15        (a)  A municipality may by ordinance require that a truss
16    construction  emblem  be  affixed  to the front of all or any
17    class of structures within the municipality that  have  truss
18    construction.
19        (b)  A  county  may  by  ordinance  require  that a truss
20    construction emblem be affixed to the front  of  all  or  any
21    class  of  structures  within  the unincorporated area of the
22    county that have truss construction.
23        (c)  Where individual structures with truss  construction
24    are  part  of  a planned unit development or subdivision, the
25    municipality or county may  require  the  truss  construction
26    emblem to be displayed at each entrance to the development or
27    subdivision rather than on each individual structure.
28        Section 15.  Registration requirement; fee.
29        (a)  A  municipality or county that requires display of a

 1    truss construction emblem on all or any class  of  structures
 2    may  require  the owners of those structures to register them
 3    with the fire department or other appropriate agency  of  the
 4    municipality or county.
 5        (b)  The  municipality  or county may charge a reasonable
 6    registration  fee  to  the  owners  of  structures  that  are
 7    required to be registered under subsection (a).   These  fees
 8    shall  be  used  for reasonable costs related to identifying,
 9    maintaining records of, and inspecting structures with  truss
10    construction;  preparing  to  respond and responding to fires
11    and other safety-related situations in those structures;  and
12    any  other costs of implementing, administering, or enforcing
13    an ordinance adopted under this Act.
14        Section 20.  Truss construction emblem.
15        (a)  The truss construction emblem shall  have  a  bright
16    and  reflective color or be made of reflective material.  The
17    shape of the emblem shall be an isosceles  triangle  and  the
18    size  shall be 12 inches horizontally by 6 inches vertically.
19    The following letters shall be printed on  the  emblem  in  a
20    conspicuous size and color:
21        "F" to signify a floor with truss construction;
22        "R" to signify a roof with truss construction; and
23        "F/R"  to  signify  both  a  floor  and  roof  with truss
24    construction.
25        (b)  The emblem shall be permanently affixed to the  left
26    of  the  main  entrance door at a height between 4 and 6 feet
27    above the ground and shall be installed and maintained by the
28    building owner.
29        Section 99.  Effective date.  This Act takes effect  upon
30    becoming law.
