AMENDMENT TO HOUSE BILL 3120

2    AMENDMENT NO. ______. Amend House Bill 3120 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Director of the Department of Natural
5Resources, on behalf of the State of Illinois, is authorized to
6exchange certain real property in Cass County, Illinois,
7hereinafter referred to as Parcel 1, for certain real property
8of equal or greater value in Cass County, Illinois, hereinafter
9referred to as Parcel 2, the Parcels being described as
10follows:
 
11    PARCEL 1:
 
12    All that part of the Southeast Quarter of the Southeast
13    Quarter of Section 27, Township 19 North, Range 11 West of
14    the Third Principal Meridian, Cass County, Illinois, lying
15    South of the mean high water mark on the South bank of the

1    new Sangamon River Cut or Channel, containing 15.0 acres,
2    more or less.
 
3    ALSO,
 
4    All that part of the South Half of the Southwest Quarter of
5    Section 26, Township 19 North, Range 11 West of the Third
6    Principal Meridian, Cass County, Illinois, lying South of
7    the mean high water mark on the South bank of the new
8    Sangamon River Cut or Channel, containing 4.0 acres, more
9    or less.
 
10    PARCEL 2:
 
11    Tract 1:
12    All that land lying North of the center line of the new
13    Sangamon River Cut as presently located in the Southwest
14    Quarter (SW1/4) of the Southeast Quarter (SE1/4) of Section
15    Twenty-seven (27), Township Nineteen (19) North, Range
16    Eleven (11) West of the Third Principal Meridian, Cass
17    County, Illinois, containing 6.0 acres, more or less.

1    Sangamon River Cut as presently located in the South
2    One-Half (S1/2) of the Northeast Quarter (NE1/4) of the
3    Southwest One-Quarter (SW1/4) of Section Twenty-seven
4    (27), Township Nineteen (19) North, Range Eleven (11) West
5    of the Third Principal Meridian, Cass County, Illinois,
6    containing 14.0 acres, more or less.
 
7    Section 10. This transaction will be to the mutual
8advantages of both parties. Each party shall be responsible for
9any and all title costs associated with their respective
10properties.
 
11    Section 15. The conveyance of Parcel 1 as authorized by
12Section 5 shall be made subject to existing public utilities,
13existing public roads, and any and all reservations, easements,
14encumbrances, covenants, and restrictions of record.
 
15    Section 20. The Director of the Department of Natural
16Resources shall obtain an opinion of title from the Attorney
17General certifying that the State of Illinois will receive
18merchantable title to the real property herein referred to as
19Parcel 2.
 
20    Section 25. The Director of the Department of Natural
21Resources, on behalf of the State of Illinois, is authorized to
22execute and deliver to Oquawka Township, an Illinois Unit of

1Local Government, of the County of Henderson, State of
2Illinois, for and in consideration of $1 paid to the
3Department, a quit claim deed to the following described real
4property:
 
5    The Ida E. Rust Parcel, being known as the Delabar State
6    Park Entrance Road and being more particularly described as
7    follows:
 
8    A strip of land 100 feet of even width, the South line of
9    which is 1405.2 feet North 00 degrees 19 minutes East of
10    the Southwest corner of said Section 11, where the West
11    line of said Section 11 intersects the property line of
12    Delabar State Park and extending Easterly for a distance of
13    2,640 feet, more or less, to the West right of way line of
14    State Aid Route 3, in Section 11, Township 11 North, Range
15    5 West of the Fourth Principal Meridian in the County of
16    Henderson, State of Illinois.
 
17    Section 30. The conveyance of real property authorized by
18Section 25 shall be made subject to: (1) existing public
19utilities and any and all reservations, easements,
20encumbrances, covenants and restrictions of record; and (2) the
21express condition that if the real property ceases to be used
22for public road purposes, it shall revert to the Department of
23Natural Resources of the State of Illinois.

1    Section 35. The Director of Natural Resources shall obtain
2a certified copy of the portions of this Act containing the
3title, the enacting clause, the effective date, the appropriate
4Section or Sections containing the land descriptions of the
5property to be conveyed, and this Section within 60 days after
6its effective date and, upon receipt of the payment required by
7the Section or Sections, if any payment is required, shall
8record the certified document in the Recorder's Office in the
9County in which the land is located.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
