1 AMENDMENT TO SENATE BILL 2740
2     AMENDMENT NO. ______. Amend Senate Bill 2740 on page 3,
3 immediately below line 18, by inserting the following:
4     "(e) An aggrieved unit owner, an aggrieved prospective
5 unit owner, or the board of managers may commence a civil
6 action in State court against a developer or declarant who
7 fails to comply with its requirements under subsection (c). If
8 the court finds that the developer or declarant failed to
9 comply with these requirements, it may award declaratory
10 relief, actual damages, punitive damages and, if appropriate,
11 equitable relief.
12     The condominium association shall not be held liable for
13 the failure of the developer or declarant to comply with its
14 requirements under subsection (c).".
