AMENDMENT TO HOUSE BILL 3344

2    AMENDMENT NO. ______. Amend House Bill 3344 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Community-Integrated Living Arrangements
5Licensure and Certification Act is amended by adding Section
613.3 as follows:
 
7    (210 ILCS 135/13.3 new)
8    Sec. 13.3. Occupancy factor. The Division of Developmental
9Disabilities of the Department shall, in cases of medically
10required absences from a community-integrated living
11arrangement, provide 100% of the per diem reimbursement for
12any absence to providers while the community-integrated living
13arrangement holds the vacancy for the absent resident.
14Medically required absences shall be exempt from and shall not
15contribute toward the Department-determined occupancy factor
16limit. The absent resident may return to the

1community-integrated living arrangement when the resident is
2medically able to return. The Division of Developmental
3Disabilities shall provide 100% of the per diem reimbursement
4for any nonmedically required planned absence that is included
5in a resident's Personal Plan beyond the Department-determined
6occupancy factor limit to providers. The Division of
7Developmental Disabilities shall provide 50% of the per diem
8reimbursement for all other absences beyond the
9Department-determined occupancy factor limit.
10    As used in this Section, "medically required absences"
11means a situation in which a resident is temporarily absent
12from a community-integrated living arrangement to receive
13medical treatment or for other reasons that have been
14recommended by medical personnel, including, but not limited
15to, hospitalizations, placements in short-term stabilization
16homes or State-operated facilities, stays in nursing
17facilities, rehabilitation in long-term care facilities, or
18other absences for legitimate medical reasons.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
