AMENDMENT TO HOUSE BILL 5292

AMENDMENT NO. ______. Amend House Bill 5292 as follows:

on page 2, line 2, after "displacement", by inserting "and refund; consent to share"; and

on page 2, line 3, by replacing "Act" with "Section"; and

on page 2, by replacing lines 5 through 21 with the following:

"(b) A public institution of higher education may reduce a student's institutional financial aid as a result of the awarding of private scholarships to the student in order to comply with the individual or team financial aid restrictions of any athletic association, conference, or other group or organization with authority over intercollegiate athletics, including, but not limited to, the National Collegiate Athletic Association.

(c) If a student at a public institution of higher education has been awarded private scholarships and the student's total financial aid from all sources exceeds the student's financial need, then the public institution of higher education must refund to the entity awarding the private scholarships the amount that exceeds the student's financial need, but no more than the amount of the private scholarships awarded.

(d) If a student at a public institution of higher education gives written consent in the form of a signature for the public institution of higher education to share the student's financial aid report or bill to an entity that awards private scholarships, then the public institution of higher education shall send that report or bill to the entity upon the entity's request.".
