AMENDMENT TO SENATE BILL 58

2    AMENDMENT NO. ______. Amend Senate Bill 58, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 1. Short title. This Act may be cited as the State
6Entities Single-Use Plastic Reporting Act.
 
7    Section 5. Definitions. As used in this Act:
8    "Single-use plastic disposable foodware" means containers,
9bowls, straws, plates, trays, cartons, cups, lids, forks,
10spoons, knives, and other items that are designed for one-time
11use for beverages, prepared food, or leftovers from meals and
12that are made of plastic, are not compostable, and are not
13accepted in residential curbside recycling pick up.
14    "State agency" means any department, commission, council,
15board, bureau, committee, institution, agency, university,
16government corporation, authority, or other establishment or

1official of this State. "State agency" includes any
2establishment or official of the State that directly or
3indirectly oversees the State's purchase of any product for
4use in the State.
 
5    Section 10. State agencies tracking single-use plastic
6disposable foodware.
7    (a) Beginning, July 1, 2024, each State agency shall:
8        (1) track its own purchases of single-use plastic
9    disposable foodware that are less than $2,000 or otherwise
10    not reduced to writing; and
11        (2) establish goals on reducing single-use plastic
12    disposable foodware purchases based on the tracked
13    purchases.
14    (b) Each State agency shall submit a report of its
15findings regarding the matters in subsection (a) to the
16Governor and the General Assembly on or before October 1,
172025.
 
18    Section 90. Repealer. This Act is repealed on October 1,
192026.".
