AMENDMENT TO SENATE BILL 58

2    AMENDMENT NO. ______. Amend Senate Bill 58 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the State
5Entities Single-Use Plastic Reporting Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Single-use plastic disposable foodware" means containers,
8bowls, straws, plates, trays, cartons, cups, lids, forks,
9spoons, knives, and other items that are designed for one-time
10use for beverages, prepared food, or leftovers from meals and
11that are made of plastic, are not compostable, and are not
12accepted in residential curbside recycling pick up.
13    "State agency" means any department, commission, council,
14board, bureau, committee, institution, agency, university,
15government corporation, authority, or other establishment or
16official of this State. "State agency" includes any

1establishment or official of the State that directly or
2indirectly oversees the State's purchase of any product for
3use in the State.
 
4    Section 10. State agencies tracking single-use plastic
5disposable foodware.
6    (a) Beginning July 1, 2024, each State agency shall:
7        (1) track its own purchases of single-use plastic
8    disposable foodware that are less than $2,000 or otherwise
9    not reduced to writing; and
10        (2) establish goals on reducing single-use plastic
11    disposable foodware purchases based on the tracked
12    purchases.
13    (b) Each State agency shall submit a report of its
14findings regarding the matters in subsection (a) to the
15Governor and the General Assembly on or before October 1,
162025.
 
17    Section 90. Repealer. This Act is repealed on October 1,
182026.
 
19    Section 900. The Department of Employment Security Law of
20the Civil Administrative Code of Illinois is amended by adding
21Section 1005-170 as follows:

1    Sec. 1005-170. Polystyrene job study.
2    (a) The Department shall conduct a study on the potential
3impact on the State's workforce of legislation prohibiting the
4sale and distribution of disposable food service containers
5composed in whole or in part of polystyrene foam. The
6Department shall include in the study, at minimum:
7        (1) data related to employment in the State of
8    individuals who are engaged in the manufacture of
9    polystyrene foam;
10        (2) data concerning potential worker displacement that
11    would result from prohibiting the sale or distribution in
12    the State of disposable food service containers composed
13    in whole or in part of polystyrene foam;
14        (3) data concerning the potential for the
15    transitioning of jobs related to the manufacture of
16    polystyrene foam products to similar or other jobs; and
17        (4) recommendations for worker protections and the
18    minimization of job losses arising from the prohibition on
19    the sale or distribution in the State of disposable food
20    service containers composed in whole or in part of
21    polystyrene foam.
22    (b) The Department shall submit the findings of the study
23in a report to the General Assembly and the Governor no later
24than December 1, 2023.
25    (c) This Section is repealed on July 1, 2025.

1    Section 905. The Illinois Procurement Code is amended by
2adding Section 45-24 as follows:
 
3    (30 ILCS 500/45-24 new)
4    Sec. 45-24. Single-use plastics prohibition; preference.
5    (a) As used in this Section:
6    "Compostable" means that the item meets the ASTM D6400
7standard of compostability and has been certified by the
8Biodegradable Products Institute as compostable.
9    "Compostable foodware" means containers, bowls, straws,
10plates, trays, cartons, cups, lids, forks, spoons, knives, and
11other items that are designed for one-time use for beverages,
12prepared food, or leftovers from meals that are compostable.
13    "Disposable food service container" means serviceware
14designed for one-time use. "Disposable food service container"
15includes, but is not limited to, serviceware for take-out
16foods, bakery products, and leftovers from partially consumed
17meals. "Disposable food service container" does not include
18polystyrene foam coolers, egg carton containers, ice chests
19that are used for the processing or shipping of seafood or
20service ware that is used to contain, transport, or otherwise
21package raw, uncooked, or butchered meat, poultry, fish, or
22seafood.
23    "Polystyrene foam" means blown polystyrene and expanded or
24extruded foams using a styrene monomer.
25    "Recyclable foodware" means items that are designed for

1one-time use for beverages, prepared food, or leftovers from
2meals and that are commonly accepted in local curbside
3residential recycling pick up.
4    "Serviceware" means a container, bowl, plate, tray,
5carton, cup, lid, or other item designed to contain,
6transport, serve, or aid in the consumption of food or
7beverages.
8    "State agency" has the meaning given to that term in
9Section 1-15.100 of this Code.
10    (b) After January 1, 2025, State agencies and departments
11may not procure disposable food service containers that are
12composed in whole or in part from polystyrene foam for use at
13any State agency or department and instead shall offer only
14compostable foodware or recyclable foodware for use at the
15State agency or department.
16    (c) After January 1, 2026, or at the renewal of its next
17contract, whichever occurs later, no vendor contracted through
18a State agency or department may provide customers with
19disposable food service containers that are composed in whole
20or in part from polystyrene foam and instead shall offer only
21compostable foodware or recyclable foodware.
 
22    Section 999. Effective date. This Act takes effect upon
23becoming law.".
