1    AN ACT concerning real property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Director of the Department of Natural
5Resources, on behalf of the State of Illinois, is authorized to
6exchange certain real property in Cass County, Illinois,
7hereinafter referred to as Parcel 1, for certain real property
8of equal or greater value in Cass County, Illinois, hereinafter
9referred to as Parcel 2, the Parcels being described as
10follows:
 
11    PARCEL 1:
 
12    All that part of the Southeast Quarter of the Southeast
13    Quarter of Section 27, Township 19 North, Range 11 West of
14    the Third Principal Meridian, Cass County, Illinois, lying
15    South of the mean high water mark on the South bank of the
16    new Sangamon River Cut or Channel, containing 15.0 acres,
17    more or less.
 
18    ALSO,
 
19    All that part of the South Half of the Southwest Quarter of
20    Section 26, Township 19 North, Range 11 West of the Third

1    Principal Meridian, Cass County, Illinois, lying South of
2    the mean high water mark on the South bank of the new
3    Sangamon River Cut or Channel, containing 4.0 acres, more
4    or less.
 
5    PARCEL 2:
 
6    Tract 1:
7    All that land lying North of the center line of the new
8    Sangamon River Cut as presently located in the Southwest
9    Quarter (SW1/4) of the Southeast Quarter (SE1/4) of Section
10    Twenty-seven (27), Township Nineteen (19) North, Range
11    Eleven (11) West of the Third Principal Meridian, Cass
12    County, Illinois, containing 6.0 acres, more or less.
 
13    ALSO,
 
14    Tract 2:
15    All that land lying North of the center line of the new
16    Sangamon River Cut as presently located in the South
17    One-Half (S1/2) of the Northeast Quarter (NE1/4) of the
18    Southwest One-Quarter (SW1/4) of Section Twenty-seven
19    (27), Township Nineteen (19) North, Range Eleven (11) West
20    of the Third Principal Meridian, Cass County, Illinois,
21    containing 14.0 acres, more or less.

1    Section 10. This transaction will be to the mutual
2advantages of both parties. Each party shall be responsible for
3any and all title costs associated with their respective
4properties.
 
5    Section 15. The conveyance of Parcel 1 as authorized by
6Section 5 shall be made subject to existing public utilities,
7existing public roads, and any and all reservations, easements,
8encumbrances, covenants, and restrictions of record.
 
9    Section 20. The Director of the Department of Natural
10Resources shall obtain an opinion of title from the Attorney
11General certifying that the State of Illinois will receive
12merchantable title to the real property herein referred to as
13Parcel 2.
 
14    Section 25. The Director of the Department of Natural
15Resources, on behalf of the State of Illinois, is authorized to
16execute and deliver to Oquawka Township, an Illinois Unit of
17Local Government, of the County of Henderson, State of
18Illinois, for and in consideration of $1 paid to the
19Department, a quit claim deed to the following described real
20property:
 
21    The Ida E. Rust Parcel, being known as the Delabar State
22    Park Entrance Road and being more particularly described as

1    follows:
 
2    A strip of land 100 feet of even width, the South line of
3    which is 1405.2 feet North 00 degrees 19 minutes East of
4    the Southwest corner of said Section 11, where the West
5    line of said Section 11 intersects the property line of
6    Delabar State Park and extending Easterly for a distance of
7    2,640 feet, more or less, to the West right of way line of
8    State Aid Route 3, in Section 11, Township 11 North, Range
9    5 West of the Fourth Principal Meridian in the County of
10    Henderson, State of Illinois.
 
11    Section 30. The conveyance of real property authorized by
12Section 25 shall be made subject to: (1) existing public
13utilities and any and all reservations, easements,
14encumbrances, covenants and restrictions of record; and (2) the
15express condition that if the real property ceases to be used
16for public road purposes, it shall revert to the Department of
17Natural Resources of the State of Illinois.
 
18    Section 35. The Director of Natural Resources shall obtain
19a certified copy of the portions of this Act containing the
20title, the enacting clause, the effective date, the appropriate
21Section or Sections containing the land descriptions of the
22property to be conveyed, and this Section within 60 days after
23its effective date and, upon receipt of the payment required by

1the Section or Sections, if any payment is required, shall
2record the certified document in the Recorder's Office in the
3County in which the land is located.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
