AMENDMENT TO HOUSE BILL 5292

2    AMENDMENT NO. ______. Amend House Bill 5292 as follows:
 
3on page 2, line 2, after "displacement", by inserting "and
4refund; consent to share"; and
 
5on page 2, line 3, by replacing "Act" with "Section"; and
 
6on page 2, by replacing lines 5 through 21 with the following:
7    "(b) A public institution of higher education may reduce a
8student's institutional financial aid as a result of the
9awarding of private scholarships to the student in order to
10comply with the individual or team financial aid restrictions
11of any athletic association, conference, or other group or
12organization with authority over intercollegiate athletics,
13including, but not limited to, the National Collegiate
14Athletic Association.
15    (c) If a student at a public institution of higher

1education has been awarded private scholarships and the
2student's total financial aid from all sources exceeds the
3student's financial need, then the public institution of
4higher education must refund to the entity awarding the
5private scholarships the amount that exceeds the student's
6financial need, but no more than the amount of the private
7scholarships awarded.
8    (d) If a student at a public institution of higher
9education gives written consent in the form of a signature for
10the public institution of higher education to share the
11student's financial aid report or bill to an entity that
12awards private scholarships, then the public institution of
13higher education shall send that report or bill to the entity
14upon the entity's request.".
